  We hired Conan Bustos, working under the business name of "BC Design and ************* ***** as a contractor to do work on our home. The contract is attached, it was fully executed on 11-25-21. He told us work would begin immediately upon receipt of payment. We paid him $9,420 per the terms of the contract; this check was cashed per our bank statements on 11-29-21. We were told via text that work would begin on 12-4-21. As of 1-4-22 no work had been done. Conan told us via text message work would now be done the week of 1-10-22. Some of the electrical work listed on the contract was done at that time, but no paint or carpet.As of 1-17-22 no further work had been done on our house. My husband and I regularly called and texted Conan from the time we signed the contract until that date. Most often he did not respond to us. When he did respond he would tell us work would be completed the following day or week but it was not. On 1-17-22 we told him to cancel our contract since the work was not being done. He agreed to cancel. We asked him several times after that for an accounting of work completed and money owed back to us per the contract.On 3-27-22, after many requests on our part, he said he would have the breakdown to us. His text message to us that day was: "I'll have the breakdown today and I'm getting the money together I didn't forget about you guys I don't like owing money that's a fact." To us, this was clear acknowledgement that funds were to be returned to us. On 4-5-22 we requested the breakdown and refund again. No response. On 4-6-22 we contacted him again. No response. On 4-8-22 we contacted him again; he stated that his assistant, ****** emailed us the breakdown. I spoke with ****** directly and she emailed the breakdown on 4-9-22. The breakdown is attached showing $4,580 owed to us. We have not received any of the $4,580 owed to us and he has not responded to our calls/texts since 4-26-22. We are hoping for help obtaining the refund. Thank you.
