Searching the address in question this fence was installed in 2011. There is a 3 year warranty on the fence. The name on this complaint is not the same as that on the original order. I purchased a new fence form *******'s Back Yard in June 2023. I authorized payment on June 7th. They came out to finish towards the end of June. When they were almost done I called and got ********************* and complained about scratched/damages fence panels and improper screws used. I also complained about gate lock not being the one advertised and I wasn't given an option for gate latch. July 10th I authorized and filled out a service form for them to come out and finish but also take care of the items mentioned. My wife got a call from supposedly the owner (I don't have a name) to talk about the fence. She let him know the issues. They eventually came out to finish but did not address all my issues. They installed the right screws and fixed the off centered fence. There was still scratched and gouged panels. They didn't address gate lock. And there were new issues. Driveway gate posts were black and not advertised as black. More scratched panels and driveway gate latch post was crushed. Driveway gate screws were already rusted after three days. July 23rd I sent a long email back describing issues and also stated there is language barrier with the crew and I felt that If I spoke with a project manager that understood my complaints they can alleviate them. I never talked to any manager but they came out July 29th to finish. They covered posts with sleeves to color match. They painted over rusted screws. And they did not fix or replace any scratched/gouged panels or the crushed gate post. Reached out July 31st to ***** again. Received a phone call. Emailed again with issues and requested to talk to a manager again. I had a flood in my other home to take care of in the meantime but never heard back. Was going to file BBB complaint but it says to call ********************* first. Called and asked for him and left a message. ***** intercepted message and called me back. She said she would have him call me. Haven't heard since and it is 10/22/23.Business response

Dispute: Americas Backyard has cost us so much money with the damages they knowingly did. They stand to not be responsible for underground fixtures like sprinklers or gas/cable lines as stated in small print. With that being said, our property and our neighbors property was significantly damaged. Once we were not happy with their services, staff ignored our calls. It seems they do not answer the phone so they can choose who and who not to call back. Our cable line was cut and repaired wrong. Both our sprinkler lines in the back and our neighbors sprinkler lines on the side were destroyed. We had no idea until the yard was flooding. Our neighbors are elderly and their grass died without a working sprinkler in the heat of summer. We had to pay for our sprinkler damage, their sprinkler damage, and their landscaping repair. The sprinkler company reported it is very unlikely the installers did not know they were hitting feet of sprinkler as they made their way down the yard. They could have stopped and moved over, but they chose to keep going. We asked for a $1,200 credit, to cover ONLY our neighbor's repairs, but it was declined by ****************** and ***** Fargo who we filed 2 claims with. Also, Americas Backyard charged our credit OVER THE LIMIT we were approved for. They told us after doing it saying, It went through. We also reported this error to ***** Fargo. There are bent/misshaped rods weve reported to ******************. We now need to call the fence manufacturer to help us change them. After filing a dispute, seeking MINIMAL compensation for the neighbors damages (not including our own property), we were denied. Our only option is to eat the costs and report our experience to BBB. Customer was notified prior to installation that sprinkler systems are not marked and we do not accept responsibility for them. It is on his contract. I did give his information to someone who could fix it for him but he did not cooperate with them. We are not responsible for sprinklers.Initial Complaint

We had ****************** install a fence, during installation the workers hit several underground sprinkler lines. We attempted to contact them several times. ***** in the office was extremely rude stating they're not responsible for damage that occurs during installation. We tried to get them to fix the damage and they refuse.Business response

The work order was to install a fence located in the backyard. The complaint I have is that first they left cement stains in my driveway, walkthrough pavers , backyard pavers, water running for 4 hours, cutoff an Evergreen after telling them to pull out the Evergreen with root to be able replant another location, leaving mudstains in backyard pavers. I've brought this up to to ******** and *****. They've promised a cleanup crew to come by but then called that they had noone to come out because of a person going on vacation. I was mislead by stating that they've called and spoke with my wife on the attempt to cleanup. My wife stated that she did not speak with anyone from America's Backyard. Dishonest was not appreciated from *****. My issue is still not dealt with. They stated they would inform management but noone has called me back to at least have a resolution. The cost of the Install of the fence was $5,200.00. It is unacceptable in the outcome of the Installation of Fence. **************** was very poor. I hope that Management can give me a resolution by reimbursing me for the cost of the Evergreen, cost of running water and cleanup cost if I hire someone else to clean up.Business response

Purchased fencing from the company. They also completed work on both neighbor's yards. They made a significant error measuring our yard on the side with our neighbor to the left, and as a result, there is a large gap at both the front end and back end of the fence on that side. The right side of the fence was done properly but the left side has gaps large enough for human beings to walk through let alone our dogs to escape the yard. We had to tie metal shelving around the gaps resulting in the property and the properties around us look bad. Our neighbors are frustrated that we had to do this but they are frustrated with the company not us as they understand that we had to do this. The village Lemont needs to sign off on this work and they will not do that. Multiple attempts to resolve this issue with the company has been made for the last three months, and they either ignore our messages or have us submit pictures as proof and then never schedule with us to come out and fix it.Business response

We were contacted by ********************* who identified himself as a representative of ****************** to build 2 decks (pool and house).He was referred to us by another employee of the same company. On May 25, 2021 we agreed to go under contract with **** paying 1/3 of the total cost for deposit. Contract is on ****************** paperwork with warranty and all permits obtained using ****************** information for approval. Throughout the process of building many concerns were raised to **** going unresolved. We reached out to the owner of ******************, *****************, multiple times for resolution with no response. Finally threatened *** with BBB notification to which he returned the call stating our contract is not on his books so he didn't call us back. This is negligence on behalf of ******************. *** came to our home stating this work was done illegally, but he'll find someone to finish the work for same price. Honoring an illegal contract is not professional or acceptable.Business response

I am rejecting this response because: **** was referred to us on behalf of Americas Backyard. He did not submit our contract through them even though he used the paperwork to get us to agree. Our multiple calls for concern early on to *****************/ Owner of Americas Backyard went unanswered. *** started to us directly (that we have audio of) stating he did not return our calls because we were not on the books. This is negligent action directly from *** to reject calls for concern when customers stated they have a contract. ************ has poor quality control with SubContractors having access to contracts and permits without approval. It is Jims responsibility to obtain and return our deposit and garage funds. He may collect from **** on his own. We should not have to collect since this went through Americas Back yard contract. *** also stated directly to us in person that he would put the pressure on **** to return our funds. We will take no further action should these funds be returned to us so we may start over. $8480 deposit + $1700 garage door.

I am rejecting this response because: The contractor was referred to us BY Americas Backyard. The contractor did not file our paperwork through Americas Backyard as he should have. This is NOT our responsibility to ask if he had. When a company refers a worker, it is their responsibility to follow up if the contract was accepted or not. The poor controls at Americas Backyard is their own liability. We gave their representative our deposit and paid for his damage to our home. This needs to be returned to us by the representative company which is Americas Backyard. It is up to them to collect from him further. Not us.See attached contract with Americas Backyard.
