On June 11, 2022, we signed a contract with ***********************, of TLZ Landscaping, for them to do landscaping work behind our home with an estimated start date of June *****, 2022.On June 11, 2022, we issued a check in the amount of $2,925.00 to TLZ Landscaping. This payment was a deposit of 75% of the total job of $3,900.00. TLZ Landscaping picked up both the check and executed contract in person on June 11, 2022.Our dispute is that we never received the services from TLZ Landscaping under the contract and are entitled to a refund of our $2,925.00 deposit. TLZ Landscaping kept delaying the project start date for various reasons for five months between June to October of 2022. By the end of October 2022, *********************** of TLZ Landscaping agreed to refund our deposit to resolve the issue of their failure to perform the contracted services. Four months later, we still have not received the refund check despite multiple communications and promises from TLZ Landscaping to provide the refund. Like the project delays, we are given a two weeks at most excuse without any resulting action.We want to be refunded the $2,950.00 deposit, as agreed to in writing.Business response

Good Evening,
We apologize the delay in reply. We honestly apologize to our client and have in no way wanted to rip them off or steal their money. We honestly have have one issue after another. My husband who is not legal in the country was deported and our entire team fell apart. My other employees quit and I was left without any other option. I have been able to bring my husband back and will complete their project. We only ask for about 3-4 more weeks for the weather to become more stable. We of course understand if they are not able to. We will definitely pay all of the down payment back as soon as we get our income tax return. We estimate to get our return in about 3 weeks around the same time we would be over to complete the project. Again our apologies and hope we can resolve this matter in the best possible way. Thank you.

I am rejecting this response because:We do not want the business, TLZ Landscaping, to complete the project. Our project was completed by another contractor in November 2022, after TLZ Landscaping agreed to provide us a full refund of our deposit.
From TLZ Landscaping's last email on January 23, 2023, TLZ Landscaping said our refund check would be ready in 2-3 weeks. That date passed on February 13, 2023, over three weeks ago.
For over four months, TLZ Landscaping has given excuse after excuse and told us they needed just "2-3 weeks" to provide our refund check. There has been zero progress in resolving this matter.
The only acceptable resolution is a full refund of our deposit, in the amount of $2,925.00, as agreed to by TLZ Landscaping.

I am rejecting this response because:TLZ Landscaping has given the excuse of "2-3 weeks" and "asap" for nine months now, since June 2022.
The only acceptable response is when they take action to refund our deposit, and we have received the check.

We definitely understand and agree it has been longer than what we had estimated. As I explained before my husband has been ill and not been able to work properly. I will have the money as soon as our tax refund is received and we estimate it will be soon. I will email ****** personally and let him know when I have sent over payment.Customer response

I am rejecting this response because:Until we receive the actual check, and refund amount in our bank account, we will continue to reject the business response. We gave a deposit check to TLZ Landscaping about 10 months ago, and were promised a refund over 5 months ago now.
