      To Whom it May Concern:

      I received Travel Center's letter dated 8/21/23 to inform me that my account with *** Land Travel ("Sea Land"") continues to be in serious arrears. Since my first telephone response on 9/28/20 to *** ****** initial collection request, and my numerous telephone responses since then to numerous subsequent collection letters have fallen on deaf ears, I have decided to repeat my responses and position. this time in writing.

      I don't owe *** Land anything, not for annual membership dues or otherwise. I consider our Membership Application contract dated 1/13/09 null and void as *** Land never provided written notice at least 30 days prior to annual payment date, never provided annual invoices, and never provided updated directories and membership cards as required by such contract. Also, 1 received *** land"s first undated collection letter on 9/24/20 (ten years later), long after the Statute of Limitations had run out in Texas and Illinois.

      On numerous occasions, I requested copies of all annual notices and all annual invoices which *** land alleges they mailed to me timely, but which I never received. For whatever reasons, they refused to provide me with such copies. I also offered to pay *** Land $100 in cash just to make this matter ·'go away·· which *** Land rejected. I understand the current balance *** Land alleges I owe is about $4,000 which represents thirteen years worth of dues.

      Cease and desist harassing me by continuing to seek collection of this bogus debt. I have no intentions of paying it. I will not participate in this shakedown.

      Member has received yearly billings, re-billings, calls, emails along with weekly newsletters with current specials and offers. We have made multiple attempts to contact the member to help them either bring their account up to date to utilize the services they purchased, bring it up to date to sell/transfer as their contract states, along as the account is current and we approve the transfer or to close the account through a Mutual Release. There has been no response on the members part to resolve the account. 

      Member(s) contract states if their account is setup on auto-pay they will then receive a notice 30 days prior to the dues being withdrawn, member(s) account is not on auto-pay, therefore; as their contract states they are billed on their anniversary date each year. All promises made per member(s) on our part has been held. We have offered member(s) on multiple occasions a fair settlement agreement to resolve their account which was not completed. The only thing we are required to provide member(s) is a copy of their binding contract, which has been sent to member(s) on 2 different occasions just in 2023. 

       

      We are here to help the member in resolving the account. These members are no different than other members who have failed to pay as agreed and had previously never requested to cancel. These members simply need to contact our office to either pay their fees up to current to use the benefits or to sell/transfer their membership themselves just as their contract states with our approval of that sell/transfer or the other option is to contact our office to reach a fair settlement agreement to properly close/cancel through a Mutual Release document which breaks the current agreement then having no further cost or obligations.

      My initial "Membership Agreement" was signed on 5/15/2011 and was an Initial investment of over $2000 to join. Annual dues are $199 plus fees. Have attempted numerous times to cancel because I do not feel I am getting value or quality from the offerings, and in many cases the restrictions (e.g. no pets allowed for "condo weeks", minimum 7 day stays, etc) prohibit me from making reservations. Management and customer service has been adamant I cannot cancel and that this is a "lifetime" commitment. Company is non-transparent and my research shows they are affiliated with a number of other travel 'clubs' with different names! Recently was offered the option to change the membership agreement to a non-renewal plan for an addition $1000! I have more than paid my fair share of dues for the services I have received from this company and just WANT OUT. I have been threatened to be turned over for collection if I do not pay annual dues. I have an excellent credit report so I continue to pay to avoid hurting my record. I would never have signed up for this membership if I had realized or made to understand what it really was. My initial 'investment' was through a sales group named "***** ********" and ***********" was marketed as a luxury vacation club with wonderful value. I have found this to be very misleading and not at all accurate... a person can get as much or more value from booking travel themselves. I feel I am a 'hostage' in this situation and theoretically have considered KILLING MYSELF for having been duped and to finally have a viable option to get out of this program.

There has not been any request to close member(s) account. We are collecting on a debt owing to the company, as member(s) entered into a contract with us agreeing to all terms and conditions, member(s) are simply trying to get out of a debt owing.

      I have kept a LOT of notes of my discussions with this company over the years... and have attached some of those from just these past 2 years in which I repeatedly asked for options to cancel out, I am NOT surprised at the reply they provided as it similar to the responses they have provided other clients who have filed complaints against them.  I would be happy to take this to an attorney if I knew where to start looking for one that handled these types of issues.  As previously stated, I have continued to keep my dues up-to-date to avoid affecting my credit report, and have even used the program in the last year as it appears I am being FORCED to... even though I can make travel arrangements at the same or lesser costs.  I am so frustrated and at a loss for how to end this relationship.  Any recommendation you can provide me on who/where/what to do next would be appreciated.  My efforts to speak with the management by phone have been futile and it appears the only way I am going to get out is to PAY the 'ransom' they are asking for... or die.  This is just NOT RIGHT and I am afraid any further transactions I have with them will have additional 'unseen' 'unknown' and 'unfair' obligations attached... I am quite frankly AFRAID to try to discuss the matter with them any further. PLEASE give me some solid advice.

      I am rejecting this response as I have not agreed to transfer/sell my account because 1) I know no one I know wants to assume this liability/responsibility and 2) I have not agreed to the 'demand' (amount required) that was proposed to me last year.  I will, however, attempt to contact the company again to review what options are currently available for closing the account.  I respectfully request that this dispute/claim remain open until I have contacted the business.

      When I closed the ******* ****** account years ago the male employee I spoke to never mentioned a mutual release form. The original contract was destroyed after I cancelled the contract and ******* ****** or FunSeekers Inc. has not provided a copy lately. Yearly billings, re-billings and emails along with weekly newsletters with other correspondence has not occurred. We have lived at our current address for twenty-seven (27) years, so we have not received the above mentioned correspondence. I have provided three attachments of written correspondence we have received. Phone calls from ******* ****** and Financial Services/America began this year requesting membership debt resolution. I indicated that the membership was cancelled over nine years ago. This is a poor business practice. If they treat all their members in this way, that is why I contacted the Better Business Bureau. They have not honored the membership cancellation from years ago. I do not know who FunSeekers is! If Financial Services of America is not a collection entity, I don't know their mission.       There has not been a request to close member(s) account by mail, phone or email. If member(s) did in fact close their account they would have obtained a Mutual Release, which was already explained to them when they contacted our office in June of 2023 and in 2022 when they contacted our office, if member(s) do have a Mutual Release they will need to submit the proof as our records indicate one has not been completed. We have not turned this over to a collection agency, we have many departments here in the corporate office. We have also provided member(s) a copy of their contract to validate the debt owing.

      We believe they are trying to collect from us further money for a membership which was closed over nine years ago.  The proof of cancellation is that they did not contact us for nine years so we do not owe any fees.  We continue to disagree and will not pay them.  ******* ******, Fun Seekers, Inc. and Financial Services of America are all trying to collect on a membership that was closed over nine years ago.  ******* ****** agreed to the closing.  Sam and I are not paying them for any fees.  I have told them by phone the above.  We reject.

      Ten years ago I canceled our membership with Sealand Travel. We had been members for four or five years from 2009-2014 approximately. Recently they began calling us for membership dues. I explained that I had canceled years ago. They have continued to harass us for fees. I have explained that this was cancelled over nine years ago. Now Sealand Travel has turned this over to a collection agency for a payment. I do not intend to pay these fees. The collection agency is Financial Services of America in Litchfield, Illinois. I do intend to report Sealand Travel to the Federal Trade Commission and Consumer Protection. I wonder how my case falls under the Fair Debt Collection Act? Is this a case of fraud? I have paid Sealand Travel or the collection agency nothing.

      My late husband and I joined Tradewinds in 2012. We used them only once for a condo in south TX. The unit was not what was pictured on the website. It was smaller, had bugs, was dirty, was not on the beach. We called to complain, and they would do nothing to get us another unit free of bugs. So, we had to rent a hotel room at our cost. We proceeded to contact them and informed them we wanted to cancel our membership. They told us if we didn't pay the annual dues that we would just not be able to use the service. No cancellation needed. We spoke with ***. Did not hear from them for 10 years (no calls or mail). In 2020 and then all of a sudden start getting calls and invoices. I spoke with an agent and told her that my husband who did the membership passed away Aug 2019 and that I would not be paying for membership and hadn't for years. In July of 2022 I got a call from an attorney's office that was representing plaintiffs as they were suing TW for fraudulent activity. I asked to be placed on the plaintiff list. That was probably actually Tradewinds trying to get my new address as I moved from TX to NH. I then started hearing from Tradewinds in the fall of 2022 and they've been calling every week at least 10 times from a 214-area code number. They don't leave messages. And then I try to call back the numbers aren't valid. I block the numbers and they persist. and I get invoices in the mail for past due amounts which I am not going to pay.

      Member(s) concern of a property has nothing to do with us as member(s) have not placed any bookings with us, stating member(s) booked a condo with us is a false statement, regardless of that, that would be a property issue not a travel issue.

I spoke to *** and was told I did not need to do any more to cancel the account as my call was to cancel. I was sent no correspondence for years. I do not receive weekly emails. I do not receive monthly. They have come sporadically. We did in fact book a condo in Corpis Christie tx through member services so the company is lying.

      Member(s) have not spoken with ***, in 2020 member(s) account came due, member(s) contacted our office regarding a letter received from our benefits administrator and did not want to speak with them, the Director at the time, *** contacted them on member(s) behalf to notify that office of that, member(s) stated they wanted to continue with their Tradewinds Vacations package. Member(s) were previously offered a Mutual Release and declined the offer. 

       

      Member(s) account once again came due in 2020, member(s) has received weekly and biweekly emails, and phone calls along with mailings via USPS on a monthly/biweekly basis. Member(s) did not book any trip through our Travel Department and will need to send proof of the booking completed by Travel Center, as there has not been one.

      My husband (***********************) and I purchased a one week Platinum membership in Island Trader Vacations on 2/28/2013 for $2,687.00. We paid $249 annual dues in 2014 and again in 2015, and notified them in 2016 that we were cancelling our membership due to not being able to obtain any type of travel arrangements thru them. We heard nothing from them for approximately five years, then in 2021, they starting sending us monthly (sometimes 2 times a month) statements for past annual dues amounting to $1349. We also received notices from several supposedly collection agencies (**********************************. and *****************************) both located at same address a Island Trader Vacations. In June, 2023, they reduced the amount owing from $1353 to $920 if we pay and ***************. We have never used this service and do not intend to pay anything further to this/these bogus companies. My husband and co-owner, ***********************, is 92 years old, has Alzheimers, and is in an Assisted Living facility. I am 83 years old and financially strapped due to his care expense, etc. We don't appreciate the threats by mail and phone calls and wish to have no further contact from any of these companies or subsidiaries.

      At some point in the past (I can't even find any email history on this) we purchased a vacation through funseekers... I cannot remember when or where we lived at the time that is how long ago it was. We realized we had no interest in utilizing their services and requested to cancel. The company never provided any response to our inquiry, so we assumed the matter closed. We now receive regular emails / phone calls / Texts telling us we owe money for services rendered and yearly membership. To date I have ignored all correspondence to avoid giving them the incentive for direct contact. I have no intention of responding or participating in any interaction with this organization and wish everyone to know how they are nothing more than a scam who use poorly worded contracts and agreements in an attempt to extort money from unsuspecting people.

      I understand that while we may have not fully understood the conditions, I do not believe they were ever reviewed Ina clear and sufficient manner that anyone not a lawyer would understand and comprehend the need for notifying this company of intentions beyond initial payment.  it is in fact the same company currently in several suits on the same subject. 

       

      I have no desire to ever use use their services and have notified them of my intent via phone several years ago.. however after believing that sufficient (not notified on call that additional documentation or action on my part was required) they have begun to harass myself and other family members with what I consider to be threatening emails and texts.  

       

      i do not wish to interact with what I believe to be a fraudulent company further and wish anyband all plans/agreements ended with no further use and/or payments.

      I am a retired police officer on a limited income, who, back in 2013, was invited by the company for a free lunch to listen to a vacation club presentation. My wife and I were told that if we paid $ 1,500.00, that we would receive full benefits of the vacation club, and 2 round trip airline tickets for myself and my wife anywhere/anytime in the USA. We paid the $ 1,500.00, never received the airline tickets, and were told the contract was 3 years, making it expire in 2016. 7 years later, we have been contacted by Voyager Vacation Club, stating that even though the contract was over 7 years ago, we would have to pay and additional $ 498.00 to get out of the contract. They threatened to turn the account over to a collection agency and the IRS. I feel that they are in breach of contract, as we never got anything from Voyager Vacation Club except the free meal that they promised us to listen to the presentation. They, in turn, kept the $ 1,500.00, never gave us the 2 round trip airline tickets for anywhere in the USA, and now want an additional $ 498.00 to cancel the contract. This appears to be a scam to me, making you pay more, to a company you never received anything from, who is threatening to turn this over to a collection agency and ruin my credit, as well as the Internal Revenue Service. This type of deceitful business should never be allowed to operate and scam people out of their hard earned and limited monies, and then never deliver what they promised. In my opinion, the whole thing should be dismissed for breach of contract on their part. Please help, I will have no other recourse but to fight this with a lawyer if need be, which will cost way more that the $ 498.00. But it is the principle of the thing, folks, and right is right. Had they held up their end of the bargain, I wouldn't have a let to stand on, and would have to pay what they ask to cancel the contract. Please help stop these scamming business types.

      I am rejecting this response because: Voyager Vacation Club promised 2 round trip airline tickes to any destination in the USA, and they were not provided as agreed, and they have been paid $1,500.00 already, and are demanding more...$ 498.00, under threat of turning this over to collection agencies and the IRS.  This should constiture a breach of contract on the part of Voyager Vacation Club.  This appears to be fraud and a contract scheme to extracy more money for services not rendered, but agreed upon...similar to time share contract scheme, where the contractual company will not release the 2nd party unless they pay more money.

      Member(s) purchased the Voyager Vacation Club product, member(s) purchased their package from an independent sales and marketing office called 'Funtasia Vacations' any gifts given at the time of purchase is the sole responsibility of that office and has nothing to do with us, those gifts are given regardless if member(s) purchased the membership or not, they received those gifts for just attending the presentation.This should have also been addressed within the first year of purchasing, not now. 

       

      These members simply need to contact our office to either pay their fees up to current to use the benefits or to fulfill their term as they agreed per their contract paperwork.

      I joined Castaways Vacation Club in 2006 with a partner. I called and cancelled the membership in 2012, having never used it, nor did my ex partner, & I paid a fee to cancel as I remember speaking with a man on the phone. I can’t remember the exact date or amount, but I kept the information for 8 or 9 years then discarded it. I heard nothing from them for 10 years. Then in May 2022 I received a letter stating “An audit has been performed on your Castaways Travel Club account for the end of 2021 which has revealed the following: Your account shows that a significant balance is outstanding on your Travel Club annual dues account”. I contacted them by phone stating that I had cancelled my membership 10 years ago & had not heard from them in 10 years & that I didn’t owe them any money. They continued to send letters monthly. I didn’t know how to handle this so in April of this year I enlisted the help of a lawyer who wrote them a letter on my behalf telling them to cease communicating with me. I received a letter from Financial Services of America *** * ***** ****** *********** ** ***** ************ a couple of weeks ago which said “Per IRS publication 4681 we may be required to report to the IRS on any debt forgiven in excess of $600.00 as income to you. We have been authorized to offer a settlement of this debt if you contact our offices within 14 days of receipt of this letter. I check my credit score regularly, which is over 800, and nothing has shown up there. I am tired of being harassed by this company & I don’t owe them any money! I read that they have an F rating with the BBB & have read stories of other people who are experiencing the same problem as me & references have been made that Castaways doesn’t have records going back 9-10 years.       Two or more decades ago, we purchased a membership with Sea Land Travel Club. We attempted to use the club services to travel but was not able to find any value more than regular prices. We tried cancel and get our money back but was unsuccessful at that time. Recently, the club has sent us several letters attempting to solicit us to pay back-due club fees. Most recently, they have attempted to bully/scam us to pay these fees using the Financial Services of America collection agency, at the address provided in the complaint. They claim they will "report this debt as taxable to the IRS"

      Member(s) purchased their membership on 03/23/2010 and paid their dues for several years after purchase. Member(s) only have 3-5 days of rescission time to close their account after their purchase date and to receive a full refund from the sales office which they purchased from. 

      Member has received yearly billings, re-billings, calls, emails along with weekly newsletters with current specials and offers. We have made multiple attempts to contact the member to help them either bring their account up to date to utilize the services they purchased, bring it up to date to sell/transfer as their contract states, along as the account is current and we approve the transfer or to close the account through a Mutual Release. There has been no response on the members part to resolve the account. 

      We are here to help the member in resolving the account. These members are no different than other members who have failed to pay as agreed and had previously never requested to cancel. These members simply need to contact our office to either pay their fees up to current to use the benefits or to sell/transfer their membership themselves just as their contract states with our approval of that sell/transfer or the other option is to contact our office to reach a fair settlement agreement to properly close/cancel through a Mutual Release document which breaks the current agreement then having no further cost or obligations.

      I am rejecting this response because:


      Their claim of membership purchase date is wrong, we joined during the early 1990's in Colorado Springs, CO. We paid the joining fees and one year membership at that time. A few weeks later, we contacted the company to cancel the membership. After multiple attempts to engage the company to cancel, without success, we wrote the deal as a lesson learned. We never renewed the membership. After 7-years, of no contact from the company we discarded all documents. We did not receive yearly billing at all during that time, nor did we receive any offers.

      When we recently in (the last two years) received a request for payment, we considered this a phishing scam since it had been so long since we canceled and had not heard from the company. Given the inaccuracies of the company's response, I am further convinced this is a scam to squeeze money from a former member, who never received any benefits from the company.

      Our position remains that we do not owe them anything and wish they would stop harassing us.

      We will be emailing a copy of member(s) contract paperwork to the email provided, it was not purchased in the 90's member(s) must have this confused with something else.
