We signed a contract with Above Par construction, gave them a check for $4,161.53. This was the money from our Insurance claim for the roof damage. NO WORK WAS EVER PERFORMED AND THEY STILL HAVE OUR MONEYBusiness response
03/21/2023
The job was contracted and then moved into the supplement phase, as it was only a partial approval with the insurance carrier. I know there was a reinspection with the carrier back in June or July and my understanding was there was still discrepancies being addressed. Either way, I'd be more then happy to discuss things with you personally and go over what options we have to get this completed and resolved. My direct contact info is below.

Complaint: 19588420
I am rejecting this response because:I left a message on *****'s cell phone number that was listed as well as followed up in email and still no response. This has been our typical interaction with this company. If and when we could get a response from someone, they would promise a follow up with a date and never meet that date.
Yes, Above Par did send pictures to Allstate; however, Allstate did NOT accept them as they were blurry and didn't depict the damage. I asked several times even giving additional details from the adjuster on what they were looking for but it was never provided to the insurance company.
So here we are with NO repairs, approve or otherwise, and Above Par has $4,161.53 of our money for NO services rendered.
Sincerely,

This is a 2nd complaint against this company the first complaint was closed because they offered to fix the mistakes that were made the first time and promised to extend our warranty, they did try to fix the problem with a new crew which we were told the siding was nailed 36 to 38 inches throughout the house when it should be 16 inches, we now have siding falling off the back wall , we have placed several calls and no one has responded the first case was given the number ID # ******** they have not only LIED to us but to the BBB saying that subject would be resolved ...which has not been resolved and refusal of answering phone calls or from keeping our siding from buckling and falling off the wallsBusiness response

As addressed before, we have extended the warranty on the project to provide peace of mind for the customer, we have also agreed to come by and detach and reset as well as replace some siding needed to expose and ensure that proper fastening requirements are met. ************ and I spoke about 2-3 weeks ago to discuss and agree on how everything will be addressed and fixed, as of today we are still waiting on the special order siding to arrive. As soon as the siding needed comes in, ************ will be notified and the repairs will be scheduled.

I am rejecting this response because: Mr ********************** has continually promises to state an extended warranty which has never been put in writing at least 25 phone calls have been placed to Above Par where only a handful of returned calls from Above Par . Three minor repairs made which all have failed we have fallen siding in the back which we had called for them to help get it down but once again no returned phone calls ,if they would just contact us to let us know that repairs would be on the way with a time frame would help and some actual action this issue has been on going since March 9th when the first price of siding fell off

We will reach out the week of 12/5/22 to discuss, and schedule a time for the repairs as well as the written warranty to be dropped off....Most recent discussion I had was with ************ approximately 3 weeks ago informing him about the special order wait time on the siding and to discuss the plan for the repairs, at that time we were both in agreement.

Contracted Above Par construction on 2/2/2022 for the reroof, replacement of fascia, gutters, as well as the addition of 2 overhangs. At that time a $10,000 payment was made. Per the contract the work was scheduled to be done in Spring with a completions date listed as **** days. The permit was not approved until August, once work. actually began, an additional $21,000 was paid on 8/8/2022. As of this writing (10/25/2022) project is not completed. There are multiple code issues that Above Par Construction has yet to address as well as workmanship items that need to be rectified including but not limited to the continuous ridge vent not being properly fastened, the replacement of a skylight which they damaged on Installation, the replacement of a screen damaged while they were doing their work, and Insufficient ice and water shield being installed, and adjustments/replacement of fascia materials on the 2 overhangs to facilitate the installation of soffit material along with the removal of debris and remaining leftover building materials. In addition there are multiple issues as identified by the building inspector that would preclude them from being accepted. On 9/23/2022 a final invoice was sent to me (The day before the gutters were installed) and ************** arrived 2 hours after the gutters were installed demanding payment be made in full or no further work would be performed. No further work has been completed as of this date. I am withholding final payment per the addendum signed by ************** which states Do not sign a certificate of competition or make final payment until the work is done to your satisfaction. On 10/22 I received notification of intent to place a lien from ******** Building supply for $11,417.57. No work has been performed in over 30 days on the property since the gutters were installed on 9/24. I have already paid $32k and contend the lien amount is the responsibility of the contractor. Additional information available on request.Business response

A final invoice was provided to the homeowner outlining the balance that would be due, his gutters were indeed installed the following day and I stopped by to see if he was happy with everything because we were finally on the last step after a long process with some unexpected delays. He informed me that the gutters looked great but there were some minor punchout items he made me aware of, I informed that these were punchut items and that the work was completed barring the repair of his punchout items and I agreed with all of them. With that said, his final balance was over $20,000 and I suggested retaining a certain portion until all punchouts were completed, but he insisted that not another payment would be made until repairs were completed, in fact he stated in an email that after repairs were done he "would consider making final payment". To be honest it's really upsetting when a homeowner holds an unreasonable amount of $ over your head, I understand not paying in full until everything is done to satisfaction as I am personally the same way, but I never asked for payment in full, all I did was send an invoice and suggest he hold onto a reasonable portion and that I'll complete the repairs. Anyways, since that visit ********************** has elected to communicate via email and I have even scheduled a date for repairs which he has had to postpone, granted it was for a family matter, which I understand but it was still postponed on his part. Since then we've had a meeting with the head inspector of the village, *********************, and myself to discuss the exact repairs, time frame to complete the repairs, and then the balance owed by ********************** and his intention/ desire to pay that balance. As of 10/31 at 1pm we were all in agreement of how this will proceed and ultimately conclude, I and Above Par will do our part to resolve this matter.

We did receive a call about some siding issues from ************, related to his work that we completed in 2018. I went to the house personally and met with the ****** sometime around the end of May beginning of June, I then told them that most of the issues they are noticing with the siding are manufacturer related and not labor related, however I also told them that it's just a couple of pieces and I'd be happy to get it fixed for them, as well as help them with any manufacturer warranty issues. I did tell them that it could take some time, possibly weeks to get the guys out there to fix it, they said that's fine and to just keep them updated, they also had some other work they were looking at getting done and wanted me to give them a price on. I understand that the ****** are just frustrated, and that they want everything fixed as soon as possible, and since that time I was out there ************ and I have stayed in communication and the repair has been scheduled for Wednesday 7/6/22.

They have not finished complying with the work that needs to be done... Able Par did send a 2nd party to finish the job but once they finished ************************ his head and said this is no good .. I asked him what is wrong and he told us the siding needs to be redone that the siding was not snapped in place then nailed and that most places on the siding was nailed at 33 inches or more and not at the 16 inches that is required we have asked them to put more nails to make sure the siding is secured and not fall off the walls . Above Par is suppose to meet with us at the end of the week. Thank you for your time and effort to try to resolve this situation
Ps the Bay window has not be fixed from the leak and the water stains that was left when the rainstorm blew water up and underneath because there is no protection underneath and the window need to be re caulked

I and my siding crew met with ************ about a week ago to do a walkthrough, we listened to all of his concerns walked around and looked at everything at which time we told him the siding job is complete and is done correctly. He agreed that presently everything with the siding does look good and everything appears ok, he did express concern for things that could arise in the future. I told him that I would extend his service warranty from 5 years to 10 years for peace of mind, that we stand behind our work and that I want to alleviate and worry he might have about the job. The extended warranty paperwork is being drawn up presently and ************ should expect to receive it in the next **** days. The bay window framing and wrapping is an add-on and is presently in the process of being scheduled, I expect that to be completed within the next 2 weeks.

I am rejecting this response because:

they have not completed repair, they made minor repairs to siding that was loosened when they had finished doing the repairs we were inform by the gentleman working that the siding was not good that the nails were 33 inches apart and not the 16 inches to maintain the stability required when ************* and the original siding person along with the last gentleman that came out (which we found out was the son in law of *** ******* to a meeting they refused to the lift the siding to measure it and due to being 74 and sometime has a short memory span I could not remember exactly which pieces the third man had lifted to show us that it was 33 inches between nails and not 16 inches required for stability, this job is not complete because the slats of siding have still not been totally secured , the bay window still has not been addressed on the leakageThank you

**************** warranty has been extended to 10 years as previously stated. If ************ would like us to come by and lift the siding in certain spots of his choosing, to verify correct installation, we will accommodate. In terms of the bay window, as previously stated this is scheduled to be fixed, we just need adequate time to do so. We signed 2 separate contracts with Above Par (APC) in early April 2021.Contract 1 - Financed - Replacement Windows, Facia, Soffit, Gutters, Bathroom reno, Kitchen Counter, and flooring.Contract 2 - Insurance claim for replacement siding and roof repairs. We were under the impression that the work would start in a couple months, and they had their own employees doing the work. Neither was accurate.Complaint 1 - Windows were measured incorrectly and caused damage to by jambs, casing, and blinds. I had to repair this damage myself. APC wanted to charge more to repair the damage they created.Complaint 2 - Incorrect window installed in dining room.Complaint 3 - Windows still missing parts 6+ months later.Complaint 4 - My AC unit was damaged by the Siding installers. Still not fixed or replaced.Complaint 5 - Contractors damaged my front awning. APC tore up the soffit, said they wanted to charge more to fix it, then left it torn up. I also had to repair this myself.Complaint 6 - Thousands of $$ on the insurance estimate was NOT completed. APC said they had no intention of completing that work, but demanded payment for it or else they put a lien on my house.Complaint 7 - They failed to work out a final invoice BEFORE telling the finance company that all work was completed. The full amount of financing $ was taken out, and that included payment for work that was removed from the original contract (counters).Complaint 8 - There are still several open issues not resolved that have been issues since August 2021. Too much to list here.I would like the following.Money back for work NOT performed.Money back for repairs I had to make for things APC contractors damaged.Missing parts for my windows.Correct window in dining room.Compensation for my time/materials in re-trimming my windows and repairing soffit.Open issues resolved by another contractor, I no longer trust APC to do it.Still need to pass final inspection as noted on permit.Business response

I am rejecting this response because: Complaints not addressed and attached word doc is not accurate on several things.I replied on their word document in Red. - See attached Word document.
Summary
Still charging for things they didn't do.
Doesn't address their damage to my property and the time/materials I had to invest to fix those issues to keep my home safe for the kids.
Mentions a code that does not apply since house is older than the code. Also if work was done properly, damage should not have occurred.
Still mixing the funding from 2 separate contracts.
Inaccurate description of events and conversations.
Still promising to resolve things, and making zero progress on getting things resolve after 6+ months of waiting. Some things don't need warm weather to resolve such as the missing window hardware.
The final invoices are both after-the-fact and whatever they felt like putting on them.
Sincerely,

I stand by my previously submitted response. The fact of the matter is that ************** is upset with delays that occurred both with materials and labor, these were unfortunate and not expected, and we did keep ************** informed along the way. Also during the construction process, there were some unexpected hurdles that arose while attempting to complete our contracted work, we did inform and advise along the way and ************** wasn't always happy with our suggestions. Yes, there are still some minimal punch list items remaining which will be completed, also ************** still has some open grievances about some items such as the blinds and windows, which we are willing to listen to and come to a fair and reasonable agreement on. I have been in touch with ************** by email and also spoke to him on Saturday 3/5 to arrange an in person meeting on Tuesday 3/8 to discuss all open punch items as well as his list of open issues. I informed him of my desire to listen to his issues, discuss a solution, and ultimately resolve all open issues and concerns.
Thank you,

I am rejecting this response because: Thee contractor did come over and had a conversation on Wednesday 3/9/22, but while we agree on a few points, we did not come to an agreement yet on some other points. He said he would think about the other points on his end, but we haven't settled yet. Resolution TBD.
As for the statement, there are still multiple things that are inaccurate in that statement such as the timing of them telling me about them reaching out for financing and the denial of them threatening to file a lien against my house to name a couple.
I really would like these issues resolved and I want this project completed since it's been over a year since we started the process and we were under the impression it would be done after just a few months.
Sincerely,
