I was pressured to sign something I was told was not a contract to receive an estimate on a new roof. I sought out another company to get an estimate after QC Roof Doctors would not tell me what their charges were. The fine print of the "not a contract" states I owe them 25% of what insurance would have paid as a consultation fee. I offered to pay for the contractor's time if they tell me what their hourly rate is, but he insists on charging me the 25%. At the time of signing this paperwork I had no idea what the insurance would cover as the insurance adjuster didn't come for several weeks later.Business response

******************** contacted us about wind damage to his roof. Our project manager came out and found enough damage to warrant a claim through ********************' insurance.
******************** filed a claim and signed an agreement with us to allow us to replace his roof through the allocated amount negotiated by us with his insurance carrier. The roof was fully approved by his carrier and communication with the carrier had begun. ******************** was picking out his shingle color and had sent a text to confirm his color choice. In the same text he also confirmed his intention to pay the deposit to initiate work.
24 hours later, and multiple weeks beyond the 3-day contract cancellation deadline, ******************** sends another text to our project manager stating he is going to use another roofing company. We can only make assumptions at this point as to why he is attempting to cancel the contract, but we believe it's fair to assume he is attempting to profit from his insurance claim and that the other company came in and not only waived his deductible but also came in lower than the amount issued by the insurance company.

I am rejecting this response because: A price was never agreed upon because the contractor could not give a quote until they saw what the insurance was willing to pay first. The contractor did not negotiate anything with the insurance company, since the insurance company has only contacted myself in this matter and had no interest in meeting with the contractor to begin with. I can assume this lack of transparency in their pricing is done to get by with the cheapest materials and labor they can get away with while taking advantage of whatever the insurance will pay. If I did this in my industry, I would be sued for insurance fraud.The second bid I received laid out exactly what all of the charges would be, which is what I wanted in the first place. The second bidder agreed to do the work for the same price quoted by the insurance company with higher quality materials and a better warranty. They did not waive the deductible. I am comfortable paying to get my roof fixed, but I want to know what I'm getting.
My main issue with this complaint is that I feel their business practice of having a potential customer sign a contract that penalizes them for seeking another bid is unethical and designed as a cash grab. As stated before I am happy to pay for their time at a reasonable rate, but asking for 25% of work that hasn't even started yet is ridiculous. To my knowledge, they have ordered no materials, have hired no subcontractors, have done literally nothing else but come look at my roof and send me 2 pages of paperwork.

As previously stated, we work directly with our customer and within their insurance estimate. ******************** was explained this and had signed the agreement that also clearly states that we will work within the insurnace estimate.
We submit all documents, photos and samples to the insurance carrier to ensure that all perils are covered as needed. The insurance estimate dated May 3rd, 2022, that ******************** has provided from his carrier clearly has each line item directly laid out including quantities and cost (see image). Therefore, ******************** did in fact have his current line by line estimate. Why are you going to provide your insurance estimate to a contractor if you are not sure you are going to use them? Unless you are having them to the work, finding someone cheaper and collecting the remaining funds. Which is indeed insurance fraud.
More work than a simple visit to his office work had begun. On the back end for ************************ claim, documents were prepped, reports were pulled and being prepared within our office. No materials have been ordered due to ******************** choosing the color the day before deciding to back out of his contract.
