This letter is to document the current issues with Vanguard Energy Services, ******** Enterprises LLC, and ******************** LLC.History October 11, 2022 ******** Enterprises LLC (DBA ******************) entered into 2 utility agreements. One agreement was to provide electricity to two locations: *************************************************************************, ** and 495 State Route 47, unit B, ***********, **. Vanguard Energy was the broker. Direct Energy was the electric supplier. The second agreement was with Vanguard to supply natural gas to the same two locations. The electric agreement was a 24 month agreement (10/11/22 10/11/24). The natural gas agreement was for 36 months.****************** (******** Enterprises) was for sale at the time. I questioned the broker, ******************* how the agreements would be handled if the business was sold before the agreements expired. He explained that the new owner would most likely be willing to take over the agreements and they would be assigned to him. A written agreement would be required to complete this assignment. ****************** was sold on 12/28/22. The buyer set up new gas and electric accounts with ComEd and ***** and signed the required assignment agreement with Direct Energy.Resolution request Vanguard was supposed to facilitate the transfer of these accounts. The process is still not complete. Bills are being sent incorrectly to both parties and Direct Energy has billed over $2600 to ******** Enterprises as termination charges. Vanguard has promised to have these reversed since the assignment agreement was signed by all parties. This has not been finalized.There has been no explanation as to why there is a termination fee. These charges must be removed. The Vanguard ***************** was aware of the situation described and was actively working with Direct Energy to rectify. As of 6/1/23 the issue has been resolved and Direct Energy waived the early termination charges per the attachements.

I had a contract with ************************* broke it by raising the therm rate on natural gas. This was done without my knowledge and they refused to fix the deceptive practice of price gouging.Business response

The customer signed up for natural gas with ***************************************** under an Index (variable) product. *************** Intelligence index is the most widely used and accepted natural gas publication in the industry. An Index is representation of the natural gas market on a monthly basis and is exposed to price swings which is also on a monthly basis. Vanguard offers other products that allow an end-user to lock in a fixed price rate thus eliminating price volatility. ******** *********************** elected the index as described in the attached Exhibit A. Vanguard Energy and its representatives held several conference calls with *********************** explaining the natural gas market and the natural gas product that they elected and were billed. Currently, the customer is delinquent several months and ****************** is taking the appropriate measures to collect per the term of the agreement.
