      In August of 2021 we were approached by Matrix Exteriors about replacing our roof. We had worked with Matrix in 2018, having them do our siding, gutters and down spouts, and at that time were pleased with their work. When they approached on 08/21, we agreed to have the work done and also asked to have Soffit and Facia included which was agreed upon for an additional $2K, however ***** never included that in the contract. The paperwork was submitted to the insurance, the insurance checks came and we forwarded them to Matrix, the checks have been cashed and ***** from Matrix has been harassing us for payment of $3K not $2K, and is now threatening a mechanics lien on our home.Also, he never set a date for work to begin. He was informed that we would be going on vacation. He decided to begin work when we were on vacation. The construction crew drove all around our yard and right over our septic pipes that were sticking out of the ground by approximately 24 inches and broke them. When we returned from vacation we returned to sewage spillage from their carelessness. My husband contacted ***** and informed him of the septic situation. ***** showed up to assess the situation. My husband gave him ballpark estimates of having septic repairmen do the repair work, but ***** had a few expletives to describe his disagreement in the cost and ended up saying that he would have his crew come and do the the work to repair the damage but never came back! Since then ***** has been sending rather vulgar text messages, leaving threatening voicemails and emails. I called to try and resolve the situation in a civilized manner and immediately got yelled at by him that he was going to put a lien on my house. I told him that I didn't have an invoice or a contract, so he said he would make one up and send it. So that's exactly what he did, yesterday, he sent us an invoice for $3,000.00, that he alleges he sent us back in 8/20/21. I checked spam email and I never had an email 8/20.

      In response to your complaint, you contacted Matrix Exteriors. You set up an appointment to formalize a contract for a new roof, soffit, and fascia to be installed on your house and detached garage. The agreement you signed did have a construction start date of 08/09/2021, as stated on the contract, and the construction on your property was concluded on 08/11/2021, which is also stated on the agreement you entered into with Matrix Exteriors; however, on your complaint, you are alleging that you did not know when the construction would begin and that is an inaccurate statement. The past due balance you owe Matrix Exteriors is $3,000.00, which was invoiced to you back on 08/20/2021 and was supposed to be paid no later than 08/25/2021. We returned to your property regarding your alleged septic tank issue; **************** apologized and said nothing was wrong with your septic tank system. He was pleased with the work that Matrix Exteriors completed on his home. He also signed off on a certificate of satisfaction. We were not hired to work on a septic tank system that, mind you, septic tank systems are typically buried four feet under the ground; the made-up septic tank issue was, in all fairness, was a furtive attempt on your behalf to get out of paying for the material that was placed on your home and the work completed on your house over six months ago. Now that Matrix Exteriors is taking legal action to get paid money rightfully owed, you decided to post a version of what transpired that is not congruent with reality and what was stipulated on the contract that we entered into. Matrix Exteriors is owed money, and our contractual obligation to you has been fullied, and we would like to be paid in full. Unfortunately, issues like this arise in business, so this is why we have contracts that are unequivocal to obligations to be fulfilled according to the contract. I reiterate that Matrix Exteriors' contractual obligation to you has been fulfilled, and we are owed a substantial amount of money that we were never paid.

      I am rejecting this response because:

      After the very unwarranted and derisive text message, which is attached to the original complaint, from ************** to my husband, I contacted Matrix Exteriors, via telephone, on ****** @ ****pm, screenshot attached, and spoke to the manager, *********************. ****************** informed me that we did NOT have a balance with Matrix Exteriors, that our insurance had paid everything.  We also have an email, attached, from our insurance adjuster which affirms that the contract amounts have been paid which are denoted by the checks that were issued and have already been paid.  We did NOT receive any invoice from Matrix Exteriors on ******, please provide proof that you sent such invoice on that date. 

      When you returned to the property **************** acknowledged that he was pleased with the work done to the house, however he also expressed his disappointment in Matrix Exteriors utter negligence of our property and wrecking of our septic system.  **************** most certainly did NOT apologize and did not say that there was nothing wrong with the septic.  Instead, ****************, gave you a ballpark estimate of the cost to repair the damage caused by Matrix Exteriors and you, **************, showed repugnance at the figures and used a few choice expletives while expressing your disapproval of the possible quotes and you added that you would have your crew come back to dig up the septic area and do what needed to be done to rectify the problem, yet you became frutive and failed to return!  You allege that a Certificate of Satisfaction was signed, please provide a copy such certificate.  You emailed pictures of our house, which are attached, on ****** at **** which clearly show the negligent care of materials being strewn on and around the septic tank cover (pic #6), leading us, with no doubt, to believe that Matrix Exteriors was nothing but neglectful when they carelessly drove over and/or backed up into the *** pipe, which is part of our septic, closest to the street, causing the damage in the pictures that we attached to this complaint. 

      Also, with regards to those same pictures to that you provided us, we would like to inquire as why our garage door is wide open in picture #7?
      Matrix Exteriors was not hired to work on our septic tank system. The septic tank issues are a direct result of the neglect and utter disregard of our property during the time in which Matrix Exteriors was hired to do other exterior work for our home.

      In an act of good faith, we sent you a check for $500, which you clearly refuse, email attached.

      We are perplexed at the fact that you would choose proceed with legal action attempting to collect on contract that Matrix Exteriors Manager and our Insurance Adjuster affirm accounts are settled.

      In regards to complaint # ********. The claimant is deliberately misinterpreting what is going on in an attempt to not pay Matrix Exteriors for construction completed on your house back in October 2021. **************** had filed an insurance claim with AAA insurance back in July 2021. AAA insurance warranted a full roof replacement on your primary dwelling and detached garage. Two separate payments were received from the insurance company. That is how you paid Matrix Exteriors for the roof restoration completed on your home, and the deductible on the insurance claim for $1,500.00 was never paid either. However, you signed a contract for $3,000.00 to install soffit and fascia on your home, which was separate and had nothing to do with the insurance claim. Matrix Exteriors invoiced you for the completed work, and we never received payment here were are six months later and have still not been paid. We have made several attempts to contact ****************, which were to no avail, and Matrix Exteriors has been left with no other recourse but to have our attorneys collect the debt. All of this could have been avoided if you would not have breached your contract and the septic system being damaged was a made-up story that was subterfuge on your behalf to attempt not to pay Matrix Exteriors. I have attached a copy of the demand letter sent from our attorney to you via certified mail. From this point, moving forward, you can deal directly with our attorneys.
      I have made every attempt to resolve this amicably for months, and it's not that much money that you owe Matrix Exteriors, but you do owe us, and we will collect what we are rightfully owed.

      I am rejecting this response because:

      We are NOT fabricating stories about our septic to avoid paying your company.  We are simply stating the facts. **************, You and your company, Matrix Exteriors, need to accept responsibility for damages caused while working on our property.  The pictures that YOU sent us clearly show yours and Matrix Exteriors negligence and disregard for our property including having our garage door wide open without our consent.
      Please provide a copy of the alleged signed contract for $3,000.00.
      You have not provided proof that your attachments (invoice and demand letter) were ever sent and/or received by us.
      We have sent the payment amount in which we wish to resolve this issue for which we have previously attached the email which contains the tracking number as well as your response in which you clearly indicate your unwillingness to accept responsibility for you and your company's actions and YOU will not accept our check.  
      We had a company give us an estimate today for the repair of the septic damage caused by you and Matrix Exteriors, we are attaching the estimate.
      When a businessman attempts to collect a debt they certainly do not conduct themselves in the egregious manner via voicemail, text or emails, as you have, **************, we are attaching audio files for your reference.
