On July 10, 2023, *******************, property manager at Independent Association Managers, Inc., scheduled for ***************** to replace a catch basin, for which we paid $3,285. On July 11, 2023, ***************** started cutting a hole in the center of our driveway into the parking lot, which resulted in drivers driving around the hole and onto the sidewalk on either side of the driveway. Drivers damaged the surrounding grass and sod on either side of the driveway. This hole resulted in a hazard to drivers on July 12, 2023 when the rainstorm and tornadoes hit. Furthermore, the rainstorm resulted in poor conditions to complete this project because the over three inches of water will cause earlier than normal decomposition of the asphalt layer. Also, the ground retained so much water that the soil and the existing asphalt was swollen because every open pore within the structure of the subgrade was filled with water. This water created a puddle because the water seeped into the existing asphalt. When the workers laid the asphalt, the men compressed this water balloon. When the water drains from the water balloon, this process will create micro pores/voids. This will leave the patch separated instead of on the subgrade. Additionally, this repair work at the time of the rainstorm/tornado will expedite the settling and subsequent breaking of the asphalt for the catch basin, which the men laid on July 12, 2023. As a result, we also felt unsafe. On July 13, 2023, ************ stated he had "no control over the contractor or the weather and that if the ***** of ********* wishes for him to charge hourly, he would be happy to sit with them, every minute, to manage the project." Contractually, in paragraph 2G, ************ shall inspect the property quarterly and, in paragraph 2H, maintain our property according to standards consistent with the character of our community.
