Back in august, I attempted to reach out to campus point to settle a charge for a couch that I apparently damaged while living on their property. I moved in august of the year before to an incredibly ripped and scratched up couch. Was promised a new couch before moving in and we never received it. Now according to campus point I received a new couch, that I never received. I had no animal while living on the property, but the roommate with an animal was not charged for the couch. I sent several email before calling and when I did back in august an employee, not a manager, looked through my inspection and found that the couch was damaged when I moved in and told me I would have to wait on a manager to look over the account to settle the charge. I never received a call. I would email every once in a while but get no response and when I would call there was never a manager available to speak. Then there was a management change in February which apparently inhibited them from ever contacting me. Now they say they can’t remove the charge because they don’t have a proof from a prior manager. I emailed and called so many times. They have a note in my account by the same employee from earlier but since it’s not a manager they can’t do anything with that. I lived with a very damaged couch and didn’t expect to pay for the next resident to enjoy their couch.

I moved out of my Campus Point apartment in mid January due to conflicts with my roommates that were severely impacting my mental health. Campus Point gave me some options to terminate my lease in late February. Conveniently, these options were not provided to me until after I had to pay February rent, and when March rent was due in a few days. I attached the letter outlining the options. One option included providing a letter from my therapist describing the impact my roommates had on my mental health. The wording of their letter made it seem like if I provided the letter, I would not have to pay them a termination fee. However, they uploaded the mutual termination contract on March 15th which stated I would have to pay $778 (2 months rent) by March 29. It was not clearly stated in their initial letter that I’d have to pay $778 even after sending them documentation from my therapist, so this charge came as a surprise to me. Despite moving out in mid January, the company had me pay rent in February and March. So, I had paid them 2 months of rent where I was not even living on the premises. I went into their office on March 29 (I would have earlier, but I experienced a health emergency) to ask if they could just use my Feb/Mar rent to pay the fee to end my contract, and I was told I would get an answer by the next day. I didn’t. I went to the office again in early April and was again not given a clear answer. So, I sent an email on April 5th, a week before today, with some questions I had about the mutual termination, including why I still had to pay $778, if they could use my Feb/Mar rent to pay it, and asking what would happen since the March 29 deadline to pay the $778 has passed. I never got a response. I talked on the phone to the assistant manager who said I still had to pay the $778, but I never got this in writing or an explanation as to why they could not use the Feb/Mar rent. I would like them to use the Feb/Mar rent as the $778 to end my lease.

The ***** ***** is the property management agent for Campus Point Apartments LLC.  I have reviewed the February 7, 2023 complaint filed by ****** *****.   ****** ***** was a former resident at the Campus Point apartment complex during the 2018-19 term.  After he moved out with significant unpaid amounts due, *** ***** requested to terminate his financial obligations in connection with a claimed disability, which was disclosed to us only after he had moved out.  We have considered this to be, in part, a request for an accommodation for a disability under Fair Housing law.  We have already responded directly to *** ***** on December 9, 2022, and provided a generous settlement offer.  As a courtesy, I am enclosing a copy of that letter.  Campus Point would be willing to honor the settlement offer and to accept *** *****’s payment of just $840.00 (representing one rent installment and the initial administrative fee under the Housing Agreement), if received by February 20, 2023; under that settlement, Campus Point would absorb a remaining actual loss of over $8,600, which has already been incurred, as well as all costs of collection.   Should *** ***** wish to accept our settlement offer, we ask that he contact us directly (or via the BBB) and we will prepare a release memorializing the terms.

I am rejecting this response because:
Under the accommodation for a disability under Fair Housing law,  The bill needs to be cleared completely and my credit report needs to be corrected. Complications as a result of my disability was my sole reason for having to leave the apartment. I was at the time also full time college student. I also was not able to finish the semester as a result of the progression of my disease, I received full termination of financial obligations as an accommodation from the school.
I have seen several medical physicians over the years for my complex disability from all records, you will see that I am blind. All documentation says I am blind it is offensive to repeatedly provide documented information. This information has been backed by several medical doctors. It is absurd to request the same documentation that is provided.  It also violates my privacy. It will be necessary to file a with complaint with FHEO if properly accommodations cannot be met.
The medical letter from the physician is clear in stating that I am legally blind and I have Keratosis, by definition of the conditions it is extremely clear to what limitations I face. I have a state issued handicap placard.
It is offensive as a blind man is be asked what I cannot do because I'm blind. My vision is impaired. This is a tactic to refuse to resolve the issue.
Both myself and my power of attorney have been reaching out to campus pointe since for before August of 2022. I was told directly from ***** in the office that there was nothing they can do. My power of attorney and I  refused that answer and provided the doctors documentation to ****** ******* it was made clear that I am blind therefore I cannot read communication directly send to me without assistance. I did not receive any emails from the management company. The attached letters were not delivered.
If you would like further information on visual limitations you must provide a clear form to my physician. My physician wrote a letter that a competent adult can understand.

       ****** ***** / Campus Point / BBB ID ********
      Ladies and Gentlemen:
The ***** ***** is the property management agent for Campus Point Apartments LLC. We have reviewed your letter dated February 27, 2023, describing that *** ***** rejected our settlement proposal.
Under applicable Fair Housing law, a housing provider is obligated to make reasonable accommodation for a disabled resident, taking into account the cost or financial impact on the housing provider.
*** ***** sought to avoid the remainder of his rent obligation under a 2018-19 Housing Agreement after moving out. Although there seems to be no nexus between his request and his claimed disability, Campus Point made a generous settlement offer under which it would absorb a significant loss. We believe, pursuant to Fair Housing law, that the elimination or further reduction in the amount due from *** ***** would pose an undue financial burden on the owner. We request that *** *****'s attorney contact us directly.
