      To whom it concerns On April 9, we rented a ******** C-300 for 3 years At the end of 2021, we began to receive calls from various dealers with offers if we want to return our ******** to the dealership before the expiration date Our contract ended on April 9, *********************************************************************************************************** other words, they bought our car back from the company that financed us. We really liked this offer and given our current situation that we do not need to own the car, we decided to return it before the end of the term on the condition that we will not pay anything more for it in the future. We agreed with one of the dealers (his name is **** Shmuilovsky) from Autohaus On Edens that we will bring the car to the dealership. On December 28, 2021, we drove our car to **** Shmuilovsky's dealership **** Shmuilovsky told us that from now on you no longer own this car and the remaining balance of money will be paid. To our great surprise, we received a notice from ******** ******* that we owed them $1941.60 When I called and asked what happened and why I should pay this amount I did not receive a coherent answer He said that his deal with the dealership did not go according to plan He also left blamed another dealership worker. He said the car went to manager ********************************* and his assistant Nick ******** I tried to call them and left messages. I never got a call back from them. Dear BBB, we are looking for your help in resolving this issue. We have become natural victims of fraud All our lives we lead an honest lifestyle We always pay for everything and always We would not want to spoil our credit history because someone else brazenly deceived us Please kindly understand and help us in this situation Acc#************* VIN 55SW4KB2JU273134

      I am rejecting this response because: Dear BBB, I would like to thank you for the help you give me in resolving my problem. Unfortunately, the answer that I received from ******** on Edens does not suit us, since we do not see in it the slightest attempt to resolve this problem.  From the last email, I understand that ******** on Edens is trying to shift the responsibility for paying $1941.00 to us.  We think this is absolutely unfair.  I would like ******** on Edens and BBB to understand that the decision for us to return our car 4 months early was that ******** on Edens and other dealerships kept calling us and begging us to return the car early and relieve us of all liability to pay the lease and  as well as all other costs associated with the return of the car before the expiration date.  They explained their requests by the lack of vehicles at the dealerships.  We agreed with **** Shmuilovsky that we will return the car to the dealership on December 28th.  Also in his office when we handed him the keys to the car, he once again assured us that we would not have to pay absolutely anything.  We, being ordinary people and trusting him, agreed only to such conditions.  Later, when we found out that we had to pay MBFS $1941.00, we realized that we were simply deceived by him.  When we asked him to explain why it happened, he told us that the deal did not go according to his plan.  He also said that used car manager ********************************* was responsible for what happened.  We left a message for ********************************* to find out what happened after all, which we never put a call back on.  Instead, *********************** called us and said that he also disclaims responsibility for what happened.  He also said since the car was not sold from them they are just like a droop of point.  We have never heard such details before, neither from **** ************ nor from ***********************.  As a result, on December 28, we lost a car that we could have used for 4 months before the lease expired.  I would also like to mention that the car was left in perfect condition and small miles.  In the previous letter, the *** number was indicated by which you can make sure that the car has never been in an accident.  I want to thank the BBB again for trying to help me with what happened.

      I am rejecting this response because: Once again I would like to thank the BBB for the help they are trying to give me in resolving the problem that has arisen for me.  We would like to explain again to Autohaus on Edens that we would never return our car 4 months early unless we were sure that we would not pay anything for it.  We have been assured by **** Scmuilovskiy several times that our account will be paid in full and closed.  Also **** Schmuilovskiy knew that we were not going to lease another car.  **** Schmuilovskiy never told us about any other expenses such as (Disposition Fee or Turn-in Fee) which will be our obligation to pay.  We consider ourselves victims of unfair deception.  We still believe that $1941.00 should not be our responsibility.

      Dear BBB, the document you are requesting (Early Termination of Lease) we do not have in stock.  On that day, December 28, when we returned the car to ******** on Edens, **** Schmuilovskiy asked us to sign some kind of document.  We were not informed about the nature of this document.  We also did not receive a copy of this document from him.  We called ******** Financial Services with confidence that they could provide us with a copy of the above document.  They told us that they only have the original contract in stock.  I am sending a copy of this contract in the hope that it will help in resolving this problem.
