      Property damage caused by roofing materials of Quantum Exteriors. On November 5, 2022, unsecured roofing materials left on top of a roof at *********************** blew into my backyard property at *********************** causing extensive damage to my fence, of which a 16 foot section was torn down by the impact, my patio table and umbrella, as well as landscape lighting and landscape grass in the yard. Eleven roofing insulation panels blew into my yard as well as an entire pallet of of the material (I have video evidence of the pallet and damage it created) roofing materials. The materials were not properly secured on the roof as they should have been, which is the responsibility of Quantum Exteriors. Quantum has refused to take responsibility for their materials. The materials are the responsibility of Quantum Exteriors and they are responsible for the damages to my property.

      Dear BBB,

      Thanks for contacting us about this complaint.

      We had the materials placed and secured on top of this roof. See picture attached.

      We had delivered the materials on september/2022 and secured the materials properly at the job site. 

      Between this time frame, another contractor hired by hoemowner (tuckpoint contractor) went to jobsite and moved the materials around to perform his work.

      Materials were not put back in place as it were, and when the windstorm happened on 11/5/2022, the materials flew away into the homeowner's naighbor property.

      If the windstorm ****** the secured materials loose, the situation would be a case for a claim that would be classified in an Act of God claim and should go under the homeowners naighbor's insurance.

      However, if another contractor on the job unsecured the materials while performing their work after Quantum Exteriors had already secured their materials and left the job site, then the claim would go under the other contractors general liability coverage for negligence.

      The homeowner was present when the materials were delivered and secured at the jobsite and he had confirmed that he saw the materials secured by Quantum Exteriors and also confirmed that another contractor went to work on job site.

      There is an open claim in place for it with LAG Insurance.

      Quantum Exteriors can not be liable for some damage that happened on a house that we were not working on and that we have proof that our part was done properly.

      I am rejecting this response because:

      ***************************, owner of Quantum Exterior provided a photo to me of the materials UNSECURED on the roof of the building (attached) located at ***********************. Their claim that the materials were secured is false.  This was negligence, not an "Act of God".   They would not have blown off of the roof had they been secured (i have video proof of the velocity and the damage to my property).  It does not matter if someone or another contractor untied the materials as Quantum is claiming.  The materials are the responsibility of the contractor who owns them.  Quantum Exterior should never have left the materials on the roof of a four story building - period. Quantum has no proof that another contractor untied the materials and provided me with a fake name and phone number of the supposed "tuckpointer".  Quantum is simply trying to deny culpability in this matter and their materials caused damage to my property.  

      The claim was denied by the insurance company who represents the owner of *****************************; The reason?  They tried to work with Quantum Exterior to provide partial payment for the damage to my property and Quantum refused to cooperate or respond. 

      In addition, I have spoken to my homeowner insurance company and the deductible is over $2,000 and they will provide zero payment at this time.  

      I have no idea who LAG insurance is and who they represent.  I have not been contacted by anyone at a company named LAG.  An internet search shows that there is no  insurance company by this name.   Another false statement by Quantum Exterior.  

      My property has been damaged to the tune of approximately $3,800 and the owner of the unsecured materials - Quantum Exterior is refusing to provide recompense for my property that has been damaged.

      Dear BBB,

      Im writing to clarify about the info we gave yesterday 1/23/23 and also to bring some additional info brought from our insurance company.

      The reason we mentioned that the claimant had an open claim is because we got a message from our insurance agent that mentioned it. (See pdf attached with note from agent)

      After acknowledging about this situation, we have contacted our insurance agent ******************************** from ************* (here is his info)

      who said **** who is the agent for the owner of the building that materials were located, his name ***********************, and was agreed that nobody would file a claim and *********************** paid the claimant $3,000.00 for the damages that occurred by the wind, but from the materials that were left untied by the tuckpoint contractors and thats why they paid her, because they were at fault.

      Quantum Exteriors clean out her property and removed the insulation debris that felt on her house as a courtesy as we were not liable for other contractors work on the roof who left materials untied and cause the materials to fly due to windstorm and land on her property. But we have cleaned her yard and we have assisted her in multiple ways with the owner of the building and there was no claim filed with her insurance or for any matter as the damages were minimum at the property and the responsibility should be for the owner of the building.

      Our insurance agent confirmed that the claimant have received from the owner of the building.

      I am rejecting this response because:  I spoke to your insurance agent today listed below - he is MISINFORMED.  I did NOT receive ANY payment from the building owner and their adjuster *****************************, in fact I received a DENIAL letter that I have in my possession.  Once again, I have not received compensation for the damage to my property caused by the negligence of Quantum Exteriors.  If you have a dispute with the building owner over who UNTIED the roofing insulation panels causing the damage, that is between YOU and the building owner.   Your agent should pay the claim and subrogate against the building owner and their insurance company to get back your money.  

      Your insurance agent "indicated" that he was going to contact *****************************, who represents the building owner today, so hopefully, this matter will be resolved eventually between all parties.  Until it is resolved, this claim stays open.
