      Business has engaged in "Spot Delivery/ Yo-Yo Sales"7/21 After submitting all requested document, sales guy informed me that deal was all good to go and all that was needed was to come in with down payment ($2500) and to sign retail installment contract along with other forms. Went into dealership same day with check for $2500 (which has since posted and cleared my bank account), signed all forms, license plates were transferred from previous car and I took possession of the vehicle.8/1 Received call from dealership stating that financing has fallen through and that I needed to return vehicle while deal is re-worked.I contacted the ************************ after seeing on their website that this unethical and illegal practice has become common amongst dealerships and are in direct violation of TILA, FCRA, ECOA and UDAP for engaging in such practices.

      Better Business Bureau:

      This is the formal response to complaint 20407886.  ****************** explanation of the deal that has occurred is not accurate.  We did not violate any laws in what happened, however,  **************** is now refusing to provide additional information to the bank that had conditionally approved the loan and by doing so the deal is now declined.  In the paperwork that **************** signed on 7/21/2023, there is a form we include with every financed deal called a Spot Rider Agreement. On this agreement it states, If the seller is unable to assign its rights, title and interest in this contract to a sales finance agency within (5) days of the date below, and so notifies the buyer by phone or mail, the buyer shall within (2) days of such notice return the motor vehicle to the sellers place of business, and the seller shall return to the buyer all the buyers deposit ********************* cost of repair for any damages occurring to the motor vehicle in the buyers possession, and this contract should be bull and void.  Fox Valley Volkswagen notified **************** by phone within those 5 business days post-sale, on the 5th business day (7/28/2023), which was when we were notified by *** about the additional documents would be needed from her (three months bank statements) as *** requested them from us.  **************** told us she would provide them but she didnt feel comfortable sending them directly to us, so *** reached out to her to send her a link where she can safely upload the documents. As of August 5, 2023, **************** still has not returned the vehicle to Fox Valley Volkswagen.  Fox Valley Volkswagen is completely willing and able to give **************** her down payment or deposit back, providing she brings the vehicle back to us in the same condition she bought it in.  Please see attachments to see Spot Rider Agreement and as well as the *** call-back (with financially sensitive information redacted) showing their need for additional proof to be sent to them.

      On August 26th 2022 I bring my car to change oil to the Fox Valley Volkswagen car service.After the service they returned me car. I did light visual inspection and found my car scratched near the hood.Based on scratches they were made when hood been opened, some scratches a dip and require painting

      Hi Mr. *******,

      I'm so sorry that you feel this was your experience with our dealership.  My service manager ********************* has sent you over the pictures that were taken when you dropped the vehicle off for service.  The reason this is apart of our check in process is because it's more common than you *** think that customers don't inspect the body of their vehicle regularly to scratches and dents that *** have occurred. I have attached the photos attached to your repair order for your vehicle when it was brought into the service lane at check in.  Your Atlas did have those few scratches on the hood prior to bringing your vehicle in for service.  Although we did not cause the scratches, they do not look too severe from the higher quality photos you submitted to BBB, and if you would like us to do a complimentary buff to the area, I think we would be able to remove a majority of the imperfection. Please let me know if there is any other way I can be of assistance.
