I entered into a title loan contract with ******** (***) for $5,000 for my $24,000 KBB valued vehicle in December 2023 to provide my child a Christmas, due to the total loss of my residence by Hurricane *** and the receivership and nonpayment by **************************. I am in the process of filing bankruptcy. Unfortunately, I did not provide the notice to creditors to Sky in time to prevent a repossession after futile attempts to resolve prior to filing. Sky, MVTrac LLC (MVT), Speedie's Recovery of S. FL (*********), and their agents (Sky, et al.) are in violation of FL Constitutional Art. 1, Sec. 23 and FL Statutes Sec. 329, 537, 714, 819, 934, and 943 as were I was illegally surveilled, tracked, video recorded, followed, and watched without knowledge by recorded on my home surveillance system, other cameras, and witnessed by people, including myself. I never received the statutorily required notice to surrender vehicle from *** prior to repossession. My vehicle was repossessed from a private apartment complex by ********* that breached the peace as complex property was moved and quite possibly damaged to remove my vehicle. **************** provided no on call a non working phone number to local law enforcement. Keyless and automatic, my vehicle was most likely damaged in the repossession as well. Sky, ****. will not provide me the location or working contact information of my vehicle to obtain my personal property. I have medication, credit, house keys, other PII and HIPAA documentation, and other items of value in this vehicle. My vehicle was unregistered and the icense plate was surrendered prior to the payoff date by Sky, et al. I am still paying insurance on the vehicle. After repeated contact, Sky, et al. ** refusing to return my personal items, in addition to all about Florida Statute violations.Initial Complaint

I spoke with ****** at MV Track first and he told me that my vehicle was at one place and he gave me the number to contact the place where my vehicle is supposed to be at and then the place stated that they did not have my vehicle it was at another location and they gave me MV Tracking number contacted them again and **** was so rude like we told you all we had and anything else you need to contact your financial company, then I just asked for a manager was told that it would take 2 hours for the manager to call me back so then I decided to continue to speak with **** and his nonchalant attitude was crazy so I asked him to go ahead and put in so I can speak with the manager to report his attitude. **** up then had someone from the finance company to call with me on three way he has the nerves to tell her that he only wanted to speak with her because he already had a fight with me, like we had done laid hands on each other but then was getting smart with the lady from the finance company. The company colluded with ****************** and **** towing by sitting on paperwork to send to the towing company so there would be increased costs and delays. Already lose of work and therefore pay has made this even more unfortunate and damaging to say the least. Valuables in the car that was repossessed were ruined and never was allowed to access them. The towing happened on a Sunday when everything was closed, again on purpose.Initial Complaint

I was stopped by two of their tow truck guys. I was told to pay the first one and debt would be cleared (which was a lie that I didnt know). The second one threatened to beat me with my kids there and my son in my arms I had to plead with him not to hit me because I have sickle cell and just got released from the hospital. I also paid the second guy for my belongings. The company sees no problems in their employees financial exploitation or physical violence because they told me they will do nothing about it.Initial Complaint

This company is purposefully trying to withhold my car. They repossessed my car and would not tell me how to reclaim my property. But gives the authority to the tow company to retrieve my belongings. They contracted with a tow company whom doesnt answer the phone and directs you to their website to book an appointment that doesnt work. I talked to many reps and supervisors and they all say they have no way of getting in touch with the company and that I should keep calling.Initial Complaint

They stole my property and monies, disabled placard upon taking the vehicle to *** airport. They now keep hanging up in my face and wont provide information. They were to bag up property not steal it. And now the vehicle was re rented out , and I have yet to retrieve my belongingsInitial Complaint

My car was repossessed on Wednesday 12/20/2023 for a default on a car title loan with Loanmax ************* in ********. The car was repossessed by MVTrac, which is a third party affiliate of Loanmax. I paid the load off in full on 12/22/2023 at 11AM. Loanmax confirmed that they sent the release form to MVTrac via email at 12:18pm on 12/22. I was advised to call MVtrac to get information of where my car is located to pick it up. I called 3-4x between 1pm and 3:30pm, where every time the employee lied and stated they didn't have my release form, told me to call back and hung up while I was on the phone. I called Loanmax back to verify and complain around 3pm, at which time it was confirmed that the release form had been sent out at 12:18pm. I called back again and magically MVtrac had the release form and I then called the **** lot, at which point I was answered by a recording making unreasonable requests to email in a request for appointment between 9am-1:30pm and the **** lot closes at 2pm. Next business day is the day after Christmas, making me wait 4 extra days and pay for 4 extra days, having no transportation over the Christmas holiday, due to carelessness, laziness and rudeness on behalf of MVTrac. I expect to be not be charged a ***** for by this company, due to its employees ******* lack of empathy or concern and intentional and malicious withholding of my vehicle and property with the intention to milk extra money out of their victims. I will be seeking legal counsel to file a lawsuit if not resolved internally and expeditiously.Initial Complaint

December 4, 2023 my car was repossessed MVTrac hired ********* towing out of ******* ** to tow the car.December 8, 2023 I went to go pick up my car and noticed that over $1600 valuables were missing out of my car. Also my car was damaged badly by the company MVTrac hired to do the repossession. Ive reached out to MVTrac to numerous of times after they promised theyll get me a call within 24 hours and still havent. Having my vehicle to be repossessed is already hard enough but to have items stolen and my vehicle to be damaged just makes the situation even more devastating. On December 8, 2023 before even leaving the towing lot I called, filed an incident report and emailed Smokerise towing about the missing items and damaged vehicle.
