      on september 24 2023 hawley construction came out replaced my driveway in january of ******************************************************************************************************************************************************* the spring well we have had really mild weather where could come out and take a look at it now he wont answer his phone or return calls so my wife called on and low and be hold he answers the phone that was on feb 23 *********************************************************************************** wensday here we are march 6 2024 and no show and wont answer or return her calls i was told by *** hawley after the job was done and he was paid that i should seal my driveway problem with that is you need 7 to 10 days that are over 70 degrees and dry well that didnt happen being the the timing and **** told by the concrete plant that sealing is on the contractor not the homeowner

      As stated in **************** complaint, Hawley Concrete, **** poured and finished a concrete driveway at his residence located at *********************************** *********, ******** on September 28th,2023. The weather on the day of the pour was ideal to successfully complete the project. The material was purchased through Princeton Redi-Mix and was poured with a six-bag mix and fiber mesh. We installed rebar throughout and put a moderate broom finish on the surface of the concrete to complete the driveway.After the job was stripped of the forms and was completed, Mr. and *************** were delighted with their final product and gave a five-star review on Google.
      *** Hawley, President and *******************, advised ************** to apply a water-based sealer after letting the driveway cure for approximately seven days after installation to protect the surface of the concrete from any spalling and/or flaking due to likely salt contact during winter months. *** explained that while Hawley Concrete, **** does not provide this service, he would strongly advise ************** to sealcoat it when temperatures are 70 or above. Though ************** may not have intentionally salted his driveway, salt will be inevitably deposited onto the driveway and will cause damage to any unsealed surface when parking on it after driving through heavily salted snow and slush from public roadways. For this reason, *** made the strong suggestion for ************** to sealcoat his driveway.
      On two occasions once prior to the job and once upon completion of the job *** and **************** discussed warranty coverage. *** stated that Hawley Concrete, **** does not give warranty coverage for things such as spalling or flaking since we have no control over whether salt or any other chemicals that could potentially cause damage to the surface of the finished concrete comes into contact with the concrete after our service is provided and the product is finished. Since we have no control over these factors after we complete the job and leave the site, it then becomes the responsibility of the homeowner to perform any preventative maintenance and care for the continued integrity of the product thereafter.
      When ************** noticed the damage, he stated that, after several attempts to reach *** over the winter months, *** would not return his or his wifes calls. *** did, in fact, answer a phone call from ************** and discussed coming to inspect his driveway in the spring. *** also spoke with *************** when she called separately and discussed the same thing with her. ************** called another time regarding the same issue.*** assured **************** that there would be an inspection arranged in the spring since Hawley Concrete, *** is typically not in operation from December 1 through March 31 due to the cold weather. On February 27th, a representative of Hawley Concrete, **** performed the inspection and captured video footage of the reported damage. Though there was a car in the driveway,no one answered the door when he knocked immediately following the inspection. Nevertheless,the findings were as we suspected: a few areas of spalling due to salt deposits.
      ************** also mentioned in his complaint that there was no possibility of weather permitting him to seal his new driveway. However, I have attached the AccuWeather report which reflects acceptable temperatures to do so in the timeframe suggested. No refund will be issued at this time since the damage cannot be faulted to Hawley Concrete, **** and the original quality of the work completed.

      I am rejecting this response because: I was told by *** that in order to put sealer on it needs to be a continuous 60 degrees or higher and as you can see what the night time temps are not to mention the leaves on the trees where falling of early and when I called and talked to the concrete plant the guy I talked to told me that sealing the driveway is the responsibility of the contractor not the consumer its just funny I have had 3 contractors out plus the a guy from the concrete plant and they all have said the same thing its a finishing issue

      Regarding ****************** additional information, he had previously accepted an estimate from Hawley Concrete **** with the knowledge and agreement that the additional service of seal coating, which Hawley Concrete **** does not provide, would not be included. He was aware that he would have to hire someone else to perform that task or seal coat it himself. Unfortunately, ************** did not do so, which cannot be attributed to any fault in the work provided by Hawley Concrete ****

      I am rejecting this response because:
      When I accepted the bid for the work I knew nothing about any seal coating in fact I was only made aware of it after he had his money in hand other wise I would have asked them to do it and like I have said in previous statements it was to late in the season to have anyone seal coat anything its crazy you pay someone ****** dollars for a service that lasted 4 months and some how its the consumers fault this isnt going away
