We hired Americas bath on 3/9/2023 to install a walk in shower which they did. The shower doors are defective and have been repaired twice and they are still not functioning properly. I called today for service only to find all phones not in service. We are suppose to have a lifetime warranty. I would like these doors replaced or a refund for the defective doors. Is this company out of business? What recourse do I have to have this taken care of? Please advise. Thank you.Initial Complaint

In June of last year, America's Bath installed a walk in shower. We paid around $15,000 to have the old tub, tile walls removed and the new dry barrier walls, sub floor and the new product walls, plumbing and shower doors installed. Approx, 3 months ago the shower doors started to rattle and I called America's Bath to tell them, and found they went out of business. Since then, mold has started to develop under the waterproof seal. Which we were told wouldn't happen. I'm just trying to find if they are doing business under another name, or if they are still doing repair work on previous jobs such as this. Any help you can give would be greatly appreciated.Initial Complaint

One shower in our master Bath will not turn on ever time. Has a **** Brushed ******************* with Positemp Valve with in line shut off. Step into the shower and turn Valve on and no water comes out. Play with it and tun it on and off 6 to 12 times and water starts slowly but flows full force finally. Something wrong with the single handle PosiTemp Valve. Needs to be repaired.Initial Complaint

We contracted with American Bath Company for a new sink and shower system. The were paid, but never returned to install the sink and counter top. We tried contacting them, but the recording states they are out of business. We need help recovering the money we paid to get a sink and counter top installed. We have no sink at all in our bathroom. We are senior citizens (73 and 74)...we need help.Business Response

It's always unfortunate to have an unsatisfied customer, but we are fortunate it very rarely happens at **************. In this case, this customer is not satisfied with the terms of the purchase agreement she signed.
The damage she is referring to is nail pops and seam cracks on walls in adjoining rooms (not in the room we worked in) that was a result of vibrations as a result of working in the space to replace her bath/shower. While this type of collateral damage rarely happens, we clearly indicate in our purchase agreement in paragraph 22 that we are not responsible for said damage. We have no control over how a home was built, what prior repairs were made that now failed, the method in which prior drywall or plaster work was completed. If we had accidently created damage by cutting holes in walls, leaks, dinging walls with tools etc. we will certainly make arrangements for those repairs. The customer was made aware of this in a phone conversation after install. Separately, the customer signed a purchase agreement with us and as such, (which we have attached to this response), ************** will honor the purchase agreement and the associated lifetime workmanship warranty that is part of that agreement. However based on Paragraph 22, ************** will not make those repairs the customer has requested as they are not covered by the purchase agreement nor ************** Lifetime Workmanship Warranty.
Two weeks and one week prior to our installation, we remind customers in both email and verbal form to read both the purchase agreement and our "Guide to Installation" to ensure they are familiar with this information so that on the day of install that if there are problems, they clearly understand how we will deal with those problems. ************** fully discloses in writing in advance of how we deal with certain situations when they come up. The customer experience is very important to us and as such we have gone out of our way to clearly articulate almost every detail in advance for the customer's reference.
Here is the language from paragraph 22 of our purchase agreement:
22. Damage: ****** damages customers home during the course of this project, *** will work with customer to remedy said damage. This remedy *** not take place until a later date so the repair can be scheduled with the appropriate trade. As a result, customer *** hold back 10% of the Balance Due until such damage is repaired. Exceptions: We will not repair or replace broken floor tile where old tub/shower meets floor or wall. We do not know how this tile was installed and subsequently, despite our best efforts, the tile *** become damaged/cracked. We are also not responsible for wall tile that we have cut to accommodate your new tub/shower replacement. We are not responsible for the repair of hairline cracks in drywall or plaster, nail pops in adjacent rooms, damage to specialty wall finishes including wallpaper that *** have occurred during construction as this is a by-product of remodeling. Plaster walls *** chip/break outside of the intended replacement area, however *** is not liable for the repair of this as this is a by-product of having plaster walls. *** is not responsible for damage to ceiling in bathroom if customer elects to have panels installed to the ceiling.
Separately, this customer is stating she did not receive color match silicone. As a normal business practice, we leave a **** ounce tube of color match silicone behind. We are not certain why she did not receive it or if it was misplaced, however we will ship her a tube this week.

I am rejecting this response because:
The crack to the adjoining wall is not on a seem. It is in the middle of the room and was caused by the demolition ************************* repeatedly being smashed with all his might to remove the hardy board. The man doing the installation kept commenting on how difficult it was to get this down and kept using excessive force to remove it.
