      Please find 5 work orders dating between 2019 and 2022.  There are an additional 2 that will be attached in a follow up response.  Work orders have been issued when there were complaints regarding this matter.  The unit owner would request the contractors completing the work make different changes to the downspout and drain tile each time they were out.  After the drain tile was initially installed, she requested it be disconnected, and then later reconnected.  After 7 different work orders were issued for the same issue, and many visits by the contractors completing the work, there is not further repairs needed. 

      The unit owner has made recent complaints regarding her neighbor over using the guest parking spaces.  Unit owners are not allowed to park in guest parking, and they have been issued violation letters.  The neighboring units guests can park in guest parking and that is not a violation of the Association's Rules and Regulations.  I will be submitting a follow up response with the 2 remaining work orders attached, the Rules and Regulations attached, and the violation letters to the neighboring unit attached for review.

      I am rejecting this response because: the management is intentionally and consistently referencing the gutter drain attached to the house near the gas line pipe, which I am completely aware of how this should be handled. ******************* is evading the issue and he is fully aware that there are two drain pipes and the drain pipe that I am referencing is at the front door and the *** ordered that this drain pipe be buried to remedy the flooding at my front door.  It took him over a month to reply with this lie. ******************* is dishonest and he is well aware of the drain pipe that I am referencing. This *** isn't going to stop handling matters that involve the paying members of this association with complete dishonesty until they are served with a law suit.

      Please find photos attached of the downspouts in question.  One is connected to underground drain tile, which discharges into the yard, to prevent flooding on the front walk way.  The second discharges at the edge of the planting bed, which is not located near the entry walk.  The gutters/downspouts were fully replaced in 2021 and there is not any required service needed on the downspout discharging into the planting bed.

      Since the unit owner moved in in 2019, there have been a total of 48 work orders issued for maintenance concerns that have been reported.  S.P. Management, Inc. will continue to provide timely service to the unit owner on any maintenance requests that fall under the responsibility of the Association.

      I have repeatedly contacted SP Management over the course of 2 months.The company does not answer any type of issue including health and safety, water damage, construction permits or even permits. We pay these people for service but get nothing for it. Please tell them to answer my communications.

      In the past 2 months, ************ has been leaving his garage door open for long periods of time and at night.  Neighboring units have made complaints as this invites anyone access to the common space in the building.  ************ continues this activity which is a safety concern for the other unit owners in the building.

      The Association is not involved in the construction permit process.  If a unit owner is completing work which requires a permit, they must secure through the Village of ************  ************ previously installed a chairlift on the front staircase of the common stairs without Village approval or the necessary permit to complete this work.  If a permit was secured, the Village would've required the stairlift be installed on the rear staircase, as many others have been installed on the property.  ************ was required to remove the chairlift due to lack of approval.  If not removed, the Village would've issued the Association fines when completing their bi-annual fire inspections of the building.

      I am rejecting this response because, *************** still doesnt acknowledge the issues that he has ignored thus far :He was well aware that the garage door being open originally was a simple memory problem on my part which was exasperated by a couple of rude and paranoid older female tenants posting a demand note pasted to my mailbox. Since then the tenants have been allowed to post and maintain 3 separate demand notes, against building rules. ******* negligence has resulted in 5 visits from village police , who have informed me it is not a police matter. ****** has been sent 4 or more requests for maintenance and support requests through the regular web site, he ignored. The chair was installed with HOA approval,  the permit is the contractor responsibility, I wasnt made aware of permit issues, the only other install point was already in use. ****** agreed to negotiate a shared use with the hostel neighbor and did nothing.  I have installed an automatic camera and closure device in an attempt to satisfy the complainers. The roof staining is in our spare bedroom, the drywall problem is next to the garage door on both sides ironically. The drywall has turned to power from water damage.

      I am rejecting this response because:

      *************** continues to deny knowledge or awareness of the eventual problems caused by his job negligence.  

      The garage door issue *** is referring to, is the result of three neighbors disagreeing about my right to control part of my personal living space.  *** could have interceded and calmed these neighbors down however, as is his habit, failed to do anything resulting in the small issue expanded to the point of the village police responding 5 times. The 5th visit was at my request in order to protect myself and my wife legally and because the neighbor mentioned "bad wiring burning the place down".  The police explained politely that the garage door being left open is not a police issue and they were trying to calm everyone down. At this point, I should mention, no response was come from ***************.

      The chair lift was a separate issue entirely as I remember.  I contacted ***************** for guidance on *** guidelines concerning such things.  *** sent a standard form that I filled out and returned with the requested copy of the estimate and name of the contractor, and it was returned approved by the *** board. We are on the 2nd floor and since moving in my wife has been declared "Homebound" as a result of onset dementia causing dizziness and arthritic conditions worsening in here legs.  It was the contractor who told us that we could not install a 2nd lift on the back stairs so any lift would be placed on the front steps.  Why do diligence was not performed on the application, I don't know.  The chair device was remove at my request after my being informed.  I should mention I have contacted the appropriate agency for housing discrimination and are awaiting there response.

      The issue of the bedroom ceiling water staining as been repaired using paint sealing primer by me personally and so far it has held.  The wall water marks are due to be addressed at my schedule.  The garage drywall problem in the garage, is ongoing and will probably be addresses when the rot appears in the neighbors garage.

      At no time has *** responded or inquired about any of these issues.  I have attached a copy , if possible, of the construction approval form, let it inform you of any guidance I was given for improvements I wanted to make.  I have reviewed your records of Mr ******* performance.  They speak for themselves.

      The source of the reported leak is likely from the above unit.  Unit owners are responsible for their individual plumbing, and the ***** of ********* did not authorize S.P. Management, Inc. to hire a plumber to locate the source of the leak for the above unit owner.  The ***** of ********* notified the above unit owner of the reported leak. 

      Since the original complaint was made, there has been a change in the ***** of *********.  S.P. Management, Inc. has since been giving the authorization to hire a plumber to inspect and determine the source of the leak. If the unit owner responsible for the leak does not take corrective action, the Association will make the necessary repairs and the responsible unit owner will be charged the cost of the repairs.

      HOA SP Management dismissive of request for repairs, ignores emails, lies about what repairs/upgrades being done, will not handle issues, gives the hired contractors my phone number and I have to convince them that there is a needed repair. For over two years, ********************** has damaged my property and does not do the work at my property that is scheduled. ***** dug a trench and destroyed my rock gravel, the owner refused to acknowledge and ******************* stated that they will repair, my rock gravel was replaced with 2 bags of $3.50 pea gravel. The landscaping company continue to plow over my rose bushes, leave grass clippings. ******************* stated that he would personally inspect, but he never came to my property and when I emailed, he and the board member ignored my emails. ******************* continues to lie stating that "the landscapers tried to fix it, but someone at your house ran them away". This is a false account because the landscapers never came to my house. I moved here in 7/2019 and my dues are paid each month on time; however. I continue to have my concerns dismissed and ignored my ******************* and when he does reply to my emails it's condescending and I'm convincing him that I do have an issue. I'm believe that this is racial because other members of the community are accommodated, but I receive nothing but pushback from him. Everything is a challenge for me, the landscapers planted the wrong trees and when I called him he insisted that they were correct and lied stating that he just inspected the trees. I had to take pictures and email the board before he would acknowledge the issue and listen. The landscapers did indeed plant the wrong trees, he did not apologize. I pay a mortgage, HOA fees, taxes and this has to stop. The board of directors are of no assistance in getting him to handle homeowners differently.

      Please see attached photos regarding the most recent complaint of the landscaping bed being damaged while the landscapers were spade edging the planting bed to define.  The original complaint reported existing pea gravel was disrupted and removed from the bed during the spade edging.  The landscaping contractor returned and installed additional pea gravel to the existing planting bed.  There are two photos attached. One of the planting bed before the replenishment of the pea gravel and another of the planting bed after the pea gravel was replenished at the expense of the landscaping contractor.

      Also attached please find the work order history for this unit.  All request, concerns, and complaints are addressed in a timely manner and sent to the necessary contractor.  There are a total of 42 work orders that have been issued since July 2019 for differing concern, requests, complaints.  S.P. Management will continue to address any concerns, requests, or complaints that the unit reports that fall under the responsibility of the Association.

      ***************** returned and replenished the stone in the planting bed.  They attempted to match the existing stone the best they could.  They continue to service the property on a weekly basis per their contract.  Please notify our office if there are any further issues with the landscaping service and they will be addressed in a timely manner.

      I notified the owner (***********************) of water damage in my garage due to water coming in from the outside. He had a contractor come out and check and they thought it was from the garage trim. So I replaced the garage trim and the water continued on days in which it rained. Eventually upon seeing more pictures, ***** acknowledged that its from the driveway being cracked near the garage and acknowledged that is a repair he is responsible for. He has only been responsive in stating that it will get done once it warms up but we have had 80 degree days and my garage continues to flood when it rains. He has since been unresponsive and is not present in the office when I have come there twice to speak to him. Emails have gone unanswered.

      Unit owner experiences water seeping into the garage under the garage door during heavy rains.  *************** has sent contractors out when reported.  Initial report was the weather stripping at the bottom of the garage door needed to be replaced as it was allowing water under the garage door. Garage doors are the responsibility of the unit owner.  After the last report of continued water seepage, the Association issued a work order for the asphalt driveway to be inspected.  It appears the asphalt may be slightly higher than the garage floor, allowing water to pool against the garage door and seep underneath.  The contractors findings and recommendations for any necessary asphalt repairs will be reviewed by the ***** of ********* and the necessary action will be taken to prevent future water penetration under the garage door.

      I am rejecting this response because: This initial complaint was sent to the association on December 9th, 2022.  Association meetings have occurred since then.  As admitted by S.P Management, the contractor they sent wrongly diagnosed the issue and therefore upon me paying out of pocket to fix the garage door trim, S.P. Management admitted via their own admission that it wasn't the issue.  This has been nearly 6 months of water pouring into my garage and through their own admission, now stating to continue to wait and receive more water damage until another meeting occurs which could be months from now.  The association has the ability to communicate and get someone assisted to this task but it is being pushed back or avoided at my expense with no compensation for the water damage and inconvenience that the flooding is causing that the business has now admitted is their fault.

      This issue was further investigated and discussed with the unit owner present at the time of inspection.  Please see attached photo. 

      The garage concrete garage floor is backpitched which allows water to seep under the garage door. Please see attached photo. Unfortunately, the garage floor is the unit owners responsibility to maintain/repair.  The inspecting contractor recommended installing a threshold to prevent future water penetration.  Please see attached photo.

      *************** to the latest statement from the business as I still remains dissatisfied with the resolution. The latest statement conveyed that they spoke to the unit owner. This is once again untrue. Neither owner was present at the location when their repair man came by because we were not notified in advance that they were coming.
      I will also like to present further evidence that still supports what they already admitted (i have submitted a copy of their email admitting to it previously) that the water coming into the garage is from the asphalt that they are responsible for. What the water does once in the garage is the unit owners responsibility but the water initially getting into the garage is their responsibility since they are responsible for the asphalt.
      Please reopen.

      After reviewing photos of the issue with the unit owner, the asphalt contractor completed repairs in two areas that could be allowing water to penetrate under the garage door.  The contractor reported he was keeping in touch with the unit owner after the repairs were made to make sure there was not any more seepage during rain events.  I have not received any additional reports of seepage at this time. If there is a continued issue, please notify me at ************** or ****************** and it will be addressed.

      I am trying to get a simple answer from my property manager. I have submitted all the required paperwork weeks ago with no reply from *******************. I have always been polite and patient with my communication and yet *** refuses to even acknowledge my issues. I have called 6 or more times and emailed 2 more. I have visited the office and was told he wasnt there so I left a note with the receptionist. My contractor is wanting for approval and I get an answer to give him. Please help.

      The entire roof for this building was replaced in 2020.  We recently received the report that could possibly be continued leaking and ***** Roofing was contacted to further inspect.  Any drywall damage or mold remediation needed due to leaking will be addressed by the Association.
