      I had hail and wind damage to the roof of my home in July of 2022. ***************************** of TPC Public Adjusters was hired by me as my Public adjuster to initiate and help settle a claim with my insurance company. As of December of 2023 the claim was closed by the insurance company. I am fine with that. The insurance company issued 2 separate checks. My agreement with TPC is to pay a 20% commission on the amount of the settlement. I agreed to that and I'm willing to pay it. The checks need to be endorsed by myself, TPC Public Adjusters, my wife, and my mortgage lender. February 8th of this year I emailed TPC to request his signatures on the checks and at that time I would issue a check to him for 20% for his service. That was about 6 weeks ago. I am not able to move forward and have my roof replaced until he endorses the checks. He continues to push to try to claim more damage to my home exists. I am completely satisfied with the insurance settlement but TPC continues to ignore my request to endorse the checks. I am at my **** end with this business. I believe he's upset we are not going to hire his roofing company to perform the work. I understand we are not obligated to hire his company to do the work.

      ***** does not understand that as a public adjuster I must compile enough evidence and supporting documentation in order to argue the scope of work which is related to the loss at hand and it does not happen overnight. I cannot simply settle the claim when the insurance company has not approved everything it takes to replace his roof, siding, and gutters according to all applicable building codes, local ordinances, and the manufacturers installation instructions. ***** refuses to have direct conversations with me over the phone for me to thoroughly explain exactly what still needs to be done in order to get all of the restoration work approved. As of right now he is only approved for $26793.89 where my estimate is for $72,122.19 which what it takes for the restoration to be completed in a workmanlike manner all while adhering to all enforceable building codes, village ordinances, and manufacturers installation specifications. Im not exactly sure how he thinks that the work can be completed at such a low dollar amount. 

      These following statements are coming directly from the ******** ********** of ********* website. 
      -Are there standards of conduct that a public adjuster must follow?  YES. A public adjuster is required to serve with objectivity and complete loyalty for your/***** interests alone and to render to you/***** such information, counsel, and service as will best serve your insurance claim needs and interests. ***** FEELS THAT HE IS BEING TAKEN ADVANTAGE OF BECAUSE THE INSURANCE CLAIM PROCESS HAS NOT BEEN COMPLETELY IN HIS UNREALISTIC TIME FRAME AND BELIEVES I SHOUKD BE FORCED TO SETTLE HIS CLAIM FOR $26k+ WHERE THE ESTIMATE I HAVE PROVIDED TO HIM AND THE INSURER FOLLOWS ALL APPLICABLE BUILDING CODES AND LAWS. 

      As a public adjuster, I agree to and understand that I must be in compliance with all Federal and State Statutes and Rules. 

      ***** has also been notified of the repercussions of canceling this contract in the middle of me continuing to assemble all supporting documents and estimates which need to be sent to the insurer as part of the negotiation process. 

       

      ***** has also threatened me that he will also push his neighbor to file complaints against me when I have not done anything wrong as a public adjuster.

      I am rejecting this response because:

      My insurance company has not approved replacing the siding on my home. And I don't blame them there is very little damage to the siding. I believe only one or two pieces of siding have a little damage. So I feel **** is continuing to pursue excess damages to increase his commission.  My insurance company closed the claim last December.  I have requested to **** several times to settle. I've also requested **** endorse the checks we've received from the insurance company to cover the cost of my roof. He has yet to do so. In fact I believe it was February 8th when I asked him to endorse the checks. At that time I'll gladly pay his 20% commission per our agreement.

      I am rejecting this response because:

      ***************************** has continually misrepresented different rights I have as a homeowner entered into a contract with a Public Adjuster. He insists I have no say in when to settle the claim with my insurance company. This is not true. He continually pushes to claim ************* all new siding when only one or two pieces need to be replaced. He submitted a claim to my insurance company saying all the plywood on my roof needs to be replaced. This is definitely not true. He just sent me an invoice which includes commission for himself on money the insurance company has not released. This goes against ******** ********** of ********* regulations. Almost a year has gone by since I signed a contract with him and he's still trying to push for more insurance money. I'm running out of patience with this business.
