      I was looking for a contracting business to help remodel my home's garage. To do this, I used ************ referral service, "Proreferral" and they recommended various companies, who went to look at my garage and to get an estimate as to how much it would cost. I decided to go with a company by the name of "Demergel Building LLC" with the contractor's name being *************************** because the price seemed reasonable.At first he said that it would cost $15,500 for demolition of the garage, new cement, and building the new garage itself on the phone. When the contractor came in person, the price increased to $17,800, which I felt was still reasonable. The contractor told me that I would have to pay for materials that is included in the $17,800 price, but I would have to go with him to ********** to pay for the materials via my own credit card. I trusted the contractor and went with him to ********** and ended up paying $6,800 for the materials from my own credit card as opposed to the company itself paying for the materials. After buying the materials the contractor asked for $4,000 payment in cash up front. This was all done in July 29, ****************************************** signed.Since I felt like the contractor was trustworthy, I gave the $4,000 in cash. I was done working a 12 hour shift at the time and was not thinking clearly, and ultimately ended up regretting my choice as I had paid $10,800 before the job was even started, AND without a contract. Ultimately, the job never started at all, and all that was given were empty promises. Due to this, I have lost approximately $10,800 in total, and have been left with nothing being done with my garage. On top of this, the company ordered a dumpster. The company of the dumpster is now threatening to put a lien on my property, claiming that I would have to pay for the dumpster. I was not the one who ordered the dumpster, the contracting company, Demergel did.

      We took on a job, demolishing and rebuilding g a 20' x 20' garage. The customer was suppose to clean out the garage, that was never full finished, as we were not contracted to do that job. Bit helped out the customer. All the materials have not arrived to the client's house. I offered a refund, but they also called the police, which sided with the company. They were in a hurry with out any proper material to compete the job

      I am rejecting this response because:
      First and foremost, my apologies for not noticing that the company responded to my initial complaint on August 10, 2023. I did not receive any emails in my inbox that showed that they responded, and only recently received an email today at 12:39 PM announcing that the complaint was closed due to no response from me. Again, I didn't receive an email stating that the company responded to my complaint, otherwise I would have responded within the deadline.
      I will be providing a refute to the contractor's argument/response to my initial complaint below if needed to re-open the case/complaint I have also provided attachments in this email as further proof to support my claims, my apologies for the long email, I just want to make sure the complaint is not closed due to my mishap:


      I have supporting documents that show that the materials were ordered for the job such as the receipts and I can also pull up camera footage of the materials being delivered to my home. I also contacted the manager from ********** to show that they ended up picking up the materials due to the job not being fulfilled. The ********** manager was there on the day that I, along with the Demergel Building LLC employee, ***************************, ordered the materials. Part of the materials arrived on August 2, 2023, and the rest arrived later. I will provide an attachment of the receipt below and will provide pictures of my cameras showing that the materials did arrive at my home.
      Regarding the "police siding with the company" that is false. When I went to make a police report, the police stated that this was a civil matter. They did not side with either side as it was not their job to since it is not their job to handle civil cases, which is why a police report could not be made. The main reason why I went to the police station was because on August 10, 2023, the dumpster company that Demergel Building LLC rented the dumpster from called me, and threatened to put a lien on my property if I didn't pay. It had nothing to do with the $4,000 dollars. I went to the police to ensure that a lien would not be put on my property because I was not the one who rented the dumpster, but instead Demergel Building LLC was the one responsible for that.
      Regarding the garage not being cleaned out, I have already cleaned out my garage. For this garage remodel job, I specifically took 2 weeks off from work to ensure that the job would be completed. I will be providing an attachment to show the inside of the garage.
      The $4,000 was given before the job even started. The job was never started in the first place due to *************************** of Demergel Building LLC delaying the job repeatedly. I do not see why it is an issue for them to return the $4,000 I gave. IN FACT, outside of the dumpster they rented, they did not spend any money on anything. The materials were paid for with my own credit card (ending in ****) and the total amounted to approximately $6,800.
      If need be, I can provide credit card proof that I used my own credit card as the name on the purchase is under ********************** name, not mine as *************************** requested that I put his name. I lost my two weeks of vacation expecting the job to be started and completed, but it never happened because of Demergel Building LLC.
      I believe that Demergel Building LLC is NOT entitled to the $4,000 given because it was my money in the first place. Their employee, *************************** was lying to not only myself promising to get the job done, but he also continued to lie to his boss, ***************************, by stating that I was the one delaying the job, when, I was not. Again, I took a 2-week vacation from my job for this garage remodel. I would not have done so if I intended to delay the job myself. That does not make sense. Why would I take a 2-week vacation from work, and then just decide to delay the job repeatedly?
      In fact, prior to me dealing with Demergel Building LLC, I worked with a different contracting company that was also referred to me by **********s ProReferral website sometime in June 2023 to have a fence built. I had no issues with that contracting company, and the cost to have the fence built was also a considerable amount of money. Again, why would I repeatedly delay a job I want done? Also, a permit was not submitted for the demolition of my garage either, despite me asking Demergel Building LLC if they had a permit. I looked at the city of building records to see, and the only record was from the fence I had built prior.
      I simply want my $4,000 back. I lost money and time off work due to taking 2 weeks off from work expecting to have my garage fully demolished and remodeled by Demergel Building LLC.
