On 5/4/2022 I ordered a retractable banner from Leap Design and Print, Co. On 5/5/2022 I paid $183.09 for the banner. On 5/13/2022 I received a banner that looked very faded. On 5/13/2022 the owner confirmed it was a machine error. I was promised a replacement after that weekend. I had no replacement by 5/18/2022 so I contacted the owner again. The owner made an offer for a partial refund or a percentage off a future order. I declined. On 5/24/2022 I asked for a new banner. on 5/31/2022 I still had no banner nor a refund. On 6/8/2022, I requested a full refund and was told the owner had no money and was being "transparent." I was told I would be issued a refund in 3 weeks. On 6/13/2022 an attempt was made to return the banner. The business was closed. The owner advised of a return time (2 p.m. to 4 p.m.) when I am at work and not available to leave my job to drop off the banner. 6/21/2022 I filed to take action with my payment company (pending) because it is going through the State of ********. 6/28/2022 I contacted the owner regarding my promised refund as it was the promised refund day. I was told by the owner that the refund was processed on 6/24/2022. Today is 6/29/2022, I still have no refund and the written agreement to produce a new banner (made on 5/13/2022) and the written agreement to refund my $183.09 (made on 6/8/2022) have both been breached. This is my final attempt to remedy.

      Business response

      06/30/2022

As the messages from the customer reflect, our company did attempt to handle the issue in the best manner as we could. As attached, the screenshot shows this item was one of few products we out source as a print broker. As soon as we were contacted, our supplier was contacted for a resolve. The response from the supplier was that they would look into the issue and get back to me, later to confirm it was a coloring issue and would need to have the machine repaired, this information was then given to the customer. Since we are a third party in this transaction, every contact from the customer that was received, we had to wait on answers ourselves whether it were item replacement, or refund. As a third party and small business, unfortunately, when a refund is requested, we have to wait on the dispute from the supplier to be approved and received before we can issue to customer as we make very little profit from products that we outsource, this in summary was explained to the customer as well stating that we did not have the funds at the moment but we will process within the next few weeks when available. The refund was processed on Friday 6/24/22 during end of day accounting with an expected completion of 2 to 7 Business Days, this notice was also emailed to the customer and legal representative on 6/29/22.

I am rejecting this response because:

I do not have a full refund in the amount of $183.09 as of this response date.

I will also add, a final reason for the rejection is the falsely laden response.

On May 18, 2022, (see attached) the owner, ***************************, emailed a response to my inquiry for an update on the banner. His email reads:

"We have a tech coming tomorrow to check the color settings on the machine. We will follow up with you tomorrow afternoon/evening."

There's no mention of a "third party."

On May 23, 2022, (see attached) the owner, ***************************, emailed an update to me. His email reads:

"Our machine is still down and awaiting parts." *************** goes on to write, "once the machine is fixed, I will get you reprinted."

There's no mention of a "third party."

I cannot control **************' business nor his business practices. However, he took my money then bullied me into waiting over 3 weeks, with no other options, just because he could.

      Sincerely,

      *****************************
