      In March 2022, my elderly mother contracted Finishing Touch to install new stairs and sidewalk at her house in ***************, ** with a $2650 deposit. The work took place in July 2022 (at which time she paid the balance of $3386.90) , and did not pass inspection. The work was uneven, the wrong size, sloppy, and not to code. My mom tried to discuss the failed inspection with *****, but he evaded all conversations. He sent, without my mom's knowledge or permission, some other worker with whom she refused to discuss. He continued to evade, so she then had to contract another company to disassemble the failed construction and re-do everything (which passed inspection). Because of my mom's age, I've stepped in to try to resolve the issue. After several conversations with *****, he suggested we go to court. I then sent a letter to the legal agent, his wife ********, suggesting we try to save the hassle and settle for a fair amount. What they suggested was less than 1/2 of what my mom had paid. So now I'm trying here to find an amicable solution on behalf of my fixed income elder mother.

      ************************* of Finishing Touch Cement and Masonry, ***** *********************************************************************, ************ or ************, was contracted to repave my entire driveway on June 14, 2022. During the process my gate was damaged. Prior to the start date, together, ***** and I, examined the fence and gate, and confirmed there were no dents, scrapes or damage of any sort.The work started on September 16th. I inquired of ***** whether his trucks would be too wide to fit through my gate. I then reminded him that there was nothing wrong with my gate, to which he acknowledged. After advising him be would be accountable for any damage to my gate, I told him that I did not mind if he removed it to get the job done. ***** assured me there was sufficient room for the truck to get through without damaging the gate.The driveway was completed on October 6th. ***** advised me not to drive on it for two weeks. I left the barricades in place longer to extend the drying period because he said the longer, the better. My focus was on the driveway. I had just paid over $15,000.00 and wanted to make sure nothing went wrong. I had yet to notice the gate because I wasn't driving due to knee surgery. My fiance provided transport for me, parked his car on the street and we used the front door to come and go.Once I began using the driveway, I noticed the scraped panels and split in the right gate post. I then called ***** on January 10, 2023 to inform him of the damage. He agreed he would do the right thing and told me to call him the next day after 10 a.m. so he wouldn't forget. I called but there was no response until his wife responded to my email on January 25th. She promised to update me on a resolution. I waited and heard nothing so I sent an email on March 6th. He came out on March 7th inspected the damage, advised he had the slats and requested that I locate where the gate kit post could be purchased. I sent the information and have heard nothing since.
