      B&S Landscaping signed a contract with ********************* ***************** for Snow and Landscaping. B&S Landscaping knowingly new all the terms of the contract and agreed. In December **** in order to pay B&S Landscaping for their services, their Certificate of Insurance was expired. For many months email correspondence and phone messages were left to B&S Landscaping for a copy of their certificate of Insurance renewal. We received a certificate of Insurance from ****************** however it did not contain the business name on the certificate of insurance. We then requested again on 7/7/2022 a certificate of insurance showing the business name and workers comp per the agreed contract that B&S signed. The association sent B&S a termination letter on 5/31/2022, stating their contract would end on 7/1/2022 due to poor workmanship on the property. B&S chose not to continue landscaping work at ********************* Association as 5/31/2022, even though they were to continue until 7/1/2022 maintaining the property per the contract and the termination letter. On June 1, 2022 we contacted B&S Insurance agent asking for a certifiate of insurance showing workers comp. We were told by B&S insurance adjuster that he offered ****************** workers comp insurance however he declined. ****************** prior to his renewal of his insurance did in fact have workers comp insurance. On 8/1/2022 I sent this email to ****************** "Hello, Please be advised per the contract that you agreed with ********************* states, you must have ********* comp. Your insurance agent stated per phone call today that he did give you a quote however you choose not to pay for that portion. Section 5 of the contract states that you must keep the proper insurance, if for any reason you change your insurance you must notify us with in 10 days of the Insurance change. Currently you are in violation of the contract. Please provide us a Certificate of Insurance showing you have workers comp. Correct the violation of contract.

      Tell us why here...We have done business with PSI for over 7 years. Never have we had an issue let alone one complaint come from ********************* ASSOCIATION. I have better communication with the actual HOA than the property management company unfortunately.  This complaint is misleading as is the way this organization operates. Mrs. ******** is not only skewing the facts but  also attempting to tarnish our phenomenal reputation!On 08/01 I emailed ******************** the timeline which leads back to December 2021and stating the consequences of PSI To take action in regards to the stated matter.I originally attempted to file a complaint on  August 4, ******************************************************************************************************** litigation. PSI must have yet to been served with a court summons. In addition,The contract provided is altered. The original SIGNED CONTRACT did NOT HAVE THE CORRECT DATES. Attached is the signed contract by both parties reflecting incorrect dates. In addition  ******************** forgot to mention that per the last Certificate of Insurance submitted in 2021 the insurance was not only compliant but did not Expire until March 27, 2022. PSI Organization OWES B & S LANDSCAPING  more than 10K  USD AS OF TODAYS DATE, Our billing Occurs after services have been RENDERED completed. 30 days net.  And 3 months (90 DAYS) went by in which payment could have been made prior to our COI expiring.  AFTER 120 DAYS OF NON PAYMENT PSI WAS IN CLEAR BREACH OF CONTRACT   We are a small organization that needs every ***** to continue to operate!  In good ***** Efforts B & S  Landscaping continued to maintenance ********************* Townhomes, yet no payment was ever received. Upon demanding payment ON 05/19  PSI Sent the attached letter wrongfully terminating our contract with *********************. THE LETTER SENT BY PSI DID NOT COME FROM ********************* BUT FROM PSI,     THIS LETTER was dated 05/24, 5 days after payment in full was demanded and an Updated COI Was sent. ******************** statements are full of deceiving dates,.  Attached you will find copy of the letter requesting termination of contract of   06/19.  After  Several Failed attempts to Collect a payment were made we no longer had ***** we were going to be paid by Psi. 30 days went by and we sent out another copy of COI because PSI Claimed it was never received.  On 07/01 ******************** was sent another COI. A whole week went by and ******************** emailed on 07/07
      Hello Please be advised that your certificate of Insurance does not say B&S Landscaping it states ***************************************  your last Certificate of Insurance says B&S Landscaping that is one we need to pay you.
      Please send me the Certificate of Insurance that states B&S Landscaping on June 12 an updated COI was once again sent.  And a reply was given as  Thank you I have received it. A whole week went by and at the end of the business day on 07/18 4:54pm I receive this email


      Hello,
      After reviewing your certificate of insurance,it does not have workers comp listed like the last certificate of insurance we had on file for you that has expired. As you know your contract states that you must have workers comp insurance.

      At this point this is just insult to injury. I replied with the email copied and pasted from email below..

      At this point PSI wrongfully terminated our contract,  so I believe that your insurance requirement as a requisite to pay B & S Landscaping  invoices dating back to winter of 2021 are not valid.
