We hired MTZ Landscaping to build a new retaining wall in our backyard beginning in July of 2021. On 8/20/21 MTZ hit the wall with a bobcat and it completely collapsed. We called in another landscaper trained in retaining wall construction and he said to stop work immediately, that MTZ was constructing it entirely incorrectly. We have had numerous engineers also inspect the wall and all said that absolutely nothing (from the construction method, the depth dug for support, the complete lack of geomesh which was included in the contract but did not appear to be used, etc.) about the construction of it was done correctly. Every engineer confirmed that the wall would have absolutely collapsed if it had been finished. If it had been finished and collapsed with our kids in the yard, it could have been devastating. They also prematurely tore down part of our existing retaining wall which is now causing soil erosion. We asked MTZ to file a claim against his liability insurance which was current when we hired him. After 2 weeks of no response, our homeowners insurance filed the claim for him against his liability insurance. We then found out that MTZ had let the liability insurance lapse so they would not cover the $115,938.48 in damages (price to undo partially constructed wall as well as to re-do it correctly). That number does not include the damages to our now cracked driveway as a result of MTZ parking his truck with 12 tons of dirt in our driveway for extended periods of time. MTZ said he would make it right and refund us the $20,500 we paid him thus far ($15,500 deposit + an additional $5000 that MTZ requested because he was running short on paying his employees). $20,500 is a pretty fair ask considering the ultimate cost to us as a result of MTZ's lack of knowledge on constructing retaining walls. It has now been nearly 10 months and MTZ has stopped answering his phone. We are unable to get ahold of him. So far $0 has been refunded.
