Spoke with our production manager yesterday about ********************. Here's my response.
******************** reached out to Gemini for a warranty repair. He spoke with our production manager, ******. They reviewed his issue and eventually determined that what he was wanting us to repair was not a warranty issue. ****** and ******************** agreed for us to do the repair for $650. Shortly after we received a complaint from ******************** through the BBB. ******* called and ******************** on the day that we received the complaint. ******************** said that it was something that he had submitted a while back and did not know why we would just now be getting it. He then told ****** that he will have it removed once we complete his retail repair. We completed his retail repair. He has not paid us our $650 and apparently has not requested the BBB to remove his complaint.

Contacted this company about a quote for replacing gutters. We signed a contract on 8/2/21. They came out to replace rotted gutterboard on 8/20/21 and advised that there was damage to the roof that *** be covered under our insurance. We called the insurance and they sent out an inspector. Gemini promised their guy would be here to meet with the insurance person but he got held ** in traffic so he was not here. Gemini advised that they would do the repairs for whatever cost the insurance company stated they would pay and they would work directly with the insurance to get it covered. We signed a new contract on 9/10/21 for the roof and the gutters. They came out an did the roof. We were told we would be contacted to schedule the gutters. No call came so I reached out multiple times thru their website chat and asked them to contact my husband and made sure they had his number and email as I was no longer able to take calls during the day. They assured me it was updated and they would contact him. They did not and in fact sent me a few emails which I did not see as I was not expecting them to contact me. My husband even called them directly and ask that they call him back several times. They still did not. Now they are saying that the insurance will not cover the gutters and they put it in the contract because they were sure the gutters would be covered. ***************** is stating they requested photos multiple times from Gemini and they did not send them. When they finally sent in photos they were not the ones they needed. Gemini is telling us now that we need to pay the remaining balance on the contract of $2539.44, even though their contract states the final balance is not due until the work listed is completed. We advised them that if they were refusing to complete the work we look into getting attorney and now they are threatening to take us to court and make us pay late fees and court costs. We are looking for an attorney to go over options as well.Business response

This matter is currently being pursued legally.
Briefly, the customer called us for a gutter quote. We bid the job and they approved the job to replace the gutters contractually. At the time of the quote it was mentioned to them that they had roof damage as well. They filed a claim and the roof was covered by their insurer. The gutters were not covered by their insurer. We addtiionally contracted with the customer for the insurance loss of the roof. The rep that wrote the second contract referenced the gutters from the first contract. Because the rep referenced the gutters on the second contract (that shows just the cost of the roof) the customer believes they should now get free gutters completely ignoring the fact that we have an additional signed contract with them to replace their gutters. When they started demonstrating the idea that they would not honor the first contract we decided to not install their gutters. All we wanted them to acknowle was that WHEN we install your gutters they would owe us the remaining balance from the roof agreement PLUS the amount from their gutter agreement. They did not see it that way. Their belief is that we should do their gutters for free. We will not. They owe us simply for the balance of the roof.
Enough people in our organization have gone around and around with both of these customers. They're one hundred percent being nothing more than opportunistic.
