      Contracted NaNa's Bakery on April 28th for a May 8th Mothers day event to provide food and sweets, after a face to face meeting/tasting in her bakery.We agreed to a set menu she was to produce, and cost we paid her $2915 in three payments first payment was $750 4/30/22, second $750 4/3/22 and final $1415 on May 5th as she requested. attached is our origional agreement she committed to. It was all black when agreed to, I highlighted it red(Red are things she agreed to and did not produce) I sent her a copy and discussed it with her she agreed to the refund and overage as well. She asked if she could make 2 payments I agreed. The day she was supposed to make a payment she changed her mind and said she didnt have it. I told her I was going to take her to court. She wanted to offer me some cheesecake offers, I was not interested or pay 100 a month I said no, and asked her to show me receipts for what she spent $2915 on, she said ok. Then I requested her to give me the Chaffing dishes she purchased with the money I gave her no response at this point. I would like to get this resoulved so I dont have to take her to court.

      I've agree with *************, it was a disaster and have tried working out a plan to pay the 25% she is requesting. I don't have a lump sum to pay, I can only pay from my resources. I will pay her from my monthly pension, $100 a month until the 25% is paid in full. I had stated to her I'd pay half but wasn't able to and tried explaining why when she went ballistic and wouldn't let me. That is the only way to pay this debt. The chafing dishes were purchased with my part of the money and therefore belong to me. I've apologized several times and have spoken these arrangements to her, which she dismissed. I will start paying on June 6, 2022 wither she accept it or not. 

      If the payments need to be sent to you and you forward  them to her, just let me know. This is the only way for me to resolve this matter.

       I am rejecting this response because:I know she in in business everyday, so for her to say she has to use her pension is unacceptable.

       No parts of the money should have been used for chaffing dishes because she told me and my partner she had them. So, then she came back and said she need to purchase them. I will accept if she  agreeing in writing to pay the entire amount if she needs to make monthly payments of $100.00 that means she has to agree with repaying $100 for 29 months.

      Or return chaffing dishes, I feel as though she'll benefit from our event and she messed it up.

      Hello BBB,

      The terms are still the same, $100.00 per month until the $975 is paid in full. That was her first request and I agreed to that. I already paid her $100.00 which she accepted thru ZELLE. She stated she wanted 25% refunded and I felt that was reasonable. I'm not going to refund the whole amount nor give her the chafing dishes. I will continue to pay her thru ZELLE. If I can pay more or faster I will. As far as my money source, you don't know my circumstances. I have to work within my means.
