A postcard was mailed to a house that I own in ************ which my sister lives in wanting to buy the house. This postcard had my picture on it with a statement under the picture which said," Very happy with how quickly and smoothly it went", ********* as if I were making this statement to promote their business. However, I am not ******** and have no idea where or how they got my picture. I called them, the person answering the phone said they got it from ****** maps under my address which is public to use. This is false. The picture on ****** maps is the house at this address and ****** maps says if they have pictures of any persons, they will blur their face. My face is definitely not blurred. This appears to be a bulk mailing from the postage printed on it which means it was mailed to several addresses. I have never had any dealings with this company, did not ever make statements to them or for them and never gave them permission to use my photo for any reasons. I wish for them to stop using my photo and to reimburse me for using my photo for their false advertising.

      Good afternoon!

I appreciate you giving us this opportunity to respond. I am so sorry and I feel a little confused. We have a video testimonial on our website and use it on our promotional materials from time to time as we received it from one of our Acquisitions Specialist the day the house was sold to us. Here is the page on which the video sits on our website: https://www.simplecashhomeoffers.com/testimonials/

We want to help out with this misunderstanding as best we can.

      Here is the video https://youtu.be/z9cpBsmZ2zg.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and find that this response/resolution is satisfactory to me. Upon reviewing this video, I have determined this person is not me, though she looks very similar and when I called the company I was told they got my picture for these cards from ****** drone from outside my house.

      Regards,

Company texted me from ************ advising that their records show I requested information from them about a cash offer on my home. I have never requested such information, and when I requested that they produce this record, they refused. This company is sending out unsolicited advertisements to telephones under false pretenses without a previously established business relationship in violation of the Telephone Consumer Protection Act.

We have completely removed you from all communications now that we have your property and number we can look you up in our system to remove you. This includes SMS, Calling, and any direct mail. We apologize for any inconvenience.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

My request for resolution was that they remove all of my information from their system, AND to provide an explanation as to why they had the information in their system and falsely stated that I requested to be contacted.  If they are sending out such messages, they should have the detail as to how they got my information and when/how I requested they contacted me. Without knowing how they got my information, I cannot trust that it won't come back to them in the future for them to bother me with unsolicited marketing under false pretenses.

      Regards,

I apologize, I must have skipped the part that you were asking how we received your information. We use a third party company that pulls public records of homeowners name and address in areas we wish to buy in. Your phone number came from a skiptracing company. Thank you.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and find that this response/resolution is satisfactory to me.  I am surprised that the business would freely admit that they paid for my data, and then used it to send out false statements in a marketing ploy, which may be a violation of the TCPA.  At least its a public record now.

I am fed up with constant harassment from scumbag cash home buyers; I am bombarded by constant mailings and early morning phone calls outside business hours soliciting the purchase of property I own which is not for sale. "Simple Cash Offers" mailings are sent by "************" (https://************.com/), which is part of ************************* (https://www.******.com/), *************************************************************. The property in question is not in ********, nor do I live in ********. The Indiana phone number (even though the business is allegedly in ********) is a voicemail. Attempting to "opt out" of these mailings does not work. Since "Simple Cash Offers" uses the address of a direct mail company, you should do better due diligence before listing it as a legitimate business.

We do mail over ****** postcards to potential sellers each month. We have received other people's requests to be removed from our mailings. Our postcards state that if they want to be removed they will need to call or text us with their property address. Unfortunately, I do not see this person's phone number to see when they called/text us to be removed. In the past, we have received texts from people asking us to be removed but didn't give us any information like a property address. I will need this person's phone number to confirm if this was the case. We apologize for any inconvenience and are dedicated to getting this resolved and removed from future mailing."

I will be happy to provide Simple Cash Offers the addresses of the properties in question by email or privately through the BBB, but I will not call or text because I do not want this company to also have my phone number, given that I already receive more spam calls from cash buyers in the Midwest than I do from local numbers where I live.  I also want to know the identity of the direct mail contractor it uses, the holder of **** Permit #**** in *********, **, since the companies behind these offensive mailings generally provide mailing lists to entities such as Simple Cash Offers as part of their services.  I want my name, address, and addresses of any property I own permanently removed from any and all mailing lists maintained by Simple Cash Offers at any of its addresses (it sends mail with differing return addresses) and confirmation that ALL my information has been removed from any and all databases maintained by any and all direct mail contractors it may use.
