      April 2024; commission dated April 3, 3024 on check for sale of some jewelry was $81.25 short (5%). *** McCulloch has acknowledged this in a text message and on a call with me back in April; said he needed to review calculation and hed get to this when he could. I sent him calculation; and, after 3 months, periodic calls and text msgs, hes gone silent. In my last msg to him I said I just wanted to know a date I could pick up or he would have a check mailed; no response. So, Im sadly filing this complaint in hopes that this may initiate payment.

      Scheerer McCulloch was under the impression that Ms.********* intended to pick-up the payment at our office.  We apologize for the confusion and delay.  A check for $81.25 was mailed to Ms.Carrisimi.  Thank you for bringing this issue to our attention.

       Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and find that resolution is satisfactory to me because a check was finally made out on 7/22 and mailed to me, after 3 months of inquiries; but, just to clarify, per the attached picture, I asked if I could pick up the check on 7/15 and on 7/18, still no response; therefore, there was no misunderstanding and no need for Scheerer to embellish its response with an untruth. I had even sent a follow-up text saying the BBB had closed for the day on 7/18 and, if he would just respond, I wouldn't file a complaint, but, again, no response. I appreciate the support of the BBB.

      Won an online auction lot that closed on 8/02/23 for a 2020 Polaris RZR UTV. Did not get an invoice the following day. So I called their office to find out there was a reserve on this particular lot. She then tried to get me to increase my bid in order to meet the reserve. The fact that this particular lot had a reserve was not divulged or disclaimed on any description of this auction. I even emailed this office with a question about this lot and their response did not include this information. My complaint is that if this was a reserve auction, it shouldve been advertised as such. And if the bidders bids didnt meet reserve they shouldve been informed. (Reserve Not Met). The argument that this was simply a mistake doesnt work either. This company is a reputable company and has been in business for many years. They shouldve known better.

      All lots (items) presented for auction on the Scheerer McCullochs Hi-Bid Bidding Platform that have a reserve that has not yet been met (the lowest price accepted by the seller) are designated by the verbiage Reserve Not Met highlighted in red on the right side of the page. (See photo of the webpage ****************** is citing.)

      If the reserve price of an auction item is met/exceeded during the bidding period, verbiage stating Reserve Met is displayed on the webpage containing the auction item.  (See example of a webpage where the reserve price of an auction item was met.)

      Scheerer McCulloch did inform ****************** of the reserve status of the item via the notice on the Hi-Bid Bidding Platforms webpage.

      I purchased a trailer from Scheerer McCulloch Auctioneers auction (hereafter referred to as SMA). Paid in full invoice # 54675 !/28/22 $1,540.76). I paid same, via my credit card thru SMA card processor and was given a receipt by SMA for the purchase. SMA accepted payment by me, to them. After this transaction took place and payment was processed, lady cashier performing all sale transactions told me they did not have the trailer where their email instructed me to pick it up at. She also said they did not have the title. I told her that was not disclosed there was no title and I asked for a refund. She refused the refund request. I was instructed to get trailer and title from a property in *************************. I traveled to that location and they did have the trailer but no title. I called the company regarding not having the title and was directed to *********************** Real Estate Agent/Auctioneer and he instructed me to take the trailer and he would make all arrangements to get the title and have it delivered to me via mail and this should not take very long at all. He made a deduction on the purchase price and credited my card for their mistake regarding the pick up location (which was a substantial distance from where they instructed me to go to pick it up). Several weeks had passed and the title has still not arrived from ***** nor any contact from him or others. Several text messages with **************** have taken place maily initiated by me since he was failing to follow up with me on follow up dates he promised. The most recent 2 communications he indicated the title was so close he could smell it" and would follow up with me few days later (4/29/22) and he never contacted me. Today is May 6th, 2022 a week after his last promised follow up date (I let it go an extra week) and still no title or follow up. instructed me to go to the estate of a deceased party to get the items.

      Thank you for bringing this situation to our attention.  The title to the trailer was lost.  Scheerer McCulloch has contacted the *** requesting the issuance of a replacement title.  That title should be received with in the next 2 weeks.  Once the title is received, Scheerer McCulloch will provide the replacement title to the new owner of the trailer.  The owner was notified on May 9, 2022 via text message that Scheerer McCulloch was seeking a replacement title from the *** and that we expected receipt of the title within the next 2 week.

      Scheerer McCulloch is in receipt of the title.  We have contacted Mr. ******** on multiple occasions to facilitate the transfer of the title to him (see attachment).  Scheerer McCulloch would appreciate any efforts BBB could take to facilitate transfer of the title to Mr. ********.

       I am rejecting this response because I still have no title and its what almost 6 months now of MY repeated attempts to get it :

      In their initial response (ONLY AFTER I resorted to this complaint about their failure in almost 6 months to produce title to what they sold me) they said they would mail the title to me within 2 weeks. I STILL have not received it. IT WOULD BE NICE IF- they would at least once, follow thru on what they (again/multiple times) promised/said they would do and again have not / failed to follow thru on ANOTHER promise.  If they have the titel (If they have it), mail it out to me like they said they would. They have the address and it has been confirmed more than once, DO IT! If you have it, Thanks in advance if you can manage to do this.

      As stated previously Scheerer McCulloch is in possession of the title.  Scheerer McCulloch must have assurance that Mr. ******** will properly signed the title as is required under the law. Scheerer McCulloch is obligated to provide assurance to the previous title holder that a proper title transference has occurred as the previous title holder could be held liable for any accidents or mishaps that would occur involving the trailer that ******************** purchased, if the title was not properly transferred. Scheerer McCulloch will personally meet with ******************** at third party location to facilitate the proper transfer of the title.  Would BBB be amenable to allowing the title transfer to take place at their office?  If not we suggest a public location such as a *********.

      SEVERAL MONTHS AGO I apparently was sold / purchased a trailer from the estate of **************************** estate sale promoter Scheerer McCulloch Auctioneers and exchanged money with the same and was given my receipt from Scheerer McCulloch Auctioneers. They never told me they had no title but sold the trailer anyhow. They had me drive to the wrong pick up location and later refunded some of the purchase price for the hassle, additional mileage and delay. They refused a refund to me after my requesting the same when I was told no title and had to drive elsewhere to retrieve the trailer.

      Tuesday 6/20/22 I wanted to go th the *** for title transfer but I texted Mr. *********************** directly, giving him a chance to further assist WITHOUT the need for further BBB intervention, at Scheerer McCulloch Auctioneers at  ************ and informed him via text with message and pics of relevant paperwork they included with the title they FINALLY procured for me from sellers estate.

      Trailer bought by *******, paid to Scheerer McCulloch Auctioneers in full. 

      Scheerer McCulloch Auctioneers sold me and collected the money/payment for the trailer.

      Scheerer McCulloch Auctioneers, *********************** assured me if I went to ***, they would take care of everything for me right away. I explained to him I don't see how it would proceed with the info they gave me but I took his suggestion and went to the *** anyhow. 

      After telling him that event failed, HE NEVER REPLIED FURTHER AND MY TEXTING EFFORTS/CORRESPONDENCE WENT IGNORED once again.

      Given to ******* after SEVERAL MONTHS WAIT, EXCUSES AND DELAYS, by Scheerer McCulloch Auctioneers:

      A. A title of trailer in ********************* ********* name (Decatur, IN) (signed on back of title by ****** *. ********** as ***)

      B. Copy of front/back ******* drivers licence of ****** **** ********** from ******, ******* expiration of licence 11/9/27 DOB ********

      C. Durable *** (power of atty) **************************** dated 6/1/15  - Notary ****************************** ***** County, *******

      D. Death certificate of *******************************/Maiden Name *******  dead on 8/7/14 - Signed by Local ************************************************ via E signature on 8/12/14 and *** *************************** (certifying cause of death) on 8/11/14.

      D1. Surviving spouse/relationship to decedent (****************************) 

      E. *** signed by **************************** on 6/1/15, giving daughter ******************************, lawful attorney in fact and  full power of substitution, and if  ****************************** is unable or unwilling to serve as attorney in fact, then  **************************** appoints another ******** ********************** to serve in that  same capacity.

       

      1. Is the deceased *** is valid after his/********* death?

      2. Drivers licence copy is from  ****** **** ********** NO association with title ownership and/ or ***

      3. Who is **********? No marriage certificate or name change document included with title-*** claims they DO NOT HAVE THE INFO.

      Mr *********************** texted ******* back and said "I had no problem with the identical paperwork if somethings not right  they should be able to tell you what needs to be done"

      Additionally he texted again; "The *** has on file a one and the same person form for ******** change in her married name  all he has to do is take the paperwork that we gave you and they will look it up, it's already on file" I asked him for additional compensation for my time and efforts having the burden of doing their work for them... Request ignored by ******.

       

      followed by "Sooo... What did they tell you about what needs to be done?"

       

      I told him " The title is signed by one person and the *** is another person". Additionally I said " *** echoed same"

       

      The *** Team ******************* also asked what *** specific location did  ****** **** ********** allegedly have whatever type of  paperwork at? I of course have no clue. 

       

      They also said they do not have anything on file (***************) and IF THEY ever did they only keep it for 60 days AND if they did have it on file, they would NOT share private / personal info with me *******"  They also asked if I had any possible marriage documentation showing name change to ********** (from **************************** J.) (not included from seller Scheerer McCulloch Auctioneers). I told them No.

       

      *** suggested  

      a. court ordered title transfer which she indicated would be quite costly, and / or 

      b. lawsuit against the party that collected money for / sold me the trailer (Auctioneer) 

      Both which would be sought after compensatory damages in any lawsuit besides that of punitive damages and any other likely relief.

      The issue appears to be confusion over the maiden name and the married name of person that signed to transfer the title to ******************.  *************************** (maiden name) and *********************************** (married name) are one in the same person.  ************************ is the daughter of the original title holder ****************************.  ******************** granted full *************** of ******** (***) to *************************** (her name at the time the *** document was executed.  The title transfer signature is that of *********************************, *** (The married name of ***************************).  The ************** of ***** Vehicles is in receipt of the *** document executed by ******************** authorizing *************************** (now *********************************) to act as *** for ********************.  Others that have purchased vehicles from Scheerer McCulloch with similar circumstances and have not experienced issues with transferring the title.  On June 30, 2022 Scheerer McCulloch made a verbal offer to ****************** to return the purchase price of the trailer in exchange for return of the trailer to Scheerer McCulloch.  ****************** refused that offer.  At this point Scheerer McCulloch does not know how to resolve this complaint.  We request that both parties enter into BBBs arbitration process and allow the arbitrator to propose a solution.  We understand that as an accredited business with BBB Scheerer McCulloch is obligated by the decision of the arbitrator.  We look forward to resolving this complaint via the BBB arbitration process.

       I am rejecting this response because: What  others have happen to them and those transactions has NOTHING to do with my specific and exact experience. Many factors including location of ***, documentation *** has or has not are just a couple examples. I can think of iothers but to dwell on anything except the facts is additional time wasted. THE **** is the *** I went to told me they are unable to process the transaction. THis is why I asked *********************** to accompany me at the *** but he refused to particiapate. It matters not what other "similar" transactions have yeilded it only matters how my transaction is unfolding and what I'm being told and by whom, both of which I have no conmtrol over and am merely a message transferrer of what I experience and am being told. Having said that I was offered to sell the item back to SMA for what I paid for it, this does not consider my time, expense and efforts to do what they say "should happen" but in fact - does not. I again emplore their efforts at the *** in Pine Valley and could also bring with docuemnts the *** is requesting and/ or the other parties that can assit in completion of the traansaction. Otherwise a lkawsuit will unfortunately be the next step plus costs and damages.

      TOn July 6, 2022 a representative from Scheerer McCulloch went to the Waynedale branch (**************) of the *** to determine the appropriate process for Mr. ******** to transfer the title to the trailer purchased from Scheerer McCulloch.  *** informed Scheerer McCulloch that Mr. ******** should take the completed One in the Same Person Affidavit form (see attachment) to the ***.   This should satisfy the documentation needed to transfer the title.  
      Mr. ******** was sent on July 7 an email from Scheerer McCulloch that contained the One in the Same  Person Affidavit document as an attachment and an explanations as to how he is to proceed with the ***.

      Scheerer McCullochs employee *********************** is willing to meet Mr. ******** at the *************** to assure that the title transfer of the trailer is completed.  We ask that Mr. ******** provide ********************* several days notice to arrange a date and time to meet at the ***.
