      My husband and I went to Rosies Garden and spoke with **** about a list of items that we wanted to purchase and we explained to him where we wanted them to go. We were told that installation would be 60% of the cost of materials so we were willing to pay that amount. Someone arranged to come to the house without meeting with us to provide an estimate so we thought that we would get an accurate estimate. The person who came to the house saw that majority of the plants were going into an existing flowerbed and explained that for that cost the existing bed would be tilled in preparation of the new plants. During the installation we explained to the workers the locations of the plants that we went over with **** but there was no work done to our existing flower bed. The workers dug a hole and placed the plants in the bed. Now that the work is done we are being told that the 60% of material cost that we were willing to pay did not cover installing the plants in our yard. We are uncertain about what it actually covered and feel that the situation was mishandled somewhere. Our requests were not unreasonable to have some of the plants positioned in different locations throughout the yard. If our estimate included the tilling and planting of our main flower bed then the credit for that work not occurring should account for the smaller areas where we placed some of the plants. We are unsure of what went wrong in this situation but we do not feel like we are at fault. This situation could be the result of a communication error, an estimate error, or a site management error but we as customers who expressed our intent and are willing to pay what was agreed do not feel that we should be responsible for what went wrong. We were sent a final bill for $300 more than the estimate to install the agreed upon plants we purchased from Rosies. They were claiming extra dumping charges and fees for installing the same plants from the estimate and we would like the charges adjusted.

      The following is a response to the complaint of case ID ********.

      1. I had no communication with the claimant **************************
      2. I only communicated with Tension Machaya at the same address of ****************
      3. Most often my customers buy a few trees and or shrubs and I charge 60% labor if I don't have to create a new bed for the plant material.  Since ****************** was purchasing a large group of plants and trees I felt it wise to see where they all were going in his yard.  I called him to ask about the job and was told that 10 arborvitaes (evergreen trees) were going in the rear yard the rest of the plant material was going in an existing bed (21' by 17') at the front of the house.  I asked if the arborvitaes were to be planted individually or if I were to create a bed for them.  I explained that creating a bed would involve an increase in the labor charge.  ****************** agreed to this.  This bed was 36' by 4.5'.  The total price was agreed upon.
      4. As stated.  The rest of the shrubs were to go in an existing bed at the front of the house.
      5. When my men returned I was told that they had to create six other beds.  This involved cutting sod and adding soils and mulch to the square area.  5' by 4'.  7' by 5'.  16 by 3.5'.  8' by 7'.  8' by 10'.  25' by 4'.
      6. When creating the invoice for the materials and labor I called ***************** and asked if I could add labor for the extra beds.  I explained that he had told me that the two places were going to be all that were needed for the plants.  He said he would ask his wife and get back with me.  A couple days later he called and said no on the additional labor charge.  I said ok.  I said I would send a final invoice and please pay with a check.  He agreed.
      7.   I added the soils and extra dump fee because this material was used in the new beds and the additional dump fee was the result of the collection of the sod and soil removed from the new beds.
      8.   ***************** called back a few days later to pay by credit card.  We accepted payment promptly.
      9.   I heard no more until the BBB complaint.
      10.   I've been in business for over 50 yrs working for myself and building a ************** center and nursery.  I employee 35 people.  I believe this is my first complaint.
