On Friday, March 3, 2023 I parked my vehicle at Whiskey & Rhythm. After parking, we walked through the parking lot to the building across the street.After approximately ***** minutes, we were told by the workers at the establishment we were at that they were towing vehicles across the street. I walked across the street to find my truck had been towed. When I asked the gentleman in the parking lot why, I was told that the parking in that lot was for that business only. He told me that his security officer told me this when we parked. First, the "security" officer was in plain clothes when he walked up on us talking and did not say a word to us. When we parked, myself and a 65 year old gentleman walked through the parking lot and across the street. At no time did anyone confront us. The security person said that he yelled "Hey, hey" and we took off running. Neither of us ran at all.Second and most concerning is that there is no sign posted AND/OR visible on this property that states parking is for patrons of that business only. If signs were posted, we would have never parked there. Furthermore, I was told that the business puts a road closed sign in a public street to avoid people parking in front of houses. How that is legal blocking a public street is beyond me.
The issue arises on the towing of a vehicle. According to ******* Code IC 9-22-1-16 Towing vehicle from private property "If after twenty-four (24)hours the person who owns a vehicle believed to be abandoned on private property has not removed the vehicle from the private property, the person who owns or controls the private property on which the vehicle is believed to be abandoned may have the vehicle towed from the private property."
Another law that was not followed was ******* Code IC 9-22-1-0.3. This law requires "Placement of notice tags for abandoned vehicles" After the notice tag, 24 hours later the vehicle may be towed.
Neither of these laws were followed.
