In 2021, I underwent a filling procedure at **** Dental. Unfortunately, they went too deep, leading to the development of an abscess. Upon returning to address the issue, they informed me that I required a root canal. I paid upfront for my portion of the costs as advised. However, in 2024, I received a letter stating they were suing me for additional funds to cover what my insurance did not pay, essentially engaging in illegal balance billing practices for a procedure I wouldnt have needed if it not for their mess up.Business response

Attached are the patient chart, signed treatment plan and EOB from Cigna for #**. Patient was originally seen for filling on #** 8/5/2019. Patient did not come to our office again for #** until 9/7/2021, at which time it was noted in her progress notes that #** was fractured. We took xrays on that day as well and it was proposed for a root canal, build up and crown and a treatment plan was signed and initialed by the patient. She had a root canal on #** on 9/20/2021, a core build up and impression for a crown on 11/4/2021 and a crown delivered on 12/1/2021. The treatment plan that she signed and initialed states "this treatment plan is an estimate only. Insurance coverage is only an estimate based on the information presented. This is not a guarantee of payment but an estimate of the benefits available for the proposed services to be rendered. I understand I am responsible for payment of any amounts not paid by insurance, up to the full fee (indicated in the *** column above) for treatment rendered. We sent almost 2 years of statements to try and collect the balance not covered by insurance. We feel that was plenty of time for the patient to contact us regarding her balance before sending it to our attorney.Business response

I forgot to include that the Explanation of Benefits from Cigna stated that they downgraded payment for her crown based on the provisions of her policy, which is highlighted on the ****
