We contacted Elite Property Renovations & Repair, LLC for a quote to remodel our garage. **** (the owner) came out to our property, then came back with a quote. After talking to him several times and being assured there would be no problem getting a permit from Greenwood we paid a deposit and scheduled a start date for our project of Monday February 28th. On Thursday February 24th, we received an email stating we had to have a structural engineer come out and check the thickness of our slab before moving forward. The structural engineer determined our slab was not think enough for our potential project. To make the necessary changes we would need to spend another $5,000-$10,000 on top of the agreed upon project cost. We came to an agreement to change our project plans to avoid going way over our budget. Our newest agreed upon project layout was about 1/3 of the original work. We received a quote for over 2/3 the original cost. When we questioned **** about the price of this newest quote he sent an email apologizing but he did not feel like his company was the right fit for our project and would be returning our deposit minus the cost accrued. After 2 weeks of waiting we contacted **** asking when to expect the check. He replied he did not have to refund anything and sent us a final invoice for the exact amount of our deposit. We feel it is fair to pay for the engineer fee of $449.50 (as long as a receipt is provided), one estimate fee of $125, and office labor of $1,000 even though he breeched our agreement.Business response

This client's review is misleading and not an accurate representation of the specific details of this proposed project. Client provided financial commitment to a binding contract with a detailed scope of work. A structural engineers report found foundation modifications would be required to meet IRC, Local and state building codes. Client failed to provide financial commitment to make those required foundations modification to meet IRC, Local and State building code. Client also failed to provide a licensed foundation contractor to preform those modifications on client's behalf. By doing so client refused to proceed forward with the scope of work outlined in the signed contract. Therefor is considered in breach of contract which warrants grounds for contract termination. Breach of contract occurs when one party in a binding agreement fails to deliver according to the terms of the agreement. Client was then presented with revised proposal that contained a scope of work detail that did not require existing foundations modifications. Client refused to move forward with that proposal as well. Client refused to allow the competition of the signed contract as outlined per terms and refused financial commitment to any additional options to move forward with this project. As a result client agreed to receive a detailed invoice for services rendered to that point on the project.Customer response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
We were mislead by the contractor before we paid a deposit. We were assured we would not have an issue with getting a permit for our original plan.After we were told the cost would be almost double the original estimate we decided to try scaling down the scope of work. **** came back with an unreasonable estimate and when I tried to question the amount he said his company would not be the right fit and he would return my deposit as stated in the email I attached to original complaint. The final invoice was obviously just made up numbers to take up my entire deposit. I expect $3575 out of my $5149.50 deposit to be returned.
