****** Borkholder is the owner of his building supply company in ******** and a co-owner of Hometowne LLC, a small development LLC in **********. He supplies building materials as they develop the *** (a neighborhood in **********). We all agree that my payment of $1800, made in Spring, 2021, would go 1/2 to design services which I utilized and 1/2 toward building materials for the house. However, Borkholder and the co-owner ***************** stopped the project 3 weeks ago at the 11th hour. Now, he is refusing to refund part of the $1800 even though he was involved in causing the project to be aborted, as co-owner of the lot and the development LLC. He says that the building could be built anywhere. However, it was designed for the specific lot at 715 ********** over 6 months, given its particular characteristics. It can not be built "anywhere". Check was to Borkholder Building Supply, so I suppose the complaint is there.
However, Borkholder was acting as co-owner of Hometowne. Hometowne is the entity that stopped the building project. He appears to be hiding from this and claiming that he is just the building supply person and had nothing to do with stopping my project.
I would be fine with a partial refund of $900 OR him selling me materials and using the $900 for the sale.

Thanks for your email. Here is the latest exchange between ****** B and myself.
I got involved with ****** and *****************, co-owners of ********* LLC in March. They were eager to have me build a new home on one of their lots. I settled on 715/711 ********** Ave. in So. Bend and shared emails and drawings of the house as it was designed over 6 months. They seemed thrilled with the plans. Once the contract was to be signed, I was to take ownership of the lots (they insisted on that order). They pulled the plug on the project saying the design wasnt right for the neighborhood. Then, they said that they didnt want a garage aon the lot. When I offered to change the garage into a carriage house, they refused to sell the lot and offered me a less desirable lot. When I complained, they cut off all dealings.
My mistake for not having it in writing.
I had given *************** $1800 for drawings (which I have and they are beautiful) with $900 to go toward materials. It was all smiles and handshakes. I felt great until they dropped the project. Now, ****** insists on the letter of our agreement that the $900 go toward window and door systems only.
I suggested that, given that he stopped the deal, I be allowed to purchase materials of my choice from his company. He refuses that, too.
I believe that he is being unfriendly in his dealings with me as is ********* LLC.
So, I think my choices are : small claims court which is not worth my time (traveling to his county, etc?), doing nothing, or making a BBB complain with a Yelp review of my experience.

As is often the case, only a small, select portion of the information was sent to BBB. Hometowne Property's initial agreement with ***** was with a lot on *** street, which was when his initial designs were started with the Borkholder Buildings architectural ***** so it is not true that this design is lot specific and cannot be built on quite a few city lots that will accommodate a 24' x 52' footprint. ***** later inquired whether he could switch to the lot on ********** St. After the design changed to where it would not work with city ordinances on the ********** lot, ***** was given the opportunity to switch back to the *** lot and proceed with the build. He was given a deadline to sign the agreement with the realtor that was representing Hometowne. ***** did not exercise that option, which then expired. As you can see there is another side to this conversation and many more details that could be added to reinforce these facts.Customer response

I am just seeing this now.
Borkholder (and his colleague *****************) is the one who closed the option of building on both the ********** and *** street lots. I have their email closing it down. I looked for another lot closeby and found there was nothing suitable after they ended our dealings on both ********** and *** streets.
I am requesting an apology and a refund of $900. They will refuse and nothing I can do about it I suppose. But, I do think they need to change their agreement with consumers who put down a deposit to state what happens if they close down the deal. And, I believe that future folks in my position might be warned.
