      Ragle Inc. is repaving Service Road ******* ** in ******, TX. We have a building that is for rent on that road. For about 5 months they were using our parking lot and storing multiple heavy vehicles and machinery without my knowledge. They did not use any other parking lots on that road way. When I came to ******, I asked the supervisor to remove all the heavy machinery and semitrucks on the lot. The supervisor did not remove the semitrucks and heavy machinery for another 2 days, so I went to their office and talked with the manager. The manager removed the vehicles the next day. The heavy machinery and semitrucks caused much damage to the parking lot and they left asphalt debris all over the parking lot, as well as trash from their crew. I emailed pictures to the manager, who did not acknowledge the damage done, but just stated that "they were still working and will try to clean up the lot when they are done." I estimate at least another 6 weeks before they are done. I have tried to text the manager about the situation and how I am trying to rent out the location, but he does not respond. I have multiple pictures that I can email, but cannot upload here because of the size limits.

      The following are unanswered complaints that I sent to Ragle more than 3 weeks ago. As part of the Newburgh Sewer Departments construction project, Ragle is responsible for insuring my easement rights are not violated. 1. Ragle violated my easement agreement by installing a manhole in my yard. My easement clearly states “no ground level structures” This statement is also clearly shown on the project’s engineering drawings. Even the town’s attorney said this is a violation. 2. In spite of my complaints the manhole has remained in my yard. For 2 months they left it uncovered and pumped raw sewage into it. At times it was left open and unguarded. 3. After being in violation for 4 months they put some dirt over the manhole to claim it is no-longer a violation. The manhole never should have been placed there in the first place. And now, my yard will be repeatedly dug up to access it. 4. Also, they refuse to answer how a buried manhole does not violate Newburgh’s construction standard 5.02 D 1 a. 5. The temporary fence has been pushed off of the construction easement and into my yard. This is another violation of my easement agreement Ragle is required to reinstall my fence: 1. My original fence posts were set in concrete. The replacement posts are not. 2. Four of the posts are so badly spaced that 2x4s were attached to their sides. Even with this unsightly and substandard repair, some of the fence panels barely overlap the 2x4 post extensions. 3. At least one rail has no overlap and no attachment screws. In other places screws are already broken. 4. One rail has a board splicing it together. Ragle is also required to restore my yard: 1. After storing gravel in my yard, Ragle chose to till the remaining gravel into my topsoil rather than properly remove it. 2. (This is a new issue). My yard now floods due to improper grading. There are many more complaints but I am out of space. I can provide photos and documents for all of these statements.
