This accounting firm was hired to file business taxes for my new business for 2020 and 2021. They filed, but the submissions were never accepted because the s corp election form was never processed. No follow up happened to check to make sure my taxes were accepted. As of now, 2020 and 2021 taxes have not been accepted for my business and need to be redone and refiled as a c corp because it's now too late for s corp election for those years. I have requested that the accounting firm redo my taxes at no additional charge for c corp, since I already paid for taxes to be prepared and filed and they were never completed. They were responsive to my emails until I asked for the c corp returns to be generated. I also have had to pay thousands of dollars in penalties and interest for ****** business taxes that were missed.Business response

We appreciate you sharing your thoughts here. However, I do want to use this opportunity to clarify a few things.
You said in your review that the submissions were never accepted because the s-corp election from was never processed. The story behind that is that we did file the election and the form it is sitting with the *** in your submission and e-file for 2020. 2021 was rejected and we asked you to paper file and provided you with all paperwork needed to submit for the late election.You said in your review that no follow up happened to check to make sure my taxes were accepted. This is incorrect as we provided you with the 2020 e-file acceptance submission. 2021 we provide you with a paper return and you would have the return signature for certified or priority mail. We state this to all of our clients that anytime you are mailing information to the *** or any other government agency you need to provide a certified or priority mail.
You said in your review that your business taxes need to be redone and refiled as a C-corp because it's now too late for S-corp election for those years. This is incorrect as emailed earlier today we stated that you still can be an S-election due to the three year limitation and we would provide you with all documentation and letter at no charge.
You also mentioned that we were unresponsive to your emails. We are closed on Fridays and did take one week off for vacation. We did respond to your email today, which I understand is later than our normal response time. An automatic response email should have went to you to let you know that I was out of the office. If you did not get that, I apologize.

I am rejecting this response because:
This response was also sent directly to the accountant, since they did reply to my original email. I would like it to be on file with BBB, so I'm sending it here, too.
I did not get an out of office reply, just fyi. And I have had some emails not be responded to in the past.
I did file for s corp election after the fact. They accepted it for 2023 only. We refiled for 2020 and 2021 with the specific language they required on the letter I got saying 2023 was accepted, and they denied it because they had already accepted 2023. My new firm said that the next steps would be either to refile as c corp for those years or get an attorney to work with the *** to get me switched to s corp. So, we already sent in the letter you said could be sent in and it was denied.
Here is the letter I got saying they accepted 2023. I have been advised that the quickest and easiest way to handle this at this point is to just file as a c corp for 2020 and 2021. I do not want to have to pay an attorney to make the change to s corp for me, and I need to do this now because I only have until September to get this done and we all know the *** is painfully slow.
I do not want to file another s corp election and lose another month. I want to refile as c corp and just be done with this mess.There is too much to risk to wait for the *** again knowing they are likely to deny the request anyway.
I know for a fact they did not file my taxes for 2020 and 2021. The electronic acceptance just means they got it, not that it was processed. I called them when I got the first letter about the s corp stuff, and the lady I talked to could see both of them were received but were not filed/accepted to completion because the s corp designation they were filed with did not match the c corp designation that was on file for my company.
I do not think she was mistaken at all. My new firm also said that the acceptance letter from e filing doesnt mean they finalized and processed and accepted, just that the submission was received.
