      ****, the owner of this company came to my house in May to provide a quote to lay sod. At that time he had no concerns about how the sod would grow and guaranteed us it would take. He took our $2200 laid the sod over our existing grass gave us watering instructions, which we followed to a tee. Never saw **** again. My wife and I ******** messaged him, texted him, called him and left voicemails telling him the sod is thinning and then dying and even provided pictures. He kept promising to come back out but we never saw **** again. Now come spring our yard is barren, worse then before we got sod. We have sod netting everywhere which is a trip hazard.

      I would like to provide additional information regarding the business owner in question.  Despite him ceasing all contact with us last year without resolving our issues he took the opportunity to initiate contact again after I left a negative review on Bizapedia based on the facts.  He took this opportunity to repeatedly email me today with constant threats of legal action based on my review.  This business did not have a BBB profile until recently so I was not able to file a complaint earlier.  Since we are unable to come to an amicable solution I am asking the BBB to assist.  **************** took my BBB complaint as an additional opportunity to threaten me with legal action and also makes the claim that the BBB is not taking this complaint seriously and has already decided on his behalf.  I trust this is not the case.

      Sod was installed per scope of work. Existing grass and weeds were sprayed with a non residual based herbicide. 
      customer was given watering instructions as well as strict warranty guidelines. Sod was checked in twice after 3 weeks it was determined the Sod had fully rooted and at that point per Warranty the guarantee expires once Sod roots to existing ground. Customer notified company of issues their statement was the sod was shrinking they were advised to water due to the only reason Sod shrinks is due to lack of watering or soil is absorbing water and to water in short increments so to not fully soak Sod so it wont ***** to sub soil. The company owner and sales rep looked at yard and determined yard was neglected by customer for lack of watering. Customer did not follow warranty guidelines in which voiding the warranty. Company even offered to seed into the yard but customer declined and said he wanted a full refund. Company advised him of the warranty was void due to neglect on homeowners part. Several other Sod projects were completed in the area , 3 projects exactly ************** and those Sod projects turned out amazing as the customers followed watering instructions. Company fulfilled the scope of work as indicated.

      **** nor his company came to our house after the initial laying of the sod. First, I have a motion sensor camera in my driveway.  Second, my wife works from home and can confirm no one ever returned to our yard or property. **** promised to come on multiple occasions and agreed that our yard was still under warranty at time of communication and was provided pictures all of which is reflected in the attached communications. The attached communication does not reflect the multiple phone calls and voicemails where we tried to communicate our issues to **** shortly after the sod was laid. **** came to our house to quote the job and talked to my wife and I and assured us sod would grow without issue. Due to my wife working from home we followed all his watering instructions religiously.  I provided the BBB with the only paperwork **** provided us which was a quote. Neither my wife or I remember signing a warranty or scope of work document. If **** has such a signed document I would ask him to produce it for consideration so we can use it as a basis for discussion. However, regardless the communication record I am attaching shows **** agreed sod was still under warranty at time of issue and promised to rectify it, which he never did and eventually he ceased all communication with us.  He never offered to overseed or seed our yard at time of concern. Our sod now is completely dead and our yard is a trip hazard due to the netting left from the sod. I can seed the yard now, that is not the work **** was paid to do nor is it commiserate with having sod professionally laid.  I also never used a herbicide or pesticide on the lawn. I am happy to provide more communications and pictures of the current state of my yard at BBB request.  I cannot share all due to limitations you have on attaching files.

      Attached is the complete and unedited ******** messenger and text communication in chronological order between ********************* and my wife.  Again this does not account for the multiple calls and voicemails left after these that he did not respond to.  Again, **** or no one from Green Envy Landscapes ever showed up to our property after installation of the sod and absolutely nothing he promised was actually completed despite clearly acknowledging in these messages that the work was still under warranty at the time.

      The companies position has not changed. Customer Voided warranty by not following watering instructions. Company completed the project within the scope of the work customer has waited over nine months to bring up these issues after customer was *********** was a mute issue that the sod had already taken root and that the installation warranty was fulfilled in the warranty paperwork that was given to the customer it is strictly outlined that homeowner neglect example not watering fertilizing or spraying any kind of herbicide will void the warranty the sod was perfectly fine at installation and it took route which in the warranty agreement fulfills the installation warranty that is all the warranty covers is up to the newly installed sod taking root.

      Customer's position has not changed.  Customer was never provided a warranty or scope of work, if company has said signed warranty or scope of work customer would like it provided so it can be reviewed as a basis for this complaint.  Customer or wife has absolutely no memory of signing any warranty or scope of work but if it exists as company claims then it is not unreasonable for company to provide it so it can be reviewed.  Customer has provided ample documentation to back up customer's position while the company has provided nothing.  As previously stated customer could not file complaint through ******************** earlier due to company not having a profile until February of this year.  However, as clearly shown in provided text and ******** messenger communications the customer and wife clearly stated and demonstrated with photos their concerns multiple times to company while sod was still under warranty and as shown company clearly failed to remedy those concerns.  Company has no basis or evidence to continue to claim issue was insufficient watering, fertilizer use, herbicide use (again never used), or soil issues and cannot provide any documentation or proof any of these were the actual issue and instead continues to make more and more baseless and unsubstantial claims.  

      Customer asks are as follows:

      Signed warranty and/or scope of work is provided by company.
      Company provide invoice for the sod they purchased for customer's project including what type of sod was used.
      Proof company provided the onsite follow up services they claim that are clearly refuted by the communications customer has provided.

      These will allow customer and company to have a factual and substantive conversation to resolve customer's complaint.

      I have paid $1187.50 that was 25 percent of total amount as a deposit for landscaping project for my backyard on 03/02/2023. I was initially told that it will be completed in 2-3 weeks depending on weather. Company kept on delaying the project and never started. Every time I was texting and emailing and was always told that it will be done next week and there was no follow up done by the company. I had to reach out to them every time they had scheduled a day and they will be NC/NS. I had taken day and time off from work when they had committed to come but will never show up or answer Text till late evening.2 weeks ago i gave them another chance to come and complete the project they scheduled the date range from May 23 to may 25 .No one showed up again. I had texted **** who is the owner and he confirmed it will be done between these dates. I took day off from work again and i texted him on May 25 to confirm if he coming today and didnt get any response. I have attached copies of all the text and emails that i have been communicating. At this point company has lost trust and will like to get a full refund. At one point i was told that they will charge me the restocking fees if i break a contract. On text message you will notice that material was never ordered as that was what the excuse, he was making that SOD was not available. I have uploaded all the documents and emails for review. I would like to get full refund on my deposit as work was never started and the way i have delayed due to comany's negligence.

      Company was paid $2500.00 in cash on 4/19/23 to seed back yard located at *************************************************************. Signed agreement was for full warranty up to germination. As of 5/24/23, germination has not taken place (seed and straw blown away due to improper installation of straw rolls). Since 4/21/23, provider committed to returning to repair and re-seed. Provider has missed multiple appointments in last 30 days (most recently 5/18/23) to come and complete the work. Currently, provider refuses to take our calls or respond to voicemail messages, emails for text messages.

      Customer was given strict watering instructions to keep warranty intact and to ensure grass seed would germinate. Customer did final walk thru before taking payment and agreed job was completed to scope of work as outlined in signed agreement. Customer made a warranty claim for no germination. It was determined by owner and seed sales rep that customer did not water the installed area as directed in the strict watering instructions therefore it was determined customer voided warranty by negligence on their part for not watering in the guidelines as outlined at final walk thru. 

      Customer was afforded all possible remedies up to a very large discounted price to reseed yard and the seed would of been drilled at that point. 

      Company feels that the issue was handled with company policy.
