I am retiring from the Army (on terminal leave) and moved to ******* to attend graduate school while my wife works as a teacher. We backed out (July 17, 2023) of buying a new construction purchase agreement (signed June 21, 2023), forfeiting our ******* money ($5,000), to buy another home that fit our needs perfectly. Now Irish Realty has communicated on behalf of Irish Custom Homes' "intent is to seek specific performance and the full extent of his rights under the contract. He is referring the matter to counsel today and [I] will be receiving communication via his attorney. If [I am] willing to close on the home, the seller would entertain extending the current expired contract to avoid expense and inconvenience." This sounds like intimidation.Business response

*****, thank you for your service in the Army. I apologize that you received the communication passed through *********************************** of *********************** to you as intimidation but that was not the intent. ***** should have informed you that the ******* money is a good faith deposit toward your faithful performance of the contract but is not a sufficient or contractual remedy for breaking the contract. You did enter into a purchase agreement with Irish Rentals LLC for the purchase of the new construction home and your exiting of it is a default under the terms of the contract that you mutually agreed to. Your offer of forfeiting the ******* money is not likely to meet the seller's expected costs/damages incurred by your default and the seller's great preference is that you would honor the contract and purchase the home as agreed. If there is another home that you feel meets your needs better then you are of course welcome to purchase it and sell the home in question or keep it as an investment property. If you'd like to meet to discuss the purchase of the home or would like to better understand the extent of the seller's likely true costs or damages that exceed your $5,000 proposed remedy, we would welcome a meeting to discuss. ********************* Irish Realty ************ (cell)Customer response
