Date of the transaction: 01 FEBRUARY 2022 (see Original Purchase receipt)Amount of money paid to the business: $1,347.09 (see Original Purchase receipt)What the business committed to provide: ****** ******* ******** Ti Founders Edition 8GB GDDR6 PCI Express 4.0 Graphics Card (see Original Purchase receipt)What the nature of the dispute is: Refund via ****** Vendor/Seller.Item was returned within the 30 day window to the seller. The seller refunded the amount of $724.59. (see Original Refund amount) This is approximately 53% of the price paid for the item.I am disputing this refund and requesting the FULL REFUND AMOUNT, which leaves $622.50 left for the seller to refund back to my account.The seller, *********************, OutoftheBoxPalace LLC, (Business ID: **************** does not have a return policy listed on his storefront. This indicates that he defaulted to ******s restocking policy. (see ****** Restocking Fee policy)****** states that the restocking fee can be up to 50% of the original purchase amount if the seller receives the item damaged or materially different than how it was originally shipped to the buyer. I affirm that the item was returned in its original condition, unopened, and in its original packaging. I reached out directly to the seller via ******s communication channel and the seller has not responded. The seller has not gotten back to my correpondence. I have reached out to ****** Customer Support on multiple occassions to file a dispute against the seller, *********************; Although they confirmed an AtoZ claim initiation, ****** has not elevated an A-to-Z claim on multiple attempts beyond **** days, for reasons unknown. (see Unresolved ****** A-to-Z claim communication)I reached out to customer service yesterday, *******, and today 08APR22 and ****** has not facilitated any assistance, citing that I need to pursue other outside claims options for this case.******.com order number: *******************Business response

They stated ****** states that the restocking fee can be up to 50% of the original purchase amount if the seller receives the item damaged or materially different than how it was originally shipped to the buyer. This counts if the package was opened or if the item inside was damaged, the outside of the gpu box had dents on it, which counts as damage. I talked to ****** about this and they said you can file a A-Z other than that there is nothing I can do about it. They also stated, does not have a return policy listed on his storefront, I asked ****** about this and they said it doesn't matter if I don't have anything listed on the storefront.Customer response

I have received the following communication from the seller and am forwarding it to you now.
I have not responded to the seller.
If the seller is truthfully stating his claim about the outside of the *** box having dents on it, then my counterargument is that the outside of the *** box was damaged in shipment via handling through the last mile delivery fulfillment service provider (i.e. ****** ************************ or whoever else transported the package). Additionally, the seller has provided no evidence for his claims.
Moreover, I reiterate that I shipped the item unused, unopened, and in its original condition back to the vendor. I was wrongfully charged the refund amount stated previously in the case. I seek a full refund.
I'd like to add another item to add to the context. Please reference the attachment.
In this context, I believe the seller (*********************) is consulting with a colleague who ordered the item using my debit card. I was not aware of this conversation that my friend had with the seller until I inquired today.
The seller claims that "the seal was opened when it arrived" back to him, but he also stated in a later in the previously forwarded email that the "box had dents on it."
I posit that this seller is completely fabricating his story and justification, by making up incongruent details about the return (without any concrete evidence), in an attempt to unlawfully leverage ******'s blanket restocking policy (while not providing his own), in order to gain an abnormally high and unjustified restocking fee.
I seek a full refund.
