  Failure to complete contracted work. I signed a contract with SilverCreek ******************* in January 2022 for a 3 season Sunroom. Building permit issued in June 2022. Construction to be completed within 45 days per contract. The Sunroom still does not have siding, all windows have not been installed, no ****************** or drywall.

  As we discussed, please find our response to the complaint filed by ****************************

  First, I think you need to know that we are continuing to do work on the Three Seasons Room and did the siding right before Thanksgiving. Also, the estimated completion date is work days and not actual days and is subject to numerous delays such as permits, weather, availability of material, etc. 

  We will get the project done on budget and it will be done in the next 2 weeks.

  ***************** has had the permit to build my 3 season sunroom  since July 2022. It is now November 30, 2022. He has still not completed the work. The sunroom still needs interior drywall on the walls and ceiling, the floor covering hasn't been laid, 2 windows  and 1 door still need installing. I texted him Nov. 30 and asked when this will be done he said Thursday. The reason I am rejecting his response is because I cannot trust what he tells. He told me months ago the windows are here and will be installed. After about 2 weeks his crew installed 4 of the 7 windows. When I asked when the last 3 would be installed, he said I have them in my car and will bring them to your house. The crew came and installed 1 window and said **** has the remaining 2 windows. The windows still have not been installed. I can't depend on what he tells me he has lied so many times. They did install the exterior siding only after I filed my complaint to BBB. 45 calenar days is what the contract says after receiving the permit. It has been 4 months since the permit was granted.

  I have received the response you sent from ***************************** and here is my response. 

   

  1) The drywall and insulation are currently being worked on and the floor will not be laid until after the painting is complete. 

  2) I have always been honest with the Customer, telling her what I know at the time. As with everything in this business, especially right now with the labor and material shortage, things change daily. 

  3) The exterior siding was scheduled to be installed prior to any complaint she filed. We had to schedule them approx 2 weeks prior to the install date as their calendar is busy like everyones. In fact, after calling 5 other companies they were the only ones that I could get to install the siding in a decent amount of time. 

  4) The contract language states "Depending on the availability of material and fixtures and barring unreasonable interference in completion of the work, such as inclement weather, the Contractor represents the construction within 45 work days. (The parties acknowledge that ******* currently suffers from certain restrictions as a result of Covid-19; however, such restrictions may delay Contractor's to timely complete work)".  it clearly does not state 45 calendar days.
