*****, was referred to Kaden ***** at David ***** & Associates by *************************. ***** is disabled; he never consulted with Kaden face-to-face. ***** spoke with Kaden on the phone and later following Kaden's lack of professional courtesy; ***** became wary of identity theft. Kaden's last name may or may not be *****, he is hereby addressed as Kaden. Briefly, Kaden is holding *****'s government documents without *****'s consent. ***** had/has no signed agreement with Kaden for tax services. After speaking with Kaden on the phone in August of 2021; Kaden expressed willingness during that first call with ***** to help refund *****'s federal withheld taxes from 2016 by reason of *****'s disability. ***** made clear to Kaden during that phone call that the refund would be from the 2016 withheld tax, and Kaden advised ***** to mail his tax and disability documents to his office, and provided ***** with this address at **************************************

When ***** called Kaden's office on August 31st to find out if Kaden made any progress with the document, Kaden had an unpleasant tone; he stated that he received the documents from ***** and that the statute limitation to refund the withheld tax from 2016 had passed, then he asked ***** if he had a lawyer, and ***** stated NO. This made no sense; had ***** had a lawyer; he would not be in contact with Kaden. Kaden did not say if he was going to mail *****'s documents back as he should in a normal course of actions, so ***** made a request by phone with the lady at Kaden's office the next day on Sept 1, 2021 to have his documents mailed back to him. ***** received nothing so he called the office again on Sept 5th, and Sept 7th of 2021 to have back his documents which include copies of *****'s 1040 tax return and W-2 for the year of 2016, *****'s Social Security disability document, and a copy of another attorney's document. ***** always used the word PLEASE when he left messages asking for his documents.
September 7th, 2021, Kaden got on the phone and did not answer ***** if he received *****'s messages, but he stated that he would mail the documents back that day, then suddenly hung up the phone on *****. ***** still has not received his documents as of September 13, 2021. *****'s address was on the letters he mailed to Kaden. ***** also provided his address 2 times on the recorder in the general voicemail box at Kaden's office on September 5, 2021. Tax lawyers are not be this busy! Kaden's disregard to send the documents back placed himself under an umbrella of suspicion. The law office name is DAVE ADAMS AND ASSOCIATES. Nearly a week ago, the recorded message after hours at that office listed a directory of 4 different associates. However, the directory was changed two days ago; it was shorted out on the recorder to one (1) associate named Matt who sounded young and had a soft voice on the recorder.

As stated above, ***** is disabled; he had no income for the last 5 years. Kaden obviously reserved professional courtesy for some, and then declined service to a disabled person. The subject withheld tax can be refunded by reason of disability and lack of income. Kaden's handling of this issue threatens the rights of the disenfranchised, and regarding the issue of returning documents, ***** expressed willingness to drive to Andover Kansas to pick up his documents if they cannot be mailed out. ***** has no signed agreement for tax services to leave such documents with Kaden and associates who appear to go by one last name (*****) at that office.
