We purchased a used 2019 Ford Fusion from Victory Chevy of Garnett. The experience was great working with manager **. This dealer is approx 1 hour from our home. We worked the deal over the phone, I asked what specifically was found on inspection and ** noted tires and brakes were replaced and the vehicle was in working order. We test drove the vehicle and noticed a hard shift but assumed since the dealer said everything was in working order the computer may need to get used to a new driver. Within 60 days, the issue became much worse and we noticed a hard grinding noise from the rear of this all wheel drive vehicle. We took it in to our local Victory Ford dealer in Kansas City, KS who diagnosed the issue requiring a full rear differential replacement, valued at $4,000. I contacted Victory Chevy of Garnett and was told at first the warranty was 30 days at 25% and we were now roughly 60 days post purchase. I contended this issue existed prior to purchasing the vehicle and warranties are for unforseen issues. ** at Victory Chevy wrote up a case and was told by the Service dept had I contacted them sooner they would have been able to do maintenance. My contention is Victory Chevy was or should have been on notice of the issue as all it took was driving it for less than 500 feet to feel the shift problem. Victory Chevy are experts in their field while I am simply a consumer. My further contention is even if I reported within the initial 30 day warranty period, this isn't a warranty problem and is a miss on Victory Chevy's part. The purchase inherently implies a reasonable expectation of reliability and functionality for a reasonable period of time. This issue is substantial and responsibility rests with the experts at Victory Chevy. The vehicle continues to sit at a shop and we are held hostage as we don't want to authorize repairs until we know we will not be a majority responsible for repair costs.Customer response
