      I moved into **** **** ****** in Kansas City the middle of September 2021. At that time, a Prieb employee ********** was there to do a quick walkthrough. He said "we want you to make this place your home. You can put things on the wall, all we ask if that you leave the nails or screws there so we know where to patch." I asked if I was able to mount TV's and he said yes. I confirmed this in an email to Ashley as I was moving out the end of September this year and she said yes, just keep the nails and screws in the wall. I have attached emails and have several photos of the interior of the house proving the condition the house was in. Prieb is trying to keep my $850 deposit and charge another $1,343.72. I asked them prior to getting the statement when I would receive it because I showed that balance on my account, and they asked me to wait to receive the letter to dispute it. I disputed most of the charges, was not responded to, waited a week to follow-up and still have not received a response. I have attached email threads to this complaint, and later this evening will start attaching photos. They have not provided any photo proof of the need for the "repairs" they did. I am having nightmares nearly every night about this. I truly think their list of charges are for the incorrect house. It was only my 17 year old son and I living in the house, with 2 miniature Australian shepherds, one which passed early April this year. We kept the house and yard immaculate.

      To clarify, once a dispute is received the entire tenant file is reviewed. This takes time so an immediate response is not achievable. All disputes are processed in the order they are received.

      After review of your file, it was noted that the cleaning charge was inaccurate. The cleaning company only charged $250.00. A $60.00 adjustment has been applied to your account. ($50.00 cleaning fee + $10.00 administrative fee has been deducted). All the baseboards were dirty, along with the stovetop underside, oven, freezer, cabinets, etc. Items were left behind on shelves and in drawers. This home was not left in move in ready condition for the next resident as required by the lease agreement.

      We do encourage our residents to make the property feel like home; we allow for small picture hanging nails and command strips. Anything larger nails or screws will result in charges. Any damages caused by command strips will also result in charges. This is outlined in the lease. Due to the numerous gauges, large screw holes and other damage to the walls a full paint was needed to make the home ready for the next resident. The amount charged was prorated as required by law.

      When you signed the lease, you accepted responsibility to take care of the property. Failure to do so is considered tenant negligence. This negligence subjects you to charges to correct the damages.
      Missing door hinge reported in photos taken at move out. This hinge was not found anywhere in the house and had to be purchased and replaced.
      Stained toilet seat was not for a small pink spot you spoke of but for 2 large yellow spots.
      Broken doorstop reported in photos taken at move out.
      Broken splash block is located outside and directs water from downspout away from foundation. This was found in 2 pieces at move out.
      Rusted floor vent was not reported on move in report as indicated.

      Deposit accounting is not taken lightly as it is our intention to return deposits, as much as possible to vacating residents.

      I have saved some pictures to a word doc since this site will not allow jpg images as indicted.

      Since you did not allow the 30 days response time requested per our security deposit disbursement letter and choose this route for your dispute, no communication directly with you will be allowed. 

      These pictures show the damages you were charged for at move out. The scratched cabinets, stained toilet seat, etc. Upon further review of your account, it was noticed that the paint charge was calculated in error. This had resulted in a credit of $379.92 and an credit to the administrative fee of $75.98. Your balance now due is $827.82.

      Hello, 

      We are directly communication through this platform.  I was offering to help you with the pictures you stated you had.  Also, I did give you 30 days, however, I began my dispute as instructed via email when I saw my balance on  the Rent app, and was asked to wait until I received the statement in the mail to dispute the charges (I have that email in the attachments from a previous reply).  The invoice date was the end of September.  I notified the BBB after 3 emails (one week apart from each other with no response) on November 28th.  That is more than 30 days.

      These pictures do not show me anything except there is not a hinge on a door that we did not remove.  The way the wood is on those cabinets, there are natural indentions.  It's the same in all of your homes.  I also see the couple small holes in a few pictures and 2 minor scuffs.  This again was not necessary to repaint the entire home and you have stated yourself in previous communication on this platform that you do allow small screws and nails.  These are not large or medium by any means.

      I will not be paying the remaining balance.  I am owed minimum $700 back from my $850 security deposit.

      I am in the transition process of retiring from the Army and due to my current mission schedule of Warfighter exercises I will be on temporary duty (out of the Fort Leavenworth area) on and off for a significant amount of time for the remainder of the year before I start terminal leave. Because of these reasons, I am needing to terminate my current lease and relocate. I have thoroughly read my lease and complied with the terms and conditions of the contract with providing the property management team a 60 day written date via their web portal of my notice to vacate. Prieb is not accepting my notice and unilaterally adding further terms and conditions to the contract. The conditions being added are applicable under the term/lease renewal and not indicated under the early termination section. I am providing the email documentation as well as the lease contract in hopes for a resolution.

      This tenants notice has been received and entered into our system when she emailed our office but refused to fill out our official form as requested. I have never experienced an individual who refused to fill out the appropriate form. This form includes additional information which will help with the security deposit distribution upon her move out. This vital information was not submitted in her email.

       

      Our attorney informs us that per Kansas Law, the tenant or landlord can only give notice to the other on the day rent is due. Our rent is due on the  1st of the month so we require notice to be given by the tenant on that day. We feel that is only fair given it is required of us by law as well. She gave notice on the 5th, which means her notice does not officially start unit May 1st and she will be responsible for rent until June 30th or it re-rents, whichever comes first. This is not written in the lease section regarding breaking your leases but there is a section of the lease that does state, the lease is governed by KS Law. It should be noted that her home has already been re-rented to another individual and rent for the entire month of June will not be applicable.
