      Date of the transaction was November 4th 2021 the amount paid to the business was $3,466.12. the nature of the dispute is a billing dispute due to not receiving all the items ordered. the order number was ******* and the 2 items that i did not receive was Pokemon XY12 Evolutions Booster Box and Pokemon XY3 Furious Fists Booster Box. additionally one of the boxes that i had received was damaged as well. Firstly, the order was delivered and signed for but it was not signed for by me nor the apartment complex mail office worker and was not delivered to my complexes leasing office but instead was delivered outside of my complexes main building. I was luckily able to find this but when i opened the box two items where missing. after thoroughly checking the box i immediately contacted the company to which i did not get any responds until Monday morning when i had emailed them Sunday. i simply believed that the company had shipped the other 2 items separately due to them being worth more. When i had spoken to a representative he told me that there was no way and to send him pictures of the original packing. i informed him that i would attempt to retrieve the original packing from the trash but was unable to and from this point the representative that i spoke to on the phone told me that i was lying and that there was nothing they can do because they know they sent these items out. i continued to try and work with this representative through text messages to where he kept implying that i was lying to which i got fed up with and attempted to file a billing dispute with my financial institution and they file a billing dispute in the amount of $2,229.97 for both the items missing and the damaged item as well. after their investigation they informed me that they could no rule in my favor and i would have to attempt to reach out to the attorney general or Better business bureau.

      Customer's package was confirmed to be the correct weight to contain all 9 boxes they ordered. Customer claims to have not fully checked their package and thrown away 2 boxes which would weigh approx 4 lbs. After customer admitted they may have thrown away the boxes they filed a chargeback and did not make considerable effort to recover their product. Our shipping software confirms we packaged and shipped the items correctly and we believe the complainant is a scammer.

      I am rejecting this response because:

      The business is blatantly lying about what I said. They state that I did not fully check the package and as I stated in my initial complain I did in fact thoroughly check the package. Furthermore, at no point did I "admit" to the possibility of throwing away the missing boxes. They also state that I not make considerable effort to recover the package which once again is a lie and their are several witnesses that seen me and attempted to help me search the trash. If any of what they say that I said is true why is their no recording of the conversation over the phone that was made? The continuous lies from the company and defamation of character that this company displays should be proof alone in showing how unprofessional and unwilling to help in any means possible.

      Hello *****, 
      No one called you a liar, but we are confident that all 9 boxes that we shipped were in the package that you received as 3 different employees of ours were involved in pulling, checking and shipping your order. Assuming you are being truthful, the only possibility that exists is that you accidentally threw away the 2 boxes which is not our fault. That would be on you, your loss and your responsibility to retrieve them from the trash. You claim that you received only 7 of the 9 boxes (2 boxes short) but your claim of $2,229.97 with the credit card company was for 3 boxes. THIS IS THEFT. You said the credit card company said you could claim 3 boxes missing (an additional $329.99) but you knew better, yet you still claimed 3 boxes worth of money with the credit card company. Again, this is against the law and theft. And remember, you said that you opened the 7 boxes that you received and that the damage to one of the boxes was minor so everything was OK with that box when you opened it. So why try to claim the additional $329.99? You cannot claim that money for something you opened up and decided to keep. Again, that is theft. This alone speaks volume.

      Lastly to confirm, you did indeed mention on the phone that you might have mistaken the packing materials so again that makes the only possibility that you threw away the 2 "missing" boxes by mistake, thinking that since they were inside cardboard boxes, that those cardboard boxes were packing materials. This is why we tried to get you to act as quickly to retrieve them out of the trash, since your trash had not been picked up yet. Although you said you contacted the maintenance employee, you also said that there were bees so you could not retrieve nor look through the trash because of it. Instead of asking the trash company or the maintenance guy retrieve the items you threw away, you decided to take the easy route and just call your credit card company. You didn't take any real action to retrieve the boxes out of the trash. We would recommend in the future, wherever you decide to order anything online, to keep everything that you receive and not throw anything away. That would include the outer package, packing materials, and contents. If you had done this, we are confident that the 2 boxes you said were missing, would have been there. Regardless, we have already had to deal with ******/the credit card company for this situation. We sent you everything that you ordered so we cannot do anything for you. Please note that we won't be able to accept any future orders from you.

      I am rejecting this response because:

      Throughout this whole process you have implied that I am a liar and I quote you from your last response by calling me a "scammer" and now calling me a thief. If I were in fact any of these why would I go to such great lengths to get a refund. You continue to say that the only possibility is that I accidentally threw away the 2 boxes when it could have been tampered with during delivery which has happened before but you simply refused to even say that is a possibility when the package was supposed to be signed for by me but was not, which should alone be seen as a red flag. Furthermore, the reason the 3 box was part of the claim was do to the damage that was not "minor" but actually damaged the box itself and a number of the packs inside the box and I when had told the card company and they added the additional box to the claim when I told them I did not want to add the box they told me they still would anyways since there was damage to the item. 

      Once again your company continues to put words in my mouth that was never said. I never said that I might have mistaken any of the packing material I stated that I did thoroughly look through the box and did not find the 2 additional boxes that you state were in the box and that I would attempt to retrieve the box from the trash. I did say there were bees but I still attempted to the best of my ability to retrieve the box, even with being allergic to bees, from the trash and I asked the cities trash removal to assist me in attempting to retrieve the box and they also could not find the box within the trash so to say "you took the easy way out" is ridiculous when I in contact with you from early morning until about 2 in the afternoon to which you said over the phone "well if you didn't get the box your shit out of luck". Once your employee told me that over the phone that's is when I decided to call my card company and file the claim.
