  ****** ** **** was incredibly pushy for me to sign a lease on a property she was managing. When I asked if the pet deposit/rent would be waived since I have an ESA, she resonded and said “only actual service animals get their fees waived.” This is illegal.

  The tenant was originally informed incorrectly that she would be charged a fee for her animal. Our property we were leasing to her was pet friendly, but our pet policy is limited to certain animals, includes a $250 non-refundable fee, and an additional $25 per month for the animal. The day my office had correspondence with her, they were doing as trained. We had legal counsel that had informed us that we could charge pet fees animals, even if the animals were registered ESA's. Previously, the only instance we would waive fees was for a Service Animal. 

  Regan responded by text on 3/21/24 at 12:47 with an inquiry and link, informing us that we were wrong. We did research and also sought legal counsel to see if our current pet policy, especially considering ESA animals was wrong. We were wrong and promptly responded to ***** at 1:47pm on 3/21/24. She was informed that upon providing the correct documentation for her ESA, that we would happily waive all fees and make all necessary accommodations for her. 

  My office immediately corrected our pet policy and even informed ***** that we were incorrect with what we had originally told her. We attempted to make it right.

  Below, the conversation is quoted, attached is full documentation of all text correspondence with Regan.

  "Hello ******, this is **** with nLee Management. You are correct, we can not charge our pet fees on ESA animals. ******* was correct in her original response, according to how I trained her, and that is my fault, not hers.
  
  After further review of the updated laws, upon your request, we are required to waive all of our fees. I am obligated to inform you that you will be financially responsible for any damages that your ESA animal causes. Including, but not limited to: flooring replacement due to urine and/or feces, cost of repairs for chewing and/or scratching any surfaces inside or outside.
  
  At your convenience, please send me your ESA paperwork and I will happily get those fees taken off your account! If you have any questions, please call me at the office ************* Again, thank you for bringing this to my attention and I apologize for the misunderstanding."
