      As I was out of town I had Benjamin Franklin replace the inlet water line to my house, while all the work there seems fine when I returned a couple months later to find that they had damaged the guttering and facet at my house. They are refusing any liability in the matter, and also refused to give me their liability insurance information to file a claim To their credit they tried to offer me half of what it would cost according to my initial estimates which would be $250, the invoice of repairs is around 700.

      In response to *** ******** concerns.  We have been out to look at the situation.  *** ****** has removed most of the siding from his home and has several things going on in that area of the home.  We repaired his water service in the same area 3 months before he brought his concerns to us.  He claims that we hit his guttering with our excavation equipment.  We dispute this as we do not believe that it is possible that our equipment struck the guttering, and based on all the demolition that is going on in that area, it is very possible that something else struck the guttering.  *** ****** claimed during the initial investigation that the repair of the guttering would be $500.  In good faith, and with no evidence of fault, we did offer to pay half of the cost of the repair.  When offered this settlement, *** ****** raised his estimated cost of repair and began using very foul and abusive language on our recorded phone line.  *** ****** is demanding our insurance information without providing any written estimates on repairing the guttering.  We will not provide any insurance information until we decide one, that we are at fault, and two, that we want to claim it on our insurance, based on estimates.  We have no problem in continuing to work towards a solution with *** ******; however, we will not be verbally abused over this matter either on the phone or in person.

      We would like to wait for the yard to dry out a bit from all of the snow and rain and bring the tractor out to see how the damage lines up with our equipment.

      I am rejecting this response because:

      At the rate this is going I don't know that you're ever going to be able to get a machine back to that place because of the mud hole that's been created... I've been trying the monitor the walls of the basement because part of the reason Gathering was a necessity in the first place was moisture coming through. 

      Trying to do anything behind my house has been a humongous pain and straight up makes it dangerous if I have to be on the ladder in that area, as apparently almost all of the water from the back side of the roof goes into one place. So this sucks

       

      I really was hoping for a solution in a more timely manner.

      My neighbor hired Benjamin Franklin plumbing to replace a sewer line that goes through my property. Neither party is willing to repair damages to concrete and yard. This occurred in July 2022.

Can you be more specific about the damage? I know my operations manager had been out before to look at the job site. Ultimately, your neighbor signed an agreement with us prior to the work being done, that states they are responsible for any such concerns. I am sorry if you have not been able to resolve the issue with your neighbor. If there is anything we can do to help get this resolved, please let us know. Feel free to call our office ************.
