September 9, 2023 Jeep Grand Cherokee L Midnight Sky was at a dealership close to me but we called a Glockner for a better offer. They promised that if we made the 2 1/2 drive to Glockner in Ashland Ky, they would have one there and beat the other offer. We got there at 5pm, no Jeep Grand Cherokee L Midnight Sky on their lot. Kenny, I can get the one you want but it's an hour away. Ok, we looked at pictures, this one had what I wanted. Kenny, we here at Glockner do a lifetime powertrain warranty and we will tint your windows, it will be here Wednesday waiting on you for this price. Even though the Jeep was not in their possession, they asked us for a $500 deposit. We agreed and left at 8pm with a 2 1/2 hour drive back home.Fast forward to Tuesday afternoon, Kenny leaves a voice message on my husband's phone stating they still have not heard back from the dealership with the Jeep but he was still working on it. Wednesday around noon Kenny plays text, phone call, text, phone call multiple times, telling us they can't get the Jeep. We ask three times for our deposit back and three times, I will call you back in 15 minutes with the return of your deposit receipt. When Kenny calls we ask him where the Jeep is located that we agreed to purchase, it was located at B****** ***p in Barnesville, Ohio ( 2 1/2 hours from Ashland Ky) We called B****** ***** ******** **** *** and spoke with Bill, he had told them on Monday that he was not going to do a dealer trade. Monday!!! Around 5:30 pm on Wednesday afternoon Kenny states they have found the exact same Jeep with the same package at a Tennessee dealership. We called Kenny back to let him know we were not going to go with them and we needed our $500 good faith deposit back. Kenny stated that because they have a vehicle in Tennessee, not yet traded for or transported to their dealership, we would not be getting our deposit back.

All of our phone calls and text/emails are recorded. After reviewing recorded communications with the customer, I have found no evidence that they were told that we have the vehicle that they were looking for. We did tell them that we would find the vehicle and have it brought in and took a $500 non-refundable deposit to secure. We had the dealership in OH willing to work with us until the customer called them. Once the customer reached out to that dealership, they quit returning our calls. We then located the exact vehicle in TN and ready to fulfill our commitment to the customer but were told to nevermind. We then offered to apply the $500 non-refundable deposit to another purchase before the end of the month. Approximately 2 12 weeks away.
