      Purchased a used John Deere tractor that had a problem with the brakes and transmission operation. After questioning the salesman and mechanics of the operation before the purchase I was informed by the salesman and 2 of the dealership mechanics that the tractor was operating as normal even though the brakes seemed to be partially engaged. I was told that it was a safety function as to why it would stop on its own and not roll. Upon purchasing from a 5 hour drive from Tennessee to the KY dealership I attempted to use the tractor and found it to be inoperable without further damage to the transmission and brake assemblies. I immediately loaded up the tractor and took it to the John Deere dealership near my hometown and left it for repair. Upon inspection the dealership found the issues and repaired the tractor at a cost of $2670.17 just to get the tractor back to service. There were other problems like a disconnected switch that was blowing fuses if connected and when I finally got the tractor back home it ran about 30 minutes before quitting. I found the fuel filters plugged from lack of maintenance or any service check from the dealership. This dealership is not trustworthy in my opinion as I have spoken with several representatives of their company and have had very little call backs as I was told they would do to discuss the issues I have with the tractor. The false pretense of the brakes stopping the tractor as I was told by their staff was a complete misrepresentation per the John Deere dealership that repaired the tractor.

      On August 8, 2023 *** ****** contacted our Bowling Green store to inquire about a 2013 John Deere 5065E that he had seen listed on an advertising site that was for sale.  *** ****** asked to see more of the tractor.  We sent multiple pictures and a video of the unit in working motion.  On August 11, 2023 *** ****** came to our store to purchase the unit.  He drove the unit at our lot.  He felt the brake may have been engaged and not releasing while in gear. 

      While *** ****** was there with the unit, we had our service technicians to look for the problem.  Our tech’s found nothing out of the ordinary wrong with unit.  Being trained on New Holland and Kubota units, they called our local John Deere dealership and spoke with their technicians concerning the matter.   They informed our service techs and *** ****** via speaker phone that the tractor was a hybrid and the transmission was doing what it was supposed to do.  With the explanation received, *** ****** decided to purchase the unit.  He loaded the unit and transported it home.  The unit was operating as it should have when it left our lot. It is standard business practice that used units are sold “as is”. When we advertise used units, they are listed “as is”.  This implies that the unit does not have a manufactory warranty, nor any type of warranty from the dealership that is selling it.  Upon completion of paperwork for any purchase from our dealership this is explained and a form is signed by all customer’s stating that they understand the policy.

      Not every customer tells the dealership what is exactly wrong with the unit they are trading in.  Without that information, somethings could be overlooked.  We do apologize for any inconveniences that *** ****** has experienced and hope the unit will bring him good service in the future.

      I am rejecting this response because: There were 2 incorrect statements made about the actions on the day of purchase as to the condition of the tractor. (1) The tractor is not a hybrid as per the statement from the John Deere mechanic that was supposedly called and (2) I was not on speaker phone with the mechanics or the JD dealership during any call. The tractor was not operating correctly when I left the lot period and the mechanics are who told me the dealership said it was a hybrid. I did not hear that since I wasn’t on any speakers with the dealership. The tractor had a locked right rear brake assembly and water in the transmission as determined by another John Deere dealership who repaired the tractor. There is no hybrid designation for the tractor transmission per the repairing dealer so that is a misrepresentation by someone. I will settle this and close this case but the Hobdy, Dye & Read folks should do a better job of identifying any known issues and misstatements and representations to customers. Close this case BBB. Thank you
