      I signed a contract with Old Time Masonary 4/3/22 to complete stonework around my deck for a walkway and sitting area. The cost was $6800 and a 50% deposit was required of $3400 dollars. Wade Hall the owner told me that they would like to get it done about a month later but that there was a possibility it could be moved to the following spring depending on weather conditions. I messaged Wade 5/14/22 and he said, "i'll call you later today bud", but I never heard from him. I was not concerned as Wade has done work at my home before and they did a good job and were very courteous and I know they were busy. I assumed the spring would most likely be when it got done. I contacted Wade 3/23/23 to check in with Wade to see when approximately we might get things done and to let him know the area was cleaned, prepped, and ready. I never got a response. Out of respect I realized he is behind on his work and my project wasn't urgent so I just waited. I contacted Wade again 5/15/23 again to get an idea when this would be completed. No response. I contact Wade again 5/16/23 and 5/17/23 but no answer. Wade has turned his phone off to receiving calls and closed his email account. I also reached out to him on facebook messenger 5/16/23 but no response. At this point I'm assuming that I have been robbed of $3400 which is a significant blow to my family and I. Companies like this should not be allowed to operate as after some research the past couple of days I see that this is a pattern for Wade and he has done this many times. Wade strategically put a po box as his address and has cut off all communication to anyone. I would like a refund if he cannot come and do the job within a week as he has lost my trust and I don't believe that he is coming back.

      In September of 2022 I contracted Old Time Masonry to do a number of jobs including chimney repair and sealing the wood under my deck. I paid for the jobs in cash as was requested and *** the jobs but the sealing was completed. The price I paid for the sealing job was $1200. I c***ed Wade H*** *hroughout the rest of the year but was told the weather was too bad for the job to be completed. In 2023 I c***ed again and was told that Mr. H*** had cancer and that my job would be done regardless., Ii was c***ed by Mr. H***'s son in July and told that he would be out to do the job the following week, but it wasn't. Now when I c***, I get a recording that says the party is not available. I would like a refund of my money..

      The issue is a failure to repay a sum of money. The business owner has promised to repay a down payment. He said that the re-payment would come in three installments. The first would come about June 3 of 2022, the second about July 3, and the final one about August 3. Today's date is December1, 2022 and no money has been re-paid. There has been no response to my repeated calls for an explanation. The business owner told me that there would be a re-funding of my money when i spoke with him on May 10, 2022

      On January 2, 2021 I contacted Old Time Masonry for a bid. **** **** came to my home at **** ******** Place and gave me a bid of $4480.00. To take out a stone wall, widen the driveway, and replace the wall. I said I would get back with him after our January 2021 vacation. He called me a couple of times in January to ask if I was going to do it and that I needed to get down payment in so I could be put on the schedule. On February 3rd, 2021 he came back to my house and we discussed what I wanted done again and I asked if it could be done in March because our street and driveway aprons and curbs were being done and I wanted the new apron to be the size of new width of driveway. He gave the impression that was going to happen and even wrote on contract (curbs in March), and I paid him $2240.00. I contacted him at the end of March asking why he hadn’t come and when we were on the schedule. He got angry and told me that I sure wasn’t patient and that we had had record rain and that there were a lot of jobs ahead of me. Something he failed to tell me when taking my deposit. He continued to message me weather reports and excuses. I have since sent him messages and emails monthly or bi-monthly. At first he would reply and say he’d check the schedule snd get back, but never did. The last few messages and emails I received no reply. It’s now been 11 months and I would like a full refund of my $2240 deposit. I have saved all phone messages from Wade and all of my messages and emails. I can also produce the contract dating acceptance of check on 2/3/21. Any help would be appreciated. At this point, we just want a refund of our entire deposit.

      We contacted Wade in July 2021 to complete a large wall for our historic barn. He quoted us $15,000 and said he would start the project by the fall. We gave him a $7500 deposit which was immediately cashed. I contacted him in October and he said he would complete the project before the ground "froze". My husband and I have reached out to him and left telephone messages for the last month and have had no contact. We would like our deposit returned in full before January 1, 2022.

      On May 17, 2021 I contracted with this man to build a Firepit 2’ x 6’ to be completed within 30 days. I gave him a check for 50% ($900), which was cashed the following day. After almost 3 months of excuses, it is too wet, I do not feel well, I will be there Saturday, I just want my money returned so I can contact someone else. He does not answer my texts or voicemails.       I have tried to view the attachments sent by the consumer and I do not have infront of me the contract between the customer and myself but would like to provide it tomorrow if possible. I agree with the customer that it's taken a little longer to get to her project than I thought I could but not due to my negligence or intention whatsoever and I did not guarantee that I could get to her project nor be completed with it within 30 days as she claims in the complaint.

      I did say that I would try to work her project in my schedule in between jobs if I could and that if so it could be as soon as 30 days not that it was for sure whatsoever. I also explained to her as I do each and every customer whom I contract with that if there's any rainfall I will definitely be off schedule because 99% of my work is outdoors and most are retaining walls which we cannot work in the rain nor can we lay a mortared wall if it's going to rain within 4 -8 hours after we have laid it because the mortar will wash out especially on a hillside and if we're not doing a wall we are still working with mortar which cannot be done in the rain and still requires at least a few hours to set up so that a rain will not wash it out or weaken it.


      With that being said in our written contract which I can provide to you states that I have (180) business days to do the job contracted not counting rainy days nor delays beyond my control which I can provide the weather map of all the rainfall we've had since the day this customer and I signed the contract and it will show more than not and I must mention the jobsite where the fire ring is to be built is a complete mud hole where it's been excavated to build a new home and there's absolutely no grass or groundcover whatsoever so when it does rain it's a muddy mess for several days afterwards until it has time to dry up enough to walk on it and we will need to drive on this area to get stone and materials close to the area the pit is to be built.

      If the rainy delays wasn't enough I infact did have some health issues that delayed me as well which I did infact inform the customer about and she didn't seem to have any sympathy or consideration about them although I was hospitalized several times from the time she accepted my contract to date which I can provide proof if necessary and one of those times I stayed in hospital for 6 days for a heart attack and others were one day stays but I had kidney stones thise days and was unable to move from my bed due to unbeli6pain eachbtime until the lodged stones passed and these lasted from 3- 7 days each themselves.

      One more thing I'd like to say is the statement that I never answered her calls or text is completely false, I may not answered everyone of her calls immediately but I certainly answered several of them and I also returned each and every single call if she left me a message or I text her. I can also provide my complete call history between us as well as the text which I'm certain she would not want because it would certainly show that her accusation about the calls and text are completely false and fabricated.

      With all this being said I apologize it's taken longer than I expected and longer than she wanted but there's things beyond my control that has caused delays which prevented me from getting to her project as I'd liked to have done and for that I do apologize and wish that she could see my point and have a little more patience and understanding of how my side of the coin looks and work with me another 2 weeks and I will go out of my way to get to her project and get it finished promptly and I guarantee she will love it and enjoy it for many years afterwards.

      I have no hard feelings nor am I upset that you filed this ***** and somehow I do understand your frustration and only wish you could understand my delays were not fabricated nor done intentionally. I hope you agree to the 2 weeks and I will get this finished. Thanks

      i just want my money back please.  I cannot believe anything he says because he has not followed through on numerous occasions.  In fact, he asked if I would like it completed in 30 or 60 days and I said 30.  We have had rain but he has had more than ample time to complete this project.  We were using stone from our property and I told him they were ready to do the final grade.  He said we will be there on Friday.   He was a no show and no call.  He said give him one more chance and he would be there Saturday.  Again no show and no call.  I have lost faith in him and would just like my money back please.

      A refund is not a problem whatsoever but it will be according to the written contract which will require a $500 cancellation fee deducted from your initial deposit since I am still trying to perform the work contracted and the customer has rejected my attempt to complete the project per contract although she feels it should be done at her request not per contract . So, I have no problem issuing a refund less the fee immediately and we can close this issue or once again I am still willing to complete the project within a two week ti mbv e frame and resolve the issue. It's now up to the customer. Thank you

      This is unacceptable.  I gave him $900 which he immediately cashed and has not done what he said he would.  He is the one who has broken the contract.  I have been patient with all his excuses until filing this complaint.  I do understand why it has been one thing after another and then refusal to return my money so I can hire someone else.  I would like my money returned in full if this project is not complete in the next 10 days.  When I signed the contract and asked when he would do it, he asked if I would like it done in 30 or 60 days to which I said 30.  Despite illness and weather, which has been very good, the job is still not finished or even started.  I understand but if you cannot do it, please return my money.
