My son and I purchased a home that was contingent on a new roof being installed prior to closing. The closing was scheduled for 12/01/2023, in the event that the roof was not installed prior to closing, the funds were to be taken from the proceeds and be held in escrow by an attorney until the job was completed. The roof was completed a few days prior to closing. It was our understanding that there was a warranty on workmanship and materials. The seller did not provide us with any information or documentation. Early in January of 2024 we had a leak in the roof, I contacted ***** ****** the owner of DunRite roofing about the leak and inquired about how I could obtain the warranty. While he was here to evaluate the leak he told me that sometime in March I would be able to go on ***** ******* website and obtain the warranty. When I contacted ***** ******* they said since 30 days had passed they would could not provide a warranty, when I explained about the contingency on the sale, they asked me to obtain specific info from the contractor, he ignored my repeated requests, he finally told me to contact his OC rep **** ******* which I did, I provided him with the sales agreement and he told me I was entitled to the warranty. He asked *** ****** to provide me with the document(s). ** ****** continues to ignore the many phone messages and texts that I have sent him asking for the warranty. What I want is the warranty that was provided to the seller when the roof installation was completed as well as an invoice for the work. The warranty should apply to the purchasers (my son and I). I have been trying to get this for nearly 6 months. I have put so much time and effort into this it's unbeleivable.
