      The company commuted fraud and forged records. I have original paper I signed and they filled in my copay I owed as a down payment which it was paid in full. They billed after I paid in full for work they never did but fraudulently charged State Farm. They only replaced roof and never did any work in my house. I still have water stain on my ceiling. They stated they did drywall work and painted and that is a total lie. Scammers Unleash the credit department or I will sue they forged paper work and can prove they did zero work on inside of house.

      This job was installed in 9/18 as doing a truss and roof repair due to a lightning strike. Permit was obtained from local building authority, an outside independent engineer was hired for consult on this job, and we worked closely with the Homeowners State Farm Adjuster to make sure everything is right. We have signed contract on the scope of work being completed and we completed that work. In 2018. We wrote the unpaid balance on this account off in 2020 after numerous attempts and even turning over to collections department to collect unpaid balance with absolutely no communication from Homeowner.

       

      The complaint also stated that we billed the insurance company which is totally incorrect. We do as everyone in the industry does, write supplements to a claim on behalf of a customer for new work or work discovered while in the process of a repair. Payment for these supplements goes to the homeowner as they are the payee with a contract with the insurance carrier, not us, they would then pay the contractor to complete the repairs written in the supplement. 

      I would welcome the ability to litigate this case if the homeowner would so wish to go to court. After 2-3 years of us being having an unpaid balance.

      I have reviewed the response made by the business in reference to complaint ** ********* and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below.

      They received my deductible as final payment. I do not owe anything more and absolutely no work was done on inside of my home as they are billing for drywall and paint which is fraud. State Farm is aware of fraudulent billing and stated I only owe my deductible which was paid. Your company filled/forged document after my signature to represent a down payment I have pictures of paper I signed and then after I signed you filled in that my deductible was a down payment. I assumed done since I paid In full my deductible. State Farm says I owe nothing more.

      Signed a contract for roofing services on 8/27/2021. Roofing contract partially fulfilled on 10/15/2021 & I was invoiced. The satellite dish which was not suppose to be put on was reattached to the roof, also were some additional charges that weren't in the scope of the insurance allowance. Prior to me signing the contract with AnyWeather the point of contact (POC) assured me that the insurance would cover any unanticipated costs. Unfortunately the insurance notified me on 8/18 that the portions of the roof decking & fascia board were damaged by rot and not covered, which was an additional cost of $1,191.57 of unanticipated costs. When I received the original invoice in 5 November I called AnyWeather and talked to ******** to let her know that I hadn't received the insurance check yet & that I needed to talk to my POC regarding the extra costs. ******** informed me not to worry that I would be charged any let fees that they understood I was waiting for settlement from the insurance company. There started approx a month of going back and forth with the insurance company & the POC at AnyWeather. On 12/6 I requested to speak to the Supervisor of the POC and at that time I spoke with him and we came to an agreement regarding the additional costs, along with the removal of the dish. On 12/13 noone from the company had removed the dish or contacted me regarding the removal of the dish. I contacted the supervisor that I had previously spoken to and said that I would not be paying until ALL the work was completed satisfactorily, the removal of the dish. I sent another text on 12/16. Around 12/20 the dish was finally removed & I sent payment on the 28th of December 2021 which was cashed by AnyWeather on the 2 January 2022. A certified letter from AnyWeather came to me that they put a lien on my property due to non payment. I contacted AnyWeather on 24 Jan and 14 Feb the lien is still in place.

      I have reviewed the file in its completely. As a business we very much dislike ever having to file a lien on a job completed. It's difficult for all parties involved. The period of time to file is set by the state and we have to follow those guidelines. Luckily we do not have to do it often. In this particular situation our attorney filed it and upon payment we notified our attorney to remove it. Our office has a very well documented series of emails with request to get it removed and satisfaction sent to us. My investigation has found that the satisfaction was filed and we are awaiting the physical satisfaction from the court house. Im not exactly sure why it takes so long, if it is a staffing issue over there or other issue. As soon as it is received it will be forward to all concerned parties.

      I have taken the liberty to paste the whole file of communication on this file from beginning to end. It very accurately with time and dates shows the communication we had with customer. It shows the the willingness of our office to work with the customer and even the original request of investigating "the wood as her gutters were sagging" but we did go ahead and drop that charge after insurance carrier took the stance of not making her whole on the claim.

      on the xactimate from state farm and ours i see 20sq of shingles going on and only 9.33 sq of felt being estimated. I do see 7.75 square of ice and water but it still leaves a gap.       AnyWeather is very sorry that the customer feels so mistreated. We do business with 100's of very satisfied customers each year. We work hard to accommodate the needs of each one of these individuals and do the very best by them. The main core value we live by is integrity. 

      Every so often we find a customer that we can not seem to make happy and it is unfortunate and we do not like it, but do understand the dynamics of it.

       

      In reference to latest response from our customer here

      The lien when and if we have to file, (which is only done to protect our financial position in the transaction) is always filed in the county in which the work was completed.

      The original filing is always maintained by the courts and any request for records is always a certified (by the courts) copy

      My deepest apologies go to the customer as to our crew putting what they thought was an important part of the homeowners equipment back on the roof. It was not communicated to them that the dish was to be permentely removed. Most often it is communicated with them and for whatever reason this incident was not. We made it right and removed it.

      In reference to the credit given to the customer, I mis-spoke about what it was for. The credit given was for the roof decking that the customers insurance carrier did not cover.

      The rights provided by the State to provide a way for a contractor to ensure payment for a job completed were not put in place by AnyWeather. Any disagreement with these process should probably be directed to State Legislature for modification if needed, not AnyWeather Roofing.

      In summary we contracted for a job with the customer when she was in need of specific things being done. We helped to navigate the confusing world of Insurance and we completed here job and made everything right. We have been paid for the job we completed. The work completed as contracted.

      Tell us why here...I just want the record to be clear it is not the fact of the quality of workmanship it is the policy and procedure of attaching a lien on a property when the customer is in active litigation with; a) the insurance company & b) the company known as AnyWeather.  It is not a matter of not paying but a matter of AnyWeather completion of a job, as soon as they completed the work AnyWeather was paid.  The lien was levied against my property prior to the resolution or the work being completed.

      The other issue is that it is, as I stated originally, that the lien was put on in December but wasn't released until February after I contacted the BBB.  Also note that I had contacted AnyWeather on 2 separate instances regarding the lien being taking off. 

      Am I satisfied with the work done?  Ultimately Yes.  What I am not satisfied with is the policy of a lien being levied on a property prior to a final invoice being received & paid.  Note that once that final invoice was received payment was issued within 2 weeks, the time that it took AnyWeather to complete the job.
