      I ordered( 25 ) 4 to 5ft Emerald Green arborvitae’s shrubs in January of 2023 for late spring delivery. We agreed on delivery for April 13th. The owner texted last minute indicating that date wouldn’t work. In light of that information, I reassessed my area and asked the sales manager Iliana A*** can I add an Additional ten more. I received the payment link and paid for an additional (10 )4 to 5 ft Emerald green arborvitae’s. At this time, that’s a total of 35 I have payed for in full to all be delivered on Friday. The day of delivery the driver/owner stated his ETA wasn’t until 8pm on Friday and we spoke on the phone. That same day…he tells me he only has (32) shrubs in total not the 35 I paid for. He proceeded to state I have (15 ) 5 to 6 foot and ( 10 )4 to 5 ft and (7 )ugly ones ( which means they don’t look great and he ll give me those for free) a total of only 32 not 35. I’m like well the 5 to 6 ft is cool but I asked for all 4 to 5 ft shrubs to have symmetry( back in January) and you tell me this the day of. The sales manager never even mentioned this through all our email correspondents. However, since he said he ll give those “seven uglies” for “ free” i said ok I’ll try to revive them( why not since there free. The next day when I asked for the refund he had a different tune. I said well you have to refund 3 anyway bc it’s only 32 here (not the 35). In total, he refunded 5 (3 of which was bc he only had 32 not the 35 that I paid for in full. They left me with 7 not in good health shrubs-which is why they referenced them as ugly. I paid all that money and that’s what I got. I would like all of my money refunded. I had to dig up all those shrubs buy and replant new ones( I have receipts from **** ***** for my new purchase) I had to buy new soil ,compost and the back breaking work to replant. The company knowingly gave trees we both knew were in bad shape and hoped I could revive and refused to return my money. I would like all my money back.

      Hello,

      I’m asking to be refunded $800 dollars for the following reasons.

      -They knowingly delivered 7 “bad” 4 to 5 foot Emerald Green arborvitae shrubs and the agreement was he would refund all 7( would be for free) since he knew they were in bad shape. Instead, after the fact he decided to only refund me 2 out of the 7 bad trees( which was not the agreement). I wouldn’t have accepted the shrubs that way if he hadn’t stated they would be for free.


       I paid for 35 shrubs at 60 dollars for each shrub ( he only delivered 32). He “had”to refund three at the very least bc he didn’t deliver all of the product. The ones he did deliver ( from the 32 were in horrible shape).

      So, the refund I’m requesting is for the 7 bad trees he delivered for which he only refunded two-Leaving me with 5 bad ones for which did not survive with regular watering and proper planting. 

       They all had to get dug up. I had to pay for more soil, mulch, compost and five new shrubs to replace them. To add, two of the 5 to 6 foot Emerald green shrubs were pruned off from the top( not growing in pyramid shape as they should) Sadly, these shrubs take a really, really long time to grow and recover. Ordering from
      this company was the biggest mistake. Later, it was easy to find beautiful, well shaped and  maintained Emerald green arborvitae’s at big box stores such as ****** and **** *****( mind you where I bought five brand new ones). I used there services because I liked the ideal of delivery( biggest mistake I ever made).
